HaHietburtj American Friday, iux 3a, I til Pag 2 Kyker hassle heads back to court abandon the newsstand because the Saenger Center is in the process of being renovated and the space is needed for a dressing room. Miss Kyker has been fighting the city'i efforts to move her because she wants to see the newsstand remain open for SO years a desire expressed by her parents. "I'm trying to do it for sentiment and tradition," Miss Kyker said. "My mother and dad wanted to run the stand for 50 years. I'm trying to do it for them." Miss Kyker had lost a legal showdown in front of County Judge Dickie McKenzie June 17, when he reinstated a previous order that she must vacate the property. No hearing date has been set. Her NFPW honors included a first place in photography (all publications), a second the City of Hattlesburg, but a story that appeared in Thursday's edition of The American apparently had ended that possibility for the time being. In the story, Mayor Bobby Chain said he had given Miss Kyker 10 days to abandon the newsstand, and that she had been offered a plaque commemorating the Kyker family. The plaque, according to Chain, would have been erected at the site of Kyker's Newsstand, marking it as a historical landmark, However, the mayor put a stipulation on the plaque-Miss Kyker had to leave the newsstand within the time limit and not cause any more problems. After seeing the story, Jones said, "That's It, we're filing the appeal in circuit court right now because of the mayor's arrogant attitude in that story." Chain could not be reached for comment today. Mississippians recommended for judgeship WASHINGTON Sen.

Thad Cochran has received numerous recommendations from throughout Mississippi for a vacancy on the Fifth U.S. Circuit Court of Appeals that will be created when Judge James P. Coleman takes senior status July 1. Although it is not required that President Reagan replace Coleman with another Misslsslppian, presidents traditionally replace appeals court judges with somebody from the same state. As Mississippi's highest ranking Republican office holder, Cochran will be able to make the recommendation to Reagan.

Several weeks ago, Cochran asked Mississippians to submit nominations to him. His press secretary, John Perkins, said Thursday that he had received a large number of recommendations from throughout the state. Perkins declined to reveal any of the persons nominated.
