in the important suit ot tbe MarketMarket street Railway Company against LW HellmanA Borel Daniel Meyer and others This is the action brought to determine the legality of the cable companys recent issue of bonds to the amount of 17000000 The defendants agreed to take a certain quantity of the bonds but failed to do so because of doubt expressed by their attorney as to the legality of tbe bond issue The suit is an amicable one and is designed to settle tbe legal points in controversy In order to present the tsue fairly Judge Wallace was asked to grant a writ of mandate compelling tbe defendants to accept tbe bonds at an agreed price stated in the complaint As to the facts there was no dispute so that the question presented to udge Wallace was purely one of law Counsel on both sides had hoped for a decision on the merits Instead JudgeWal lace yesterday rendered a mere pro forma decision for the rail ay company without passing anv opinion on either tbe law or tbe facta He believed that the important points in controversy should be decided by the Supreme Court on appeal a i tUK GRAND JCKY They Are Stitl Xaveatlgatlng the Election Fraiudi The county Grand Jury met
