THE WASHINGTON POST FRIDAY MAY 11 1906 REVIEW BY COURTS What the Amendments to the Rate Bill Provide a CULLOM PROVISION BROAD 1 Specifically Prescribes Legal Pro ceeding to Set Aside Comparison with Amendment Introduced by Mr Rayner Providing the Limited Review Contended for by Senators DoUirer Long and Other Intimate Advisers of the President Some Senators May Vote Against Earlier Views rrom New York Timet Th Cullom amendments to the Hepburn rate bill which are now at hand In the printed form not only show tbe nature or the changes agreed upon by the Republican majority the Senate Unit bring clearly Into lew the defects of the bill as introduced notably In wspect to the Te view of tbe commissions orders by the courts As drawn the bill provided that orders of the commission fixing Just land reasonable rates should remain jin force unless the same shall be suspended or modified or set aside by the commission be suspended or set aside by a court Competent Jurisdiction This ts the narrow court review pro islon which from the beginning has seemed to hare the approval of the President and which has been stubbornly defended by the Senators whom he has taken into his councils Point Raised by Senate Lawyers TIip best lawyers In the Senate have raised the point that this clause merely rwopiuzes a right which the act could jollier onfer nor take awa he right lie carrier to file a bill In the Circuit 1 asking that the commissions rate bo set aside on the ground that it violated fifth amendment prohibiting the tak me if property without due process of terms of an amendment Introduced by Mr Rayner and printed with the Cullom amendments which Imposes upon tho jurisdiction thus rested the courts these limitations But such Jurisdiction shall not attach tipon the bill or petition of a carrier for the purpose of enjoining setting aside annulling or suspending any order or requirement of the commission unless the carrier alleges In Its bill or petition that Its property has been taken In violation of the fifth amendment of the Constitution of the United States or that the commission has exceeded the Jurisdiction confer red upon It by law and in the bearing and determination of such suit the court shall be limited to said allegations so set forth in said bill or petition This Js the limited and imperfect review so strenuously contended for by Senators DolUver Long and other Intimate advisers of the President It has been supposed that the President himself was opposed to the broad review principle Mr Rayner is a Democrat By attaching his amendment to the Cullom amendments which it Is understood are now acceptable to the entire Republican majority some of the Presidents friends have been put In the position of having to vote against their own political and within the exclusive prn mi of Congress Mr Earners Proposal nis is manifestly a broad and full court re tew Its breadth and fullness may be leariv conceived by comparison with the From the Jw York Tribune The unanimity with which the compromise between the broad review and narrow review factions in the Senate has been accepted seems to prove that differences of opinion in that body on rate legislation were more apparent than real The Tribune has all along maintained that the issue between the two groups of Senators had been befogged by over technical treatment and that the court review question could be settled when each side knew what the other actually wanted The understating now reached shows that the two factions were never very far apart for each asserts that it is satis fied with the machiner provided for testing in the courts the validity of rates made by the Interstate Commerce Commission The broad reviewers contend that they have carried their point because the Federal circuit courts are empowered to hear suits brought against the commission Left the Courts Open But if this is all they desired to ac complish they have secured a concession which the upporters of the Hepburn bill never intended to withhold The framers of that measure and its supporters in the Senate have always ar pied that it left the courts open to any plaintiff who might feel like contesting the decisions of the commission The rates prescribed were to remain in effect unless suspended or annulled by the courts and no restriction was placed on an appellant seeking redress or on the power of the courts to entertain his suit By the terms of the Allison agreement suits must be brought under certain limitations as to venue and with certain restrictions as to the iosue of interlocu I tory orders Undefined Phrase Excluded Moreover the grounds on which a rate may be challenged are narrowed by the excision of the term fairly remunerative a phrase undefined by the courts and the conditions which a rate must fulfill to be binding are simply that it shall be just and reasonable words which have been applied in manv decisions interpreting the interstate commerce law The Hepburn bill set up three standards of validity for measuring the commissions Judgments The amended Senate