HATTIESBURG AMERICAN Friday, April 28, 2002 2C News of RecordSouth Alabama moves from electrocution to injection I For the record MONTGOMERY. Ala. Siegelman said the chance was a Alabama death-row inmate Gary Department of Corrections spokesman Brian Corbett said prison officials will have to find funding to pay for the new death chamber and new equipment, because the law passed by the Legislature did not include money to pay for the new form of execution. Alabama's electric chair was last used in June 2000. Gov.

Don Siegelman signed a law Thursday making lethal injection the primary method of execution in Alabama, leaving Nebraska as the only state exclusively using the electric chair. Beginning July 1, condemned inmates in Alabama will die by injection unless they choose the electric chair. precaution in case the Supreme Court rules the electric chair is cruel and unusual punishment, which could otherwise have thrown the state's death penalty law into limbo. Prosecutors backed the change to make sure capital punishment remains legal in the state. The Supreme Court earlier this month blocked the execution of Leon Brown, convicted of stabbing a man to death in 1987.

His appeal contended, in part, that the electric chair is cruel and unusuaL Only one execution is scheduled before the change. "Our case covers what has been labeled in papers from (Tate's) appellate lawyer as 'the bogus wrestling and we think maybe Lionel Tate may have some relevant information," said Daniel Casey of Miami, one of the WWF attorneys working on the case. Richard Rosenbaum, Tate's appellate attorney, said in court documents filed Wednesday that the WWF should be barred from questioning Tate because conversations he had with Lewis are protected by attorney-client FORT LAUDERDALE, Fla.

(AP) The World Wrestling Federation wants to question a young killer about the "wrestling defense" his attorney used during his trial last year. Attorneys for the WWF want to question Lionel Tate about the defense Jim Lewis mounted when Tate was tried for the July 1999 death of 6-year-old Tiffany Eunick. Lewis had claimed that Tate, then 12, accidentally killed Tiffany while imitating pro wrestling moves. Tate, tried as an adult, was convicted of first-de gree murder and received a life sentence. The WWF has filed a multimillion-dollar defamation lawsuit against Lewis in New York federal court for implying in media interviews and in a video produced by the Parents Television Council that it was partly responsible for the girl's death.

The WWF, which is also suing the television council, says it lost advertisers because of Lewis' claims. Attorneys for the WWF told the South Florida Sun-Sentinel that they won't say exactly what they plan to ask Tate, whom they re He also argues that since Tate's appeals have not been exhausted, he cannot be forced to answer questions about Tiffany's death because of his Fifth Amendment right against self-incrimination. He also wrote that Tate is not intellectually competent to testify. Lewis' attorney, Robert Buschel, said he is sure Tate would say nothing bad about his client. "Jim was always trying to zealously advocate for (Tate) and win Lionel's freedom," Buschel said.

"It was never about the WWF, it was about Lionel Tate." The following is a roundup of crimes reported to area agencies within the previous 24 hours.
