Sheppard, who met her at the air- Marilyn, port in Cleveland on her return from Ger- (AP Wirephoto) CLEVELAND, Ohio (AP) 12-member jury was sworn in Friday to retry Samuel H. Shep-i pard in the 1954 slaying of his first wife, after a widowed 1 great-grandmother on the panel nearly upset the applecart. Common Pleas Judge Francis J.

Tally was prepared to swear a jury of eight men and four women near the end of the first trial week. At the last minute he asked if any of them knew of any reason why they could not serve fairly. Frances Grodzinski, oldest member of the panel, shot up her right hand. She had sat in the jury box since Wednesday morning without giving any indication that she did not feel herself qualified. Tally took her inlo his chambers and after a brief conference she returned to the jury box and was sworn in wilh Ihe rest.

There was no immediate indication what had disturbed her. None of the 12 jurors has ever sal in criminal judgmenl upon a fellow human. The only one with previous jury service is Mrs. irodzinski, but that was in a civil case. Jury members ranged from 27 through middle and inlo old age.

They appeared lo be a repre- entative middle class group. Among them are housewives, mail carriers, a bookkeeper, a ederal revenue agent, and iron and steel industry workmen. The present jury was selected half the time required in a 954 trial in which Sheppard was convicted of second degree -murder. Thai jury consisted of time during the retrial was men and five women.
