McCorriston said today he has notified Tokai's attorney of the ruling that the company "is not discriminating against American citizens because of race, color, creed or ancestry." People of different race, color and ancestry are able to buy the apartments in Japan, unless they are American citizens, McCorriston said. TOKAI'S decision not to sell the units to Ameri- Good Guys Case Under Advisement The State Supreme Court today heard an hour of complex legal argu-mentsun the State's case against the Good Guys for Fasi, and then took the matter under advisement.

A. decision will be issued later. The State has charged that Mayor Frank F. Fasi's political organization violated the 1970 campaign law when it failed to report several large donations received after Fasi filed for mayor in the 1972 election. FASI'S organization.

Good Guys for Fasi, claimed it cannot be prosecuted because it is an unincorporated entity. The arguments today were concentrated on the 1970 law which used the word "persons" to define who can be prosecuted and whether the word included unincorporated entities. The State contends the organization can be prosecuted, such as the Committee to Re-elect the President. Associate Justice Bert Kobayashi made it clear he disagreed with the State's position, saying at one point he could not see how the Good Guys for Fasi could be found guilty. HE AND TWO other justices agreed that the 1970 law was ambiguous in its language.

Hearing the case were Kobayashi. Chief Justice William S. Richardson, and Associate Justices Thomas S. Ogata and Benjamin Menor and Circuit Judge Yoshimi Hayashi. The case was appealed to the Supreme Court after District Court Judge Ronald Greig dismissed the case, ruling that an unincorporated entity cannot be prosecuted.
