he had made hi3 home for the past year Though over 90 years of age Irish Henry as he was familiarly known had enjoyed the bent of health up to ten days ago when he suffered a stroke of apoplexy Dr Kane was at onoe called but medical science was unable to relieve the old man and to day the end came As a young man he left Ireland and went out into the world to make his fortune Arriving in New York worked there until the announcemeL tame of the discovery of gold in California when he lost no time in making his way to Missouri where he cast his lot with a party just ready to then undertake the perilous trip across the plains Like the other members of the party he engaged in mining and met with fair success Possessed of a snug sum of money the desire of his life to become a land owner was soon realised He visited this county and at what is now known as the head of Thirteenth avenue purchased a tract of fifty two acref on which he at once erected a modest duelling and announced his intention to make it his home until his dying day Repeated offers were made to him for the sale of the property which is now very valuable but to all of them he turned a deaf ear A quarry of good macadam stone was found on the property when a road was cut through it years ago but it was with reluctance that he permitted it to be worked For nearly half a century he lived on the property and with the exception of the company of a hired man was for the moat part of the time alone He was generally reputed to have kept a large sum of money about the house and one evening about sfven years ago two men rode up to the cottage on bicycles and asked for shelter for nc evening The old man dire ted his man to prepare some food for the strangers who at an opportune moment seized Heyland and hi companion and bound thm hand and foot after which they proceeded to ransack the house They found about 60 which Heviand had on his person nut were not contented wltn so small an amount and threatened to kill him unless he revealed the location of hjs buried treasure He Anally succeeded in convincing them that he had no money about the place and the thugs went away leaving the old men bound After an hours struggling they succeeded in cutting the ropes that bound thfm and Heviand lost no time in getting intn Oakland and reporting hi los but the thieves were never captured A year or two later a Mrs Wright thf niece of Heyland and the only relative he had in this country attempted through the courts to have him decUrr i Incompetent alleging that he was owing to advanced ag and general weakness Of mind and body unable to properly look after his interests Heyland was charged by his niece with seeing fairies and spirits and conversing with them The old man admitted the truth of the accusation and furnished the Court with a very nleasing description of his spiritual fri md He alFO offered the testimony of a large number of pe fcons with iom he had done business in recent years and they all testified that he wis competent to look tfter his own affairs On this showing the application of Mr Wright was denied Heyland some months later made a will which he gave Into the keeping of Attorney McDonald It is said thai the bulk of the property goes to relatives in Ireland but that Mrs Wright will fall heir to a portion of the property Arrangements have been made for holding the Service Oakland High School Forms Council to Direct Its Outside Enterprises OAKLAND June 1 For the purpose of giving general direction to all tho student activities at the Oakland High School representatives of all the classes met this afternoon with Principal James Pond and the heads of the various departments of the faculty to form a student council The organization was completed with the election of officers as follows President Oirard Richardson vice president Edna Whitney sec retary Lilfle Harting The new organization has nothing to do with the discipline of the high school and is not intended to direct student life In the classrooms It will endeavor tc unify and give purpose to all the activities conducted by the students outside of the school With this object in view It is of the Board of Supervisors yesterday the Security Coin Box Company was permitted to withdraw its bid to furnish a new vault for the County Treasurers office at a cost of 35000 After the bid was put Hotel Secures a Site OAKLAND June 1 At a meeting of the Hoard of Trades special hotel committee held to night at the residence of King at 10 Sixth avenue the stm of 2dO0OO was subscribed towarc thf project to build a 300000 tourist hotel in Oakland The company th committee proposes to organize to build the hotel is to capitalized at ItOOOOO and the sum subscribed to night is toward the capital stock A few days ago the committee secured an option on the property bounded Twelfth and Thirteenth and Madison ard Jackson streets comprising an en tire block at the price of 45000 To night the committee ratified that option and definitely decided to purchase the property as the site for the hotel King chairman of the commit te was instructed to name an executive committee of seven to handle afternoon denied the suit of Mrs Florence Richards for a divorce but granted her husband Harry Richards a decree on his cross complaint The formal signing of the decree was deferred until to morrow to allow the parents to agree if possible upon a disposition of the children that would be satisfactory to both