SALT LAKE CITY (UPI) Ezra Taft Benson, 82-year-old heir-apparent to the Mormon Church's presidency, was hospitalized with a hip fracture Wednesday, only two months after he had a hip socket and ball joint replaced. Mormon Church spokesman Jerry Cahill said Benson received a hairline fracture in his left hip when he slipped and fell Tuesday night at home. Benson, president of the Mormon Church's Quorum of the Twelve Apostles, was listed in satisfactory condition at LDS Hospital Wednesday night. If the Mormon Church follows tradition, Benson will become the church's president and prophet upon the death of Mormon Church President Spencer W. Kimball.

Kimball is in ill health and is still recovering from skull surgery performed Sept. 5. The leader of the world's 4.7 million Mormons had scar tissue; fluid and blood removed from between his skull and his brain to relieve a subdural hematoma. It was the third such operation the 86-year-old patriarch has undergone. Cahill said Benson is expected to be hospitalized only eight to 10 days, and doctors say the injury will heal by itself if Benson keeps his weight off of it.

Benson fell and broke his hip several years ago, then underwent surgery in October to relieve pain and correct a limp. Cahill said the recent fracture is not in the same hip. Music for recess SALT LAKE CITY (LTD It wasn't a constitutional issue such as separation of church and state It was just a matter oi quiet the Utah Supreme Court that ended Christmas caroling by several public school groups in the State Capitol Building. The court is holding session each morning this week and the justices said they couldn't hear lawvers argue their cases while choirs sang in the capitol rotunda outside the courtroom. Court Clerk Geoffrev Butler then asked Kaye Smith the building's tour guide, to schedule the groups when the court is in recess.

But since several of the schools had already scheduled their capitol visits for the morning hours Mrs Smith said the court order has forced at least lour school choirs to cancel performances. Structure retained SALT LAKE CITY (UPI) Mormon Church-owned Zions Securities Corporation says it will gut the aging Eagle Gate Apartment Building, but retain the structure's outside walls for a new apartment complex. The financial corporation said Wednesday the turn-of-the-centurv building needs to be renovated because it does not meet lire and safety code standards. The new building will also house commercial shops on the street level. Zions president J.

Howard Dunn said the renovation plan proposed by a San Francisco firm has been accepted bv Zions' board of directors and bv the Mormon Church's First Presidency. 'He said the costs of renovating the Eagle Gate or completlv rebuilding the structure were about equal, so' the firm elected to save the exterior walls due to their historical value. But Dunn said no timetable for the multi-million dollar project had been established. weather Retirement postponed NATIONAL WEATHER SERVICE FORECAST to 7 PM EST 12-17-81 2977730.00 30.24 Ok 30.24 30 00 30 00 i I BOSTON FREEZING LAS VEGAS, Nev. District Judge Roger Foley has notified President Reagan he is postponing retirement to senior status on the court indefinitely because physical facilities do not exist for a third working judge. Foley's retirement to senior status would clear the way for the presidential appointment of a third federal judge who would sit in southern Nevada. Foley notified Nevada's congressional delegation by letter Thursday that he had informed the President of the change in plans. "Upon my retirement, a successor judge would be appointed by the President. The existing facilities here are not adequate to accommodate three judges and their staffs." Foley said in the letter.

will riot retire to senior status on May 1, 1982, as previously announced." Presently the federal building in Las Vegas has two courtrooms and chambers suites for Foley and U.S. District Judge Harry Claiborne, the chief federal judge in Nevada. Foley said the court requested a third courtroom and chambers suite from the General Services Administration in June of 1977. He said the court has now been notified the expansion will not begin least i yzr Chicago '-krktwrrtl SAN FRANCISCO COUPON mm Bring in this coupon and receive 15 off Guitar Purchase!
