All these trains were held in Inwarden until late Saturday afternoon, creating the greatest congestion of rail traffic in the North Western yards that has been witnessed for a number of years. The carnival trains and those carrying live stock exhibits from the fair at Huron were mostly bound for Tulsa, for a fair at that place.

Members of the carnival company and shippers were rooned here practically all day Saturday and it resulted in brisk business for the Hawarden restaurants and ing places, It is also unofficially reported that Hawarden bootleggers hung up a new record for a single day's small quantity sales. The washout on the Northern Iowa division occurred about 31 miles east of Hawarden where about 20 feet of track was undermined. Section Foreman P. J. Lubsen and one assistant went out to inspect the Northern Iowa track about 2 a.

m. and met the section foreman from Ireton and an assistant at the scene of the washout. Only about 20 feet of track was undermined at this point and the damage was repaired by 6:30 a. m. and no trains were delayed on this division.

Mr. Lubsen knew nothing of the washout on the Sioux City division until he returned from repairing the damage on the Northern Iowa division and then he was dispatched to assist with the work on the Sioux City division. The washout on the Milwaukee line was discovered about 11 p. m. Friday night when time freight No.

75 struck a spot where the track was submerged along the edge of the bluffs, three miles south of town. The train was proceeding slowly and when the soft spot was struck the engine tipped slightly but neither the engine nor none of the freight cars left the rails. The train was brought to an immedlate stop and the conductor walked to Hawarden to report the condition. This train was due to reach Hawarden at 10:20 p. m.

but was somewhat late and it was around midnight when the conductor reached Hawarden and aroused Agent H. J. Brown. Section Foreman C. Olson was just starting out to inspect the track when the conductor of the train arrived in town.

Time freight No. 173, due in Hawarden at 3:25 a. had not yet left the Sioux City yards and upon being notifled of the condition came on and pulled No. 75 back off the undermined track. About 30 feet of track had been undermined by the heavy rain.

Section men were recruited all the way from Canton to Westfield and they finished repairing the damage by 9 o'clock Saturday morning, permitting the two freight trains to come on to Hawarden about 9:30 and no further traffic delays resulted. At the trial of this case last January DeJong was given a verdict for $11,000 but a new trial was granted owing to irregularities which occurred in the first trial. Twenty additional jurors had been called for possibles service in the second trial but a settlement of the case was reached last Thursday morning when the time arrived to open the Under the terms of the settlement the plaintiff received $1,905 and the defendants also required to pay the costs of the action amounting to $121.50. The county was saved considerable additional expense by reason of the settlement. Wm. Westre has commenced an action against J.

G. L. and Lela L. Stargell in which he asks judgment against each of the defendants in the aum of $2,000, together with interest at 8 per cent from Jan. 16, 1928, and the costs of the action, including attorney fees, The Portable Milling Company has filed an action against G.

Herren in which plaintiff asks that a writ of replevin issue to the sheriff putting plaintiff in possession of a truck chassis, mill, mill motor and other equipment and plaintiff also asks judgment against defendant in the sum of $1,500 for damages for the wrongful detention of said property and costs of the action. Sieperda Dickman have brought suit againat Jake Riepma in which they demand judgment for $95.52 with interest thereon at the rate of 6 per cent from Oct. 30, 1927, and costs of the suit. The State of Iowa has filed a petition asking that Roy Carr be permanently enjoined and restrained from in any manner bootlegging by or for himself or others.

In the case of Gertruida Mastbergen and others vs. the Northwestern State Bank, a motion to strike was overruled and a motion for 8 nmore specific statement was sustained. The plaintiff was given until Sept. 26th to comply. In the case of A.

Addink, the defendant was given ten days in which to plead further. In the case of Mason-LeCocq-Yelton Company vs. Arie G. Van Marel, the defendant confessed judgment in the sum of $75.00 and costs which were taxed at $2.00. Alex Yunker obtained judgment against Nick and Johanna Vander Meulen in a suit on an unpaid note and mortgage.

Judgment was rendered against the defendants in the sum of $8,751.33 and costs, amounting to $143.66, and said sums were declared a lien against the mortgaged premises. It was further ordered that a special execution issue against the said premises to be sold to satisfy the amount due, with interest and costs. An order was signed setting Sept. 30, 1931, at 2 o'clock p. m.
