Deaf and Blind Institution BERKELEY July It Aftr a recess of twelve days the Investigation Into the affaire of the State Institute for the Deaf and Blind conducted by Governor Johnson reopened here this morning The largest crowd which has ever attended the hearings ws In attendance at this afternoons session Interest In the proceedInjHr1Se1ng at a high pitch The Inquiry today resolved around the qualifications of Superintendent Douglas Keith and the Justice of his appointment to the place as head of the Institution Two members of the faculty Vice Frinclpal A Caldwell and former Principal Warring Wilkinson were called on to testify as to how the school was conducted The question whether politics had ln I fluenced the board of directors of the Institution In making appointments waa probed by Governor Johnson today Caldwell declared that as far as he knew politics had nothing to do with the appointments and stated that he did not believe that Keith had been appointed because of polfllcal affiliations The bulk of the days Investigation was taken up with an Inquiry as to Keiths ntness for the place With the centering of the Inquiry on Keith and a statement by Governor Johnson that the State did not care for a superintendent who had to ha some one to do his work It Is believed that the investigation will result In a recommendation that Keith be removed from office A dramatic feature was introduced Into the routine of the session this afternoon when John Connor president of the California Alumni Association of the school stepped to the table and asked Governor a Pistol Battle in Oakland RESOLUTION ARE 11K4D The resolutions deploring conditions were injected by the Governor Into the proceedings as having a direct bearing on the case despite a protest from Attorney Charles Wesley Reed claiming that the action waa untimely The protest of the blind graduates was as follows Be It resolved That we deplore the attempt of some of the Inexperienced oiioa graduates or this school to dls credit the management of Superintend ent uougias Keith and that we go on record as favoring and approving itenn aaminlstratIonIand that believe he Is an earnest and efficient superintendent and a successful friend to the blind students of this school The resolution was signed by Presl dent Connor and Secretary Naale of the association Attorney Hed cross questioned Connor asking If he hnd been re quested to prepare and fim the resolu Uon The witness replied that he had not and declared In reply to a question that the organisation formed of blind graduates of the school was highly Incensed at the attempt on the part of a small faction of the blind graduates to remo ve Keith from office Connor while testlflng declared that Keiths administration had brought about a marked improvement In conditions for the blind and that the course of Instruction now In voiOie at the achool tended to ward the education of the students In trades to enable them to be self supporting after their gruel uation He declured that the blind graduates who hail testified against Keith were Inexperienced and not qualified to Judge whether Keiths administration was efficient Attorney Robert Harrison asked for a special investigation Into the charges that had been brought by the petitioners against Instructor Theodore Grady following a lulm that he hid made Improper suggestors to students In his classes A dozen witnesses from sll parts of the State will be summoned to testify In the special hearing against Grad which was pirtlallj set for Monday of next Keith win appointed and had assisted In drawing up ihe schedule of hours for the children Governor Johnson then took the witness advising Caldwell that he need have no fear of losing his position as the employ of the Sunset Lumber Company and two striking unionists engaged In a revolver duel this morning the diminutive war resulting In the wounding of three of the combatants and the arresting of Charles Hay and Jesse Barnett the two non unlonlsts on the serious charge of assault with a deadly weapon with Intent to commit murder Ernest Franklin a teamster of 221 Fifth street and Luther Davison a lumber clerk of 819 Fallon street were the other two combatants HRrry Leach attorney for the Sun set Lumber Company represented Ray and Uarnett upon their arrest and se cuied their release from custody upon depositing J1000 ball for each The si used men will appear In the Police Court tomorrow morning when the date will be set for the preliminary eamlnatlon Franklin DavWon and Rarnett were wounded In the trouble which occurred on liwton avenue between Fifty third and Klftj fourth streets Barnett life was probably saved because the horse driven by Franklin reared and spoiled the aim of came to the wagon of A Klrkendallt which was far In the rear because of the Inability of his team to make speedy progrees up a hill This procedure necessitated passing the rig carrying Franklin and Davison At this point the stories of the two factions differ Barnett claims that Franklin leveled a gun at him and that he Barnett then began firing Ray also opened fire hitting Davison in the right foot Davison had no gun and Franklin revolver clogged and refused to work after he had fired one shot the one which struck Barnett in the leg Franklin and Davison claim that Bar nett and Ray fired twelve shots at them and show the riddled buggy as proof of their contention Barnett says he fired no more than three or four shots and Ray claims to have discharged his weapon but once Frsnklln seeing that his gun was useless and fearing that the other strike breakers would Join in the fray wheeled his horse about and made his way to the Receiving Hospital where his wound and that of Davison for a couple of years confirms the earlier report that Mrs Dennis was not crushed death between the rar and a tree but died of fright and shock to her nervous system when she felt the car toppling and