bill prescribes only two and in this respect is an improvement But this change as well as the others agreed on is plainly in the direction of narrower rather than broader review Underlying Principles the Same We cannot see therefore in what essential respect the Senate measure departs from the underlving principles of the Hepburn bill The grounds on which suits xan be brought remain practically un changed Under both bills the courts themselves will have to determine how far their right to reverse the Judgments of the commission extends They are as little likely under one act as under the other to constitute themselves administrative bodies of a superior class with power to ao the Interstate Commerce Commissions work over again whenever the expediency or good Judgment of that work is called in question On the other hand they are certain to defend the constitutional rights of appellants and to annul any attempts at rate regulation which amount to the appropriation of property without due process of law This was the result aimed at by the House measure and is a result with few days ago wiseacres at the National Capital who apparently had not previously known of the Presidents Intention to send in a message on the Standard Oil trust announced with a great show of agitation that the message was to sent in as a blow at certain Senators who were In favor of the Senate rate bill As we stated at the time the report was sillj because the President is well satis fied to have the court review amendment in the bill inasmuch as such able lawyers as Root and Knox Insisted on It A oiactlcally official announcement from the White House now practically confirms what was previously known of the Presidents position I No Idea of Preventing It Not belmj or professing to be an expert on constitutional law the President Is well content to have the amendment adopted He therefore had no Idea of preventing the passage of the court review section of the rate bill and certainly had no thought of that section in mind when he determined some weeks ago to send Garfields report to Congress with a mes sage of his own The rate bill as amended by the Sen ate has the support of practically every leader of the Republican party at Washington except possibly Speaker Cannon It Is therefore fair to assume that it will become a law without much delay It will stand on the statute books as largely due to the strong and Insistent efforts of the President to have government supervision of interstate commerce Abuse of the Senate For some months the Senate has been undergoing a storm of abuse from that class of writers whom the President has aptly likened to the man with the muck rake In all this time the Senators have made no public reply for the reason that most of them felt that it was useless to reply to such evident unfairness Justly enough In this case the reply comes from the President himself who lets it be known that he stands ready to approve of the work done by the Republicans of the Senate and to indorse It by signing their rate bill when It comes to him The Muck Rake Critics The President has also recently tak3n advantage of a proper occasion to char acterize the muck rake critics as they hove so fully deserved And there Is no question that public opinion in this country als3 revolts against the wholesale and utterly inexcusable abuse of men like Knox Sjrticner Crane Allison and other pr minem Republicans as somehow opposed to the partys policies These men still stand with the President as Republican leaders He takes and profits by their counsel Their Cause His Own Possibly one or more of these Senators has differed with the President at times on details of the administration plans But that has made no difference In his relations with them or In his respect for their counsel and Judgment He has made their cause his own under the spiteful assaults of the muck rakers And the notable and typical effect among the critics has not been to stop their assaults on the Senators but to turn those attacks against himself Consequently the public can now fairly class the muck rakers as Just as bitterly opposed to the President as they have been to the Republican Senators for hot accepting socialism as the best national ideal and policy crop reporting board of the Bureau of Statistics Department of Agriculture The area under cultivation May 1 was S9K3000 acres The average condition of the growing winter wheat crop on May 1 waa 91 as compared with 9 on April 1906 92 on May 1905 78 on May 1 J904 and 85 the mean May average for the last ten years The average condition of winter rye on May 1 was 93 as compared with SI on April 1 1906 94 on May 1 1905 SI on May I 1904 and 89 the mean of the May averages of the last ten years The average condition of meadow mowing lands on May 1 was 92 against 93 on May 1 1905 85 on May 1 1904 and 90 the mean of the May averages of the last ten years The averago condition of spring pasture on May 1 was 91 against 92 on May 1 1905 fO on May 1 1904 and S9 the mean of the May averages of the last
