PROBATION BEFORE If defendant follows the terms of his probation and is convicted of no new crimes, his record can be SUBSEQUENT OFFENDER NOTICE: Occurs when the prosecution asks for increased punishment because of a defendant's prior conviction or convictions. STET: Means the case is placed on the inactive docket.

If defendant violates the agreement or commits new crimes, the case may be removed from the STET docket and tried. PLEA BARGAIN: Agreement between defendant, defense attorney and prosecution. A plea agreement may or may not be accepted by the court. was placed on the stet docket by order of the court. Wilson was sentenced to five months, with 49 days credit for time served.

Criminal fines and court costs were suspended. Edward Warren Flueallen, 48, of the 400 block of Priscilla Street, Sails-bury, was charged with being a fugitive from justice form the state of Delaware on violation of probation charges. Flueallen voluntarily waived extradition. The following cases were heard In jl Wicomico County Circuit Court by Judge D. William Simpson the week of May 21 to May 25.

The charges were placed on the stet docket by order of the court and with the con-vf sent of the defendant. Groom was placed on 12 months supervised probation and ordered by the.court to pay a fine in the amount of $200, plus an additional $301 in court costs.

Barry Anthony Hyland, 31, of the 700 block of East College Avenue, Salisbury, was charged with violation of probation. His probation was revoked and he was sentenced to 300 days, to run consecutively with the sentence handed down in another case. He was allowed 24 days credit for time served. Incarceration is for execution of a previously suspended sentence. Leroy Raymount Leonard, 27, of the 600 block of Decatur Avenue, Salisbury, was charged with second-degree assault and assault with a deadly weapon with intent to Injure.

The verdict of the court was guilty of the charge of second-degree assault, and the remaining charge was dropped at the request of the state. Leonard was sentenced to four years, with 52 days credit for time served. He was ordered to pay restitution to the victim in the amount of $1,237.75 and to AKB Rentals in the amount of $78.38. Criminal fines and court costs were suspended. Denlse Ann Wilson, 30, of the 600 block of Academy Street, Cambridge, was charged with possession of a controlled dangerous substance not marijuana, and possession of controlled dangerous substance paraphernalia.

He pleaded guilty to the charge of driving a motor vehicle while license suspended, and the remaining charges were dropped at the request of the state. Winter was ordered by the court to pay a fine in the amount of $500, plus an additional $181 in court costs within 120 days. The following cases were heard In Wicomico County Circuit Court by Judge D.

William Simpson the week of May 14 to 18. Franklin D. Ruff, 33, of the 100 block of Second Street, Salisbury, was charged with possession with intent to distribute a large amount of a narcotic controlled dangerous substance, possession of a narcotic controlled dangerous substance with intent to distribute, and possession of a controlled dangerous substance not marijuana. The verdict of the court was guilty of the charge of possession with intent to distribute a large amount of a narcotic controlled dangerous substance, and the remaining charges were dropped at the request of the state. Ruff was sentenced to eight years, with 212 days credit for time served.

The first five years of the sentence are mandatory, with limited rights of parole. He was ordered to forfeit $42 in U.S. currency. Sean Edward Clarkson, 34, of the 500 block of Lincoln Avenue, Salisbury, was charged with second-degree assault. The charge was placed on the stet docket by order of the court and with the consent of the defendant.

Paula Rushia Hall, 36, of the 300 block of Elizabeth Avenue, Fruitland, was( charged with second-degree assault, reckless endangerment and wearing and carrying a deadly weapon. The charges were placed on the stet docket by order of the court and with the consent of the defendant. Albert Lee Winder, 53, of the 25000 block of Naylor Mill Road, Salisbury, was charged with driving a motor vehicle in excess of reasonable speed and driving while intoxicated. He pleaded guilty to the charge of driving while intoxicated, and the remaining charge was dropped at the request of the state. Winder was sentenced to 30 days, suspended, and placed on 12 months supervised probation.

Fines and court costs totaled $601. Warded Leroy Giles, 33, of Wicomico County Detention Center, was charged with possession of a controlled dangerous substance not marijuana, and possession of controlled dangerous substance paraphernalia. The charges were placed on the stet docket by order of the court and with the consent of the defendant. Sherman T. Pride, 26, of Hager-stown, was charged with (1) possession with intent to distribute a narcotic controlled dangerous substance, (2) possession with intent to distribute a controlled dangerous substance within 1,000 feet of a school, (3) conspiracy possession with intent to distribute a narcotic controlled dangerous substance, (4) possession of narcotics production equipment, (5) possession of a controlled dangerous substance not marijuana, (6) possession of a controlled dangerous substance marijuana, (7) delivery of controlled dangerous substance paraphernalia to a minor, (8) possession of controlled dangerous substance paraphernalia, and (9) possession of controlled dangerous substance paraphernalia.

Pride pleaded guilty to count 5, and the remaining charges were placed on the stet docket by order of the court and with the consent of the defendant. He was sentenced to three years, to run consecutively to a sentence he is now serving. He was allowed 48 days credit for time served. Pride was ordered by the court to forfeit $1,062 in U.S. currency.

The following cases were heard In Wicomico County District Court by Judge R. Scott Davis the weeks of May 28 to June 8. Samal Robert Fields, 20, of Wicomico County Detention Center, was charged with second-degree assault of a Department of Corrections employee. The verdict of the court was guilty, and Fields was sentenced to 366 days, to run consecutively to the last sentence to expire of all outstanding sentences. Kenneth James Zearfoss 50, of the 4000 block of Joseph Drive, Fruitland, was charged with second-degree assault, disorderly conduct and obstructing and hindering.

The verdict of the court was guilty of the charge of second-degree assault, and the remaining charges were dropped at the request of the state. Zearfoss was sentenced to 150 days, with one day credit for time served. Criminal fines and court costs were suspended. Evamarie (NMN) Michaels, 41, of the 30000 block of Manokin Street, Princess Anne, was charged with violation of probation. Her probation was revoked and she was sentenced to 30 days.

Incarceration is for execution of a previously suspended sentence. Rhonda Lee Parks, 26, of the 100 block of Columbia Avenue, Crisfield, was charged with fourth-degree burglary, malicious destruction of property valued at less than $500, possession of a controlled dangerous substance not marijuana, and possession of controlled dangerous substance paraphernalia. The verdict of the court was guilty of the charge of possession of a controlled dangerous substance not marijuana, and the remaining charges were placed on the stet docket by order of the court. Parks was sentenced to 365 days, with 42 days credit for time served. Criminal fines and court costs were suspended.

Thelma Lee Russell, 42, of the 1000 block of Queen Street, Salisbury, was charged with violation of probation. Her probation was revoked and she was sentenced to 20 days. Incarceration is for execution of a previously suspended sentence. John (NMN) Vega, no age listed, of the 100 block of Francis Drive, Salisbury, was charged with telephone misuse repeat calls. The charge was dropped at the request of the state.
