Old deportation case may be reopened WASHINGTON (API s. tmrni source. senior Official of the Croatian sfatp request from the Yugoslavian govern STAR-GAZETTE, Elmira, N.Y., Thursday, March 18, 1S7S 111, a gration officials are moving to reopen the case against Andrija Artukovic, a 76-year-old California bookkeeper accused of war crimes by the lavian government. At the request of several House members, including Rep. Elizabeth Holtzman, the Immigration and Naturalization Service has decided to dust off Artukovic's decades-old Tile to decide if he should be deported.

Those efforts are denounced as a "Campaign of falsehood" by allies of Artukovic in the United States. Currently, immigration officials are pressing the State Department for a fresh opinion on whether Artukovic would face political persecution if he were to be returned to Yugoslavia, which has been an independent-minded Communist state since World War n. Immigration officials are again pressing for a straight-forward answer from the State Department, the source said. Only if the department drops its objections can the immigration service order a new hearing. 1 Meanwhile, Radielovic has mounted a campaign to prevent Artukovic's deportation.

Historians and others who have, wortten about genocide by leaders of the Crotian state during Wrodl War II have fallen victim to a phony version of events put out by the Tito government, Radielovic says. He believes that government has suppressed documents showing what really took place during the war. As for Rep. Hozman, Radielovic says, "We cannot understand how she can support Tito." She replies, "I don't even know what Tito's propaganda Is." ment that Artukovic be extradited to stand trial. "Yugoslavia had its chance to prove its case, and it failed to do so," said Radislovic.

"Rep. Holtzman should accept that." For her part, Rep. Holtzman said, "It is an indisputable fact that Artukovic entered the country illegally and that he is in Illegal status today." She says the refusal to extradits is a completely separate issue from the standing deportation order. Holtzman and 10 other Hosse members have written Secretary of State Henry A. Kissinger asking that State Department objections to Artukovic's deportation be lifted.

Immigration service officials asked the State Department to review its objections last October but a reply on March 5 "did answer the question," according to a government" now part of a present day Yugoslavia. The Tito government in Yugoslavia save 750,000 Serbs, 60,000 Jews and 26,000 gypsies died in camps administered by Artukovic during World War n. Artukovic immigrated to the United States following the war but in 1952 was ordered deporeed because he used fradulent documents to enter the country. However, the order was never enforced because the State Department found that under the Immigration and Nationality Act Artukovic would face persecution for either his "race, religion or political opinions' if he were sent tack. Peter Radielovic, president of the Croatian Information Service, cites a 1959 decision by a federal Immigration commissioner as evidence that Artukovic should be left alone.

The commissioner rejected a 1941 to 1945, Artukovic was a 1 0 LOOKS FOR MUSSELS A lone man wades in the backwaters of the Tennessee River, near Decatur, recently in search of mussels and their shells.
