Trial at Lynchburg Large Corps of Investigators Operating in District and Other Seizures Probable Reject Compromise SHERIFF BEARD KILLED Special to Tb Washington Post Danville Va Nov 8 The large plant of the Dry Fork Distilling Company Inc located about fifteen miles from this city is closed as the result of a second seizure by the United States revenue officers on the charge of defrauding the government About a month ago a large corps of revenue officials headed by Chief of Division of Itevenue Agents A Gates of Washington and District Attorney Thomas Lee Moore raided the distil lery The government officials had examined the books of the railway company at Dry Fork and found that large quantities of whisky in excess of the amount on which tax was paid were being shipped almost dally Angle the manager for the Dry Fork Jjistllllng Company was arraigned before Commissioner Capers who required him to give bond for 14000 before the commissioner of revenue for this district It has been claimed that the bond was irregular and should have been given before United States Judge Henry McDowell of this district Wednesday night another seizure was made and the distillery will remain idle until the bond can be given properly before Judge McDowell Investigating Revenue Frauds Half a dozen revenue officers are in the city to night but they decline to be interviewed In addition to these officers many others Including Col If Chapman revenue agent for Virginia are now operating in the country within a radius of twenty miles of this city Other seizures are expected Manager Angle of the Dry Fork company was called up to riight by long distance telephone by The Post correspondent and said that his bond was ready to be filed and that operations would be resumed shortly The place was formerly known as Piggs Distillery He said that many revenue officers have been shadowing his and other places in the neighborhood for some time Last Saturday night he said six offi ers slept in the woods near here and In the morning following inspected th etilt Angle says that thsre are many other distilleries in the Dry Fork neighborhood shipping whisky and he declares that the excess shown by the railway re idjiis does not show that his conipany has violated the laws The regular fall term of the Federal Court of the Western district convenes next Tuesday morning at Lynchburg and come highly sensational developments are expected to follow as indictments ar considered certain It is generally believed that the continued presence in the neighborhood1 of the many high officials of the revenue and secret services is the forerunner of a round up of other violators of the revenue tax laws Several government storekeepers gangers and UistiilTs will be tried upon the charge of collusion in defrauding the government Kxpertaccountants have for months been engaged in going over the records here oi the railway and express companies Supply Dry Districts Distilleries have sprung up like mushrooms around this city since the recent temperance laws were enacted in North Carolina Being only three miles from the North Carolina border line Danville Is an ideal shipping point to Greensboro Durham Charlotte and oth dry towns Commissioner of Internal Revenue John Capers was notified yesterday of the seizure by government agents of the Dry Fork Distilling Company This is one of the distilleries which it is said has been defrauding the government out of internal revenue taxes by means double runs and certain other methods known to distillers who desire to evade the payment of the excise of J110 on every gallon of spirits produced The report states that fraudulent opera tlons have been going on there for aboul two years and it is estimated that the government has lost between 75000 and jluO000 during that period The capaclty of the plant is about 1200 barrels or between 50000 and 60000 gallons annually and if the revenue officers estimate is correct it would signify that for nearly every gallon on which the tax was paid a gallon was surreptitiously manufac tured Distillery Valued at 5000 The value of the distillery is placed at between 4000 and 5000 and when It was raided sixty barrels or nearly 300 gallons of spirits were afso seized Including the tax the whisky is worth about J45O0 Yesterday afternoon a representative of the distilling company called at the Revenue Bureau and offered to pay 7000 to compromise the case but Commissioner Capers declined to consider the proposition Should no compromise be effected It means that the plant and its product will be sold under forfeiture and the owners prosecuted criminally The Com mlssioners present disposition Is to let the case take its course The seizure at Dry Fork is the fifth or sixth that has been made in Virginia during the last month or two and it is expected others will be made in due course for the frauds as stated a few days ago have been very extensive Thus far the plants raided were of small in the city late this afternoon from Lynchburg with his daughter Mrs Perkins of Sanford Fla who was en route to her home He had Just kissed her and his little grandchild good by and was attempting to hoard a moving north bound train when he lost his balance fell under the train and both of his legs were cut off He displayed remarkable nerve and directed his rescuers to notify his relatives Sheriff destroyed by fire to day causing a loss of two lives and more than 100000 John Foley a fireman and John Dewey shipping clerk were caught by falling floors and buried under tons of debris Firemerf Haggerty Clark and Botkin were also struck by flying debris and injured but not fatally The fire originated on the third Moor of the grocery house where repairs were lieing made to the elevator and Is sup posed to have caught from a mechanics gasoline torch The Ruffner Hotel building adjeins the grocery and for a time was in imminent uanger of destruction as also was the entire block The building unanimously agreed that the only feasible plan would be to pave the street the full width with vitrified brick and to widen the Hooffs Run bridge to conform to the street Estimate of Cost Ordered The city engineer was directed to prepare an estimate of the cost of the pro posed improvements The mayor was re quested to communicate with the board of supervisors of Alexandria County adjoin ing property owners and other interests and to arrange another conference at the earliest opportunity It is expected that at the next confer ence President White of the Washington Southern Railway will be
