The Cuyahoga County lawmaker said the Supreme Court has made it clear in its ruling that parents cannot have the last word in prohibiting a minor from having an abortion. Rocco says its main purpose is to define the term "informed consent," and to try to deal with concerns about abortions for minors under 16. The bill also contains recordkeeping and other regulations for abortion clinics. The legislation is one of more than 100 measures up for hearings during what is expected to save 6b7oLu be a busy week for committees and subcommittees of the two chambers.

Senators return from weekend recess tonight and the House reconvenes Tuesday morning. Rocco said the informed consent portion of the bill, in effect, seeks to end the practice under which a woman electing an abortion and the physician "have their first meeting at the operating table." Rocco said the U.S. Supreme Court held, in effect, that abortions may be performed during the first trimester of pregnancy because interference by the government would be a violation of privacy between physicians and their patients. He said the vast majority of abortions in Ohio and elsewhere occur at clinics where there is no prior consultation between the woman and the physician. His bill requires such consultations, and establishes a 48-hour waiting period, from the end of the consultation, before an abortion can be performed.

With regard to minors, the bill provides that abortions may be performed either with parental consent or by means of a court order.
