The satellite penitentiary is to be built somewhere between Salt Lake City and St. George. "I'm elated," said Stephanie Barton of the Fillmore Citizens for Economic Development. "This shows the will of the people is strongly against" the facility.

"I'm glad to see we were able to educate people on the truth and the facts." Proponents had said the prison would bring economic growth. "This facility would not contribute to the tax base of the community, and yet it would be contributing to the tax burden of the community," Barton said. Proponent Terri Penney said opponents used scare tactics. "I heard a lot of older people were told prisoners would infect the town with HIV and AIDS," she said. "I hope those who opposed it will work as hard to bring something in" that will provide economic development, she said.

After publicity about Smith's development plans, SUWA's board of directors reviewed the role of the advisory board. As a result of that review, Smith agreed to step down, said SUWA Director Mike Matz. Smith, who runs a publishing firm in Layton, did not return phone calls. However, in an interview in May, Smith said environmentalists' criticism was misdirected. Development in small towns such as Boulder is inevitable, he said, promising his projects will be examples of how it can be done in an environmentally compatible manner.

Environmentalists privately say Smith's plans to develop properties in Boulder were a public-relations liability for SUWA. OBITUARIES "There is a great need for jobs around here. There are a lot of families that are struggling," Penney said. The prison would bring 100 or more new jobs to the region, with the beginning salary for local employees about 1 0 per hour. The City Council went on record in May as supporting the project and promising to work with MTC to get tax-free revenue bonds to help fund the project, which would take a year to complete.

When the council ran into mounting opposition, its members voted 4-1 in early July for a resolution identifying a 48-acre site in the Fillmore industrial park west of Interstate 15 and endorsing MTC as the exclusive developer. By The Associated Press FILLMORE Fillmore residents have voted against constructing a 500-bed private prison in the city's industrial park. In a turnout of 60 percent Tuesday, residents voted 417 against and 326 in favor of the facility.

The referendum was non-binding but the City Council had said it would go with the will of the people on the proposed $34 million facility proposed by the Ogden-based Management Training Corp. Also on the referendum ballot was the question of whether the city should create a building authority to issue $20 million in bonds that would transfer ownership from the MTC to the city. That referendum was defeated 446 to 288. Fillmore was MTC's top choice for a location for the prison. Maryann grew up in California, Oregon and Washington with her construction family. She and Bill came to Hurricane 14 years ago to enjoy the outdoors. Maryann loved fishing, camping and restoring and collecting antiques. Her family was most important to her. She loved her three grandchildren as well as her nieces and nephews.

Surviving family include her husband Bill Hatch of Hurricane; son Steven William Hatch of Apple Valley, daughter Cynthia Ann Webb (Don) of Hurricane; grandson Randy Hatch and two granddaughters: Elizabeth Ann Hatch and Shannon Webb; brother John "Jack" Line (Kate) of Clatskanie, and sister Nita. 23, 1916 in Treasureton, Idaho, to Thomas James Williams and Rosa Belle Stanfield Williams. Florence will be remembered for her many years of dedicated teaching, and her wonderful sense of humor. She was always willing to help anyone in need. Florence spent many happy hours in her garden, painting, reading, music and being of services to others on her back-hoe. Smith, who had served on SUWA's advisory board for several years, proposes to build a trading post and other tourist-related facilities on the corner of U.S. 12 and the Burr Trail in Boulder. He also plans, with the help of the Utah School and Institutional Trust Lands Administration, to subdivide a mesa south of town for residences near the new Grand Staircase-Escalante National Monument. Wendell Nuffer RICHFIELD Wendell Peter Nuffer, 74, died Aug. 4, 1998 in Richfield.

He was born March 17, 1924 in Logan to Louis Ferninand and Ruby May Jensen Nuffer. He married Elsie Carol Ogden, May 21 1948 in the Manti LDS Temple. Pete graduated from high school in Caldwell, Idaho. He is a veteran of WWII having served as a naval viator. He received a bachelor of science degree in geology from Portland State.

He served as president of the Oregon Nurseryman Association. He was employed by Carl Zeiss Inc, a German optical company. He began his career as sales agent in Corvallis, and retired as president of Carl Zeiss Canada in Toronto. He was an active member of the LDS Church where he served as a bishop, on the high council and as stake clerk. He and his wife served a mission to the Washington D.C.

Temple. He loved working in the temple and was a sealer. His great joy was wandering through the backroads of Utah and hiking mountain trails with his wife. He is survived by his wife Carol of Richfield; son David Ogden (Lori) Nuffer of St. George; daughter Mary Ann Wilson of McCall, Idaho; 11 grandchildren; three great-grandchildren; sister LaRee Lyman of Applegate, brothers: Donald L.

Nuffer of Molalla, and J. Stanley Nuffer of Troutdale, Ore. Funeral services will be held on Friday, Aug. 7, 1998 at 11 a.m. in the Richfield 4th LDS Ward Chapel, 159 N.

Sevier Post No. 5050. Margery Black BEAVER Margery Bernice Black, 80, passed away Aug. 3, 1998 in the Beaver Valley Hospital. She was born Sept.

23, 1917 in Beaver to James Ether and Bertha Artulus Peterson Robinson. She married Vernon Rex Black on May 31, 1940 in Beaver. He preceded her in death on Jan. 14, 1979. Bernice was an excellent cook and was known for her good homemade bread and well prepared meals and her warm hospitality.

She was a devoted wife, mother and grandmother and will be missed by all of them. She is survived by her children: Eldon (Nella) Black, Madyline (Duane) Anderson, Michael (Susan) Black, Leland (Linda) Black, and Susan (Steven) Maycock, all of Beaver; 27 Brenda (Kim) Jensen, all of Desert Springs, Wendy Williams and Maria (David) Gledhill, both of LaVerkin; 26 grandchildren and 22 great-grandchildren. She is also survived by her husband Harold Woolley Blackmore, sister Gwendolyn Blackmore (our other mother) and her children: Thomas (Eileen) Browne of Creston, B.C., James (Evelyn) Blackmore of LaVerkin, Lorna Blackmore of Canyon, B.C., Arthur (Nurylon) Blackmore, Nola (Marion) Hammon, both of Colorado City, Dean (Irene) Blackmore of Creston, B.C., Dale Blackmore of Bonner's Ferry, Idaho, and Lane (Judy) Blackmore of LaVerkin; 56 grandchildren and 48 great-grandchildren. She was preceded in death by her parents, her sister Alice, three brothers: Paul, Jerry and Roger; nephew Lynn Blackmore. Funeral services will be held on Wednesday, Aug.

Shane Offret WASHINGTON Shane Verl Offret, 30, died Sunday, Aug. 2, 1998 in Missouri of injuries sustained in an automobile accident that also took the lives of his wife, Sheri Tirnetta Offret and two stepchildren, Jonathan and Zachary. Shane was born Feb.

29, 1968 in Provo. His parents are Ronald M. and Mary Ann Schemensky Offret. He married Sheri Nov. 4, 1997 in St.

George. Shane grew up in Orem where he attended Mountain View High School. He had recently moved to Missouri to accept new employment. He loved hunting, fishing and spending time in the outdoors. Small children were Shane's greatest joy.

His closest and best friend was his grandpa "Fred." Shane will be dearly missed by his family and friends. Survivors include his parents; children: Ryan, Tara and stepson, Joshua; twin brother: Shawn (Teresa) Offret of Washington; sister Shantelle (Mark) Lund of St. George; grandparents: Verl and Fay Schemensky of Washington and Marion and Marie Offret of Provo.
