Jack Dayan and Bernard Apanel, declined to give a reason for the action and later was forced by a Circuit Court Injunction to restore to them sociate staff privileges.

The two doctors, through the attorneys, charged that they were being discriminated against because they were of foreign birth and that they had been removed from the staff of the public hospital Avithout due process of law.
