Continued from page A1 When Judge Wharry asked Jeffries what sentence she would like to see, she responded, "I don't want to hurt anybody else's child and I don't want vindication. But I think he ought to serve more than a year.

She (Jane) was a good person," Jeffries said. Then, Deputy Prosecutor Ron Byal expressed his anger about reckless homicide being a Class felony instead of a Class felony. According to the Indiana Criminal Code book, a Class felony carries a maximum sentence of 20 years, while a Class felony carries eight years. "What boggles my mind is that a life has been taken and the penalty is only a maximum of eight years," said Byal. "I think there is a great need to change this.

Someone who recklessly takes another life should be held responsible. Probation is not enough. He should spend the two year sentence to reflect on what has happened." Gasper pleaded guilty to the reckless homicide charge March 9 as part of a plea bargain. In the agreement, a charge of Class felony operating a vehicle while intoxicated causing death and a Class criminal recklessness were dropped. Deputy Prosecutor Ron Byal said the plea bargain was taken into account due to the strengths and weaknesses in the case.

"Rather than gamble with the severe charges, we went for the lesser," he said. The OWI while causing death charge was filed after Gasper tested positive for marijuana and cocaine use on a urine test. But on the stand, Gasper proclaimed, "I don't drink or do drugs and I have never used cocaine." In addition, the Indiana Court of Appeals, First District, ruled in December of 1994 that a urine test revealing a controlled substance is insufficient to sustain a conviction for operating a vehicle while having a Schedule I or II controlled substance, which includes marijuana and cocaine, in the blood. To sustain a conviction a blood test must be done, according to the Indiana Lawyer, a legal publication. Gasper was not given a blood test following the accident.
