Discussed FUNERAL NOTICE HEARING BY THE U.S ENVIRONMENTAL PROTECTION AGENCY ON PROPOSED DESIGNATION OF AIR QUALITY MAINTENANCE AREAS FOR THE STATE OF HA WAII On August 14, 1971 (36 FR 15486), the Administrator of the Environmental Protection Agency promulgated as 42 CFR part 420 regulations for the preparation, adoption, and submittal of State implementation plans under section 110 of the Clean Air Act, as amended. These regulations were republished November 25, 1971 (36 FR 22369), as 40 CFR part 51.

On April 18, 1973 (38 FR 9599), the Administrator proposed amendments to those regulations designed primarily to expand the scope of review prior to construction or modification of buildings, facilities, and installations so as to require consideration of the air quality impact not only of pollutants emitted directly from stationary sources (consideration of which was already required by 40 CFR pt. 51) but also of pollution arising from mobile source activity associated with such buildings, facilities, and installations. The proposed amendments were, and still are, considered a necessary addition to the Federa-State system for implementing, and more particularly, for maintaining, the national ambient air quality standards. On June 18, 1974 (38 FR 15834), the Administrator promulgated as amendments to 42 CFR pt. 51 regulations for the preparation, adoption and submittal of procedures for the designation of Air Quality Maintenance Areas (AQMA).

The State of Hawaii did not submit to EPA either a designation of AQMA's or a justification for not so desgnating; Therefore, the requirements of 40 CFR 51.12(e) are not met. On July 10, 1974 (39 FR 25330) the Admin istrator published a ind-ing to this effect, and proposed a regulation to identify pursuant to 40 CFR 51.12(e) and (f) an AQMA in the State of Hawaii. The Environ mental Protection Agen cy, Region IX will hold a public hearing on the proposed regulation on August 20, 1974, at 1:3 p.m. and 7:00 p.m. at the following address: Ala Moana Hotel 410 Atkinson Drive, Hono lulu, Hawaii.

The hear ing may be continued from time to time, or to a different place, after its commencement to accommodate the needs of witnesses or the EPA. All interested parties are invited to express their views at this hear ing. Persons wishing to make comments may submit same in writing andor appear at the hearing. Oral statements will be recieved and considered, but, for accuracy of the record, all important testimony should be submitted in writing. July 19, 1974) 1942) ell on old CLASSIFIED limnT ADS By Leslie Wilcox Star-Bulletin Writer Although conjugal visits are prohibited, Hawaii State Prison inmates have opportunities to engage in sexual intercourse with their wives or girlfriends, a State psychologist said last night. Robert Sone, consulting psychologist to the Hawaii criminal justice system, said such sex does occur during "field days" when spouses, girlfriends and family members are allowed to visit with the prisoners. "I think guards are aware of the needs of inmates and feel sympathy toward them, and they look the other way," Sone said.

But he said the activity is done covertly and is "not sponsored by the State administration." SONE WAS ONE OF three panelists discussing "Sexuality and the Prison" at the McCully-Moiliili Library before an audience of about 30 persons. Other panelists were Gerri Madden, vice chairman of the Hawaii League for Decency, and Imo-gene Cole, who spent 25 days in Halawa Jail for possession of marijuana and who demonstrated at the State Capitol in favor of legalized prostitution. The panel discussion was the first of 12 programs on "Sexuality at Work" being sponsored by Love and Peace Together, a nonprofit group which deals with sexual identity problems. Miss Cole said some women have sexual relations in the visiting room at the State Prison. She offered to introduce a reporter to a friend who is pregnant after visiting with her inmate husband there.

"After all, if you saw an inmate having sex with a woman, and if you knew he was going to be in jail for the next 30 years and he was sex-starved, what would you do?" she asked. "Wouldn't you let them have a little privacy, too?" SONE ALSO SAID he favored allowing conjugal visits in the prison. "I think we have to remember that one is sent to prison as punishment, not for punishment," he said. Sexual expression is a basic physiological need, he said, and the State doesn't have a right to "take away all someone's liberties" after he is convicted of a crime. But he said that he doesn't think conjugal visits will be permitted in State correctional facilities for a while.

"I'm afraid that we're not that civilized yet; I'm afraid we're not that enlightened; I'm afraid we're just not that progressive," Sone said.
