1 TUESDAY, MAY 23, 1950 CHILLICOTHE (OHIO) GAZETTE AND CHILLICOTHE NEWS ADVERTISER PAGE THREE Jury Hears Claim Against Eagles Lodge Claim for $8,000 damages from the local lodge of Eagles brought by Stanley Dixon, former program director for radio station WBEX, was being heard before a jury in common pleas court, Tuesday. Mr. Dixon claims permanent injuries sustained several months ago to his left leg, which was fractured when he fell on a stair. way in the clubhouse on West Fourth street. He charges that his fall was due to the fact that the stairway was defective.

Mr. Dixon is represented by Attorney William W. Stanhope. The lodge is represented by Attorney John L. Yaple, who counters that Mr.

Dixon's fall was through no negligence on the part of the lodge, that the incident which occurred was purely accidental or due to the plaintiff's own negligence, and that at the time he was enjoying the privileges of membership of the club and as a result is debarred from any damages even wise he might be entitled to them. Members of the jury hearing the evidence in the case are: J. E. Durrant, Jefferson township; Benjamin Thompson, third ward; Fred Norman, second ward; Thomas Dennis, Concord township; Roy DeFeu, first ward; Marian Zurmehly, Union township; Roy C. Miller, fourth ward; Leonard Annon, Scioto township; Lola Palmer, third ward; Frank Fisher, third ward; Howard Laymon, third ward; Edna Bell, first ward.

Wiseman Re-elected Robert Wiseman of the Chillicothe Phalanx fraternity was reelected president of the OhioWest Virginia area tribunal during a two-day meeting, Saturday and Sunday, at Camp In-A-WenDe-Win on Turkey Foot lake near Canton. Attending the tribunal from Chillicothe were Mr. Wiseman, Orris Gilmore, Ronald Hand, Jack Bumen, Richard Williamson, Robert Yerian and Gerald Bethel, The local Eta chapter of Phalanx was in charge of devotional service at the meeting. Principal speaker at the conference was Herbert F. Heine, former Chillicothean and now general secretary of the MassilIon YMCA, whose topic was, "Do You Have Your Feet on the Ground?" The local Phalanx group will have its annual banquet Thursday, at the Fox Farm, to honor the outstanding high school Hi-Y boys of the year, The fraternity also is sponsoring a 50-50 dance June 2 at Central gym with Doc Roll and his orchestra and the Melodiers.

Train-Flagging Fails To Save Portsmouth Man PORTSMOUTH, May 23 (P) Wanda Hoskins, 15-year-old high school student, tried vainly to flag down a Baltimore Ohio railroad train last night before it struck and killed Sam Templeman, 54, police reported. F. Hagemann, Stevens, Yaple on Ohio Bar Program Probate Judge Kenneth T. Stevens and Attorney John L. Yaple of this city will have places on the program for the Ohio State Bar association annual meeting at the Neil House, Columbus, May 26-27. Judge Stevens will speak on 'Land Contracts in Decedents' Estates" during a panel discussion on probate and trust law.

Attorney Yaple, as a member of the council of delegates, will participate in a meeting of this group. The council will receive reports and recommendations of various bar committees and determine policy matters of the association. About 20,000,000 persons live in the Ohio Valley. Smithson Accuses Club Owner NEWPORT, May 23 (Ph Paul W. Smithson, 39, defaulting Waverly, 0., banker, today signed warrants charging James Harris, alleged operator of the Club 19, with pandering, operating a disorderly house, setting up and operating gambling, and banding confederating.

"Smithson recently entered Cincinnati police headquarters and said he had taken $6,000 of bank funds. He said he lost most of the money while gambling at Club 19. The club is situated near Wilder, where Harris is the marshal. Smithson was brought from Cincinnati in a police cruiser to the office of Wesley Bowen, Campbell county attorney, to sign the warrants. Others against whom he signed warrants are Dwight Penick, Ray Haggard, alleged owners of the club, and Ollie J.

In addition, "John Doe," "Richard Doe" and "Jane Doe" warrants were signed. Tryling is charged with pandering and banding and confederating. Smithson was released late yesterday on $2,500 bond.
