Again 3Takes Jotest Against Xynchings in America NEW EMBASSADOR OPENS NEGOTIATIONS EFFORJS TO HAV FEDERAL GOVERNMENT EXTEND THE STATUTES The Dispatcher at Needles Powerjess to Prevent It LOS known ANGELES December 25 It is now hat the dispatcher at the Needles knew the wreck at Franconla would occur before Information of the tragedy reached him The morning of the dlfvasterhe followed the train from Peach Springs down thellne by telegraph He called up each operator and asked Is No 4 in sight He called up Franconla and asked the operator Jf No 4 had passed and the operator flashed back Yes Just went by Get out your handcar and follow No 4 as fast as possible was the reply It will meet No 3 somewhere between Franconla and Needles Before the operator could get out of the office he heard the roar of the wreck and explosion of boilers and was only a few minutes too late at the scene to see It all The explanation of this Is that the dispatcher at Needles knew the time No was due at Franconla and wished to know if the engineer was making hla schedule so he could arrange orders to help No 3 If No 4 was slow He knew that if No 4 passed Franconla before this time the two trains would meet because he had given No 3 orders that would have made that train take a siding at Franconla until No 4 had passed The dispatcher is entirely blameless and had he received word that No 4 was yet to pass might have stopped her at Fran conia for orders and would have averted the wreck STANFORD INSTRUCTORS TO JOIN HANDS FDR LIFE Its Inability to Deal With the Question Underthe Present line via Yakima Special Dispatch to the Chronicle WASHINGTOfr December 25 The Italian Government has been renewing Its efforts of late with the authorities in Washington to have pur Federal statutes so extended as toprotect foreigners In cases arising within the iur Isdlctlon of States thus giving a Federal remedy for lynchlngs and like affrays directed against Italians such as have occurred in Louisiana Colorado and Mississippi It is the exchange of Views recently which brought on the discussion In the Italian Senate when Baron Fava Interpellated the Italian Premier as to the progress of an adjustment Immediately on the arrival of the new Embassador Signor Emayor des Planches he took up this question which had arisen in connection with the lynchlngs of several Italian citizens at Irwin Miss In this connection Signor Des Planches said to day Under the treaty which exists between Italy and the United States the citizens of each country are guaranteed the fullest protection while residing in the other country In cases Of Americans residing in Italy they had exactly the same rights the same pro tection the same recourse to the courts that an Italian subject enjoys The only exception is in connection with political rights In the case of Italians re siding In the United States the treaty assures them the same rights and pro lection given to American citizens But unfortunately1 this expression of the treaty so far as it relates to Italians In this country is somewhat theoretical for under the American system which limits the Federal au thority over states the central Gov ernment Is not able to give effec to the guarantee laid down by the treaty We fully recognize the difficulties of this situation which has been as ap parent to the statesmen of this country as they have to those of Italy We have hoped this Would bring about the enactment of a law which would permit the Federal Government to carryout the guarantees of treaties This would be a genuine remedy for affairs similar to those which have occurred in Louisiana and Mississippi and wpuld prevent the periodical agitation over cases arising In the States As these cases arose they would be assured of attention under thq Federal authority with can ful regard for the execution of treaty obligations A JH10 four car re destroyedeaTy the Pullman being saved The injured Clark engineer
