Harvey Pierce through attorneys Charles Darr and Julius I Peyser filed suit yesterday in the District Supreme Court against Otho Hammond and Robert Bradbury asking the court to annul a contract entered into November 16 1908 between himself and the defendants to purchase 36 lots in East Washington Park and to cause the defendants to reimburse him for the moneys expanded In connection with the contract on the conveyance to them of those lots which now stand in his name Mr Pierce alleges that he was approached on August 16 1908 by Mr Hammond who represented to him that the land could be purchased for 3500 According to the contract entered Into In November the petitioner was to subscribe 500 to the purchase price while the defendants were to subscribe an equal sum each Mr Pierce alleges that in 1511 he accidentally learned that instead of costing 3500 as represented the property had been purchased for 2400 that he was the only party to the agreement who had paid the original Desertion His Mother Testifies She Tantalized Husband Because He Was Handsome When Angry Justice Wright yesterday dismissed the suit brought by Mrs Eleanor McGill Carr daughter of Dr McGill a wealthy physician of Jersey City for a limited divorce from Dr William Carr assistant surgeon In the United States army for lack of jurisdiction Mrs Carr has noted an appeal The Carrs were married at midnight March 21 1909 while the young army officer was a student at the Army Medical School in this city and the bride returned immediately to her fathers home in New Jersey While she made visits to Washington at different times Justice Wright decided that she had not remained long enough at any time to establish a residence in the District She Charges Desertion Mrs Carr charged that she had been deserted by her husband on June 1 1910 and he had since failed to support her The husband told the court however that hts father in law had vowed to break him unless he consented to an annulment of the marriage and had challenged him to a duel Mrs Georgia Carr mother of Dr Carr in her testimony asserted that her daughter in law had told her that she tantalized her husband frequently because he looked more handsome when angry This witness also told of threats by the young wife to commit suicide in an effort to frighten her husband into consenting to allow her to have her will Dr Carr announced that he was willing to support his wife if she would live with him but declared that she is now receiving an allowance from her father and has no need for any part of his salary FESTIVAL delightful and genuinely artistic musical performance given by the Washington Festival Chorus under the direction of Heinrich Hammer Haydns can 1 tata The Seasons was sung the great last work of that great composer who In his failing years could yet produce a score of the same marvelous freshness and naive grace as well as deeper beauty that preserves for him the unwavering affection and the admiration of all music lovers A gratifylngly numerous audience occupying a large portion of the immense auditorium showed its appreciation of its own opportunity and of the work of Mr Hammer his singers and his orchestra at this first performance oi the Festival Chorus The soloists for the evening were Mme Alma Webster Powell Paul Bleyden and Marcus Kellermann Mme Powell has a voice of great smoothness and sweetness of flutelike quality in Its higher tones and used with much skill In the ornate passages that abound for the soprano Mr Bleydens well trained tenor Is familiar to Washlngtonlans and his solos as also Mr Kellermanns splendidly powerful and resonant bass were greeted appreciatively It is no Injustice to the soloists however to say that the chief Interest of the evening was In the choruses beautiful music in themselves beautifully sung and well supported by some 30 pieces of the Washington Symphony Orchestra The sopranos are especially delightful for their volume ind fine tone and the whole organization in precision solidity and spirit gives high tribute to its conductors skill and control The work of the orchestra was also most enJ joyable It is to be hoped that this highly successfulsuccessful performance Is only one of many that this well trained choral organization will offer Chamber of Commerce Learns That Silverware Concern Is Likely to Come Them Conform to State Statutes Salary of Municipal Officer Reduced and New Post Created Election Is Void of Interest WASHINGTON POST BUREAU Kin Street Alexandria Health laws for Alexandria to conform to recent enactments of the State legislature which have been before city council several times recently were further amended by the board of aldermen last night by changing the salary of the health officer from 1000 to S600 a year and creating the office of deputy health officer at a salary of 400 a year and certain fees the latter to be the inspector of meats milk dairies The entire ordinance will now have to go back to common council The board of fire wardens ceased to exist yesterday and a joint committee of council will perform its duties in future The presidents of the two boards announced the appointment of Councilmen BIrrell Chauncey and Williams and Aldermen Hill and Summers on the new committee A committee on public health will supersede the board of health and President Smith of common council announced the appointment of Messrs Tates Brockett and Monroe to represent that board President Marbury of the board of aldermen deferred the appointment of two members from that board until the next meeting The annual appropriation bill for the year ending May 31 1913 carrying estimates aggregating SH8000 which passed the board of aldermen at the previous meeting was adopted Council appropriated 500 to be expended by the committee on light in the purchase of gas stoves to demonstrate the utility and cheapness of gas for cooking purposes Little Interest in Election Less than halt the registered vote of Alexandria was polled in the general election yesterday the Democratic nominees for mayor and city couneil having no opposition Interest was manifested In the vote In only two wards the First and Second where Robert Barrett in the former and William Desmond ill the latter were candidates for the seats in council now held by Urban Lambert and Robert Graham both of whom were elected by council to fill unexpired terms and did not enter the recent primary nor file notice of their candidacy in yesterdays election In the First ward Thomas A Fisher for mayor received 128 votes and Mr Barrett for council received 100 votes In the Second ward Mr Eisners vote was 149 while Mr Desmond received 12S votes Through an odd misunderstanding there was no election in
