Pa. (AP) W.A "Tony" Boyle's lawyer has taken the offensive in the murder retrial of the former United Mine Workers Union president, accusing the prosecutor of using the case of furthering his own career. Defense Attorney A. Charles Peruto, in i his opening address Saturday, said special prosecuor Richard A. Sprague was "building himself national reputation as he went step by step up the ladder" in his quest to get Boyle.

Sprague was the prosecutor in the spring of 1974 when a jury convicted Boyle of arranging the 1969 assassination of union rival Joseph "Jock" Yablonski. Also killed on Dec. 31. 1969. as they slept in their Clarksville.

home were wife. Margaret, and the couple's daughter. Charlotte. "We are going to show you that the cold blooded murderers made deals with Mr. Sprague." Peruto told the jury of 11 men and one woman.

We're not saying Mr. Sprague asked them to lie, (but) his were the on the strings on the puppets." Peruto's attack surprised spectators in the crowded Delaware County courtroom of Judge Francis Catania. It was in sharp contrast to Sprague's low key presentation. The former Philadelphia sistant district attorney, who already has convicted or secured confessions from eight persons in the Yablonski conspiracy, outlined in careful detail what he expects to prove against Boyle. "You'll hear how the defendant arranged for the killers to be paid with money from the union.

Sprague told the jurors. He emphasized Boyle twice gave orders to kill Yablonski. Peruto. however. said it wasn't Boyle who set in motion the murder plot.

He named as the chief arranger Albert Pass. secretary treasurer of the UMW's District 19 which embraces what Peruto described as the vioence-ridden coalfields of Kentucky and Bulletin 1 Board where Robert Pace cut his forehead and nose.