If no agreement could be reached Judge Ogden said he would award the custody of the children to the father as the evidence had conclusively sustained the charges preferred by Richards against his wife Evidence was introduced to day tending to prove that Mrs Richards had transferred her affections to George Cotton yardmaster at West Oakland for the Southern Pacific Company while her husband was in the East playing with the Way Down East theatrical company Richards had testified that his wife had placed her hand on the head of their little boy and had sworn to him that she had not been out with Cotton nor had received any letters from Mm On the witness stand both Cotton and Mrs Richards denied that there had been anything more than friendly relations between them Their testimony however was controverted by the Introduction In evidence of letters that had been written by Cotton to Mrs Richard It was shown by the testimony of Mrs Alice Wells Mrs Loriana Re tallick Robert McBride and McBrlde that Cotton and Mrs Richards were frequently together Mrs Rotalllek testified that Mrs Richards had shown tier letters received from Cotton and had told her she thought she loved her husband but learned that the was mistaken after she met Cotton Attorneys Walsh and PulcifeV stipulated that If put on the witness stand Mrs Richards and Cotton would deny the testimony offered against them Attorney Frick representing Mrs Richards did not cross examine tha last witnesses who testified and agreed that the case should be submitted without argument In rendering his decision Judge Ogden stated that according to the testimony the conduct of Richards toward his wife had not been all that it should havs been and his conduct was doubtless responsible In part for her having sought the society of other men Her conduct however was not excusable for that reason It had been shown conclusively by the letters and the testimony presented taken together with Mrs Richards denials facts that were proved that her relations with Cotton were not proper Judge Og len further ttated that it was with much pain that he listened to the testimony offered during the last two day for he was averse to hearing anything against the reputation of a women He was evidently much affected Thirteenth street OAKLAND June i Charles A French who fell oft a water sprinkling cart at Haste and Milvia jstreets in Berkeley on Monday evening and who was thrown into the Berkeley jgtl to spend the night on the floor by bep uty Marshal Bert Howard under the impression that the man was drunk died this morning at the Receiving Hospital in this city French was taken to the hospital last night when Dr Stratton found that hefwas suffering from traumatic pneumonia instead of overindulgence in liquor Coroner Mehrmann took charge of the case this morning and will Investigate the causes which led to the mans death including the night in the Berkeley lock up French was driving his sprinkling cart in Berkeley when he toppled from the seat Deputy Marshal Howard appeared on the scene and after taking the advice of Dr A Payne concluded tht the 4 man was drunk With considerable difficulty owing to the fact that French weighed 250 pounds he took him to the Addison street lock up and left him there on the floor without covering In the morning about 9 oclock neighbor heard the prise ner calling for water and at 10 oclock Howard reappeared to take the man to Justice of the Peace Edgars court As French seemed to be suffering ind complained of a pain In the side Dr Woolsey was called and it was concluded that the prisoner had a fractured rib French was then placed in a buggy and driven to the home of his cousin in West Berkeley On the Way Howard says French stopped at a saoon to get a glass of beer and had to be dragged away from the place of refreshment After arriving at his cousins place French was persuaded to go to the Receiving Hospital and was taken there by A White a Dwight way liveryman He died shortly after 8 oclock this morning Marshal Kerns and Deputy Howard both contend that the night was Warm and that it was perfectly proper to leave a prisoner on the floor of the lock up without covering They jadmit that French was left in that condition but say that Howard visited thp lockup several times during the evening and found his prisoner sleeping peacefully Howard says that when French fell off the water wagon he had been taking whisky and quinine for a cold and had taken stores in this city and In San Francisco has appealed to the police to assist him in locating a satchel containing 1600 In coin Selby left the Oakland store on the 1230 oclock tralh to dajJ for San Francisco He carried with him his overcoat and satchel On boarding the train he says he put the satchel on the floor and did not notice that he had lost it until the boat had pulled out of the slip Arriving on the San Francisco side he at once ommunl cated with the railroad officials by telepohne and returned to this side on the next boat to assist in looking up the satchel on his own account The trainmen were interviewed but none remembered seeing the satchel This evening the police were asked to assist him in the search It is the opinion of Mr Selby that the satchel was picked up by some one who is holding it for a reward as his Oakland store was communicated with over the telepohne about 3 oclock this afternoon and the question asked as to whether he carried a grip with him when he
