BegunProbable Arrests for Perjury LEFT HIS FAMILY DESTITUTE Disappearance of Man Responsible for an Accident San Diego April 5 Some weeks ago a miner named Wallace employed as bucket man at the Helvetia mine in Julian lost control of the windlass while hauling three miners up the shaft and they were precipitated to the bottom a distance of fifty five feet The men were not seriously injured and succeeded in climbing out of the shaft soon after the catastrophe Wallace immediately disappeared evidently crazed with the thought that he bad caused the death of the men From that day to this do trace of Wallace has been found and his familv and acquaintance fear that he has killed himself or wandered away into the desert He left a wife and four children in destitute circumstances and last Sunday Mrs Wallace gave birth to twins both of the infants dving the following day She and her children are in a deplorable condition Yesterday a petition was received by Supervisor Jasper of that district asking aid for the unfortunate woman DETECTIVE SULLIVANS DEATH More About the Altercation With Sheriff Matthews Tacoma April 5 The body of Sulli Tan the dead detective will be shipped to Portland to morrow Orders to that effect were received to day from Manager Barnes of Thiels Agency at Portland An autopsy to day developed the fact that death was caused by the heart which was in a diseased condition failing to perform its functions The lungs were gorged with blood The cause of heart failure was the Intense excitement produced by Sullivans encounter with Sheriff Matthews The Coroners jury returned a verdict findr Ing that death resulted from heart disease One of Thiels men arrived to night to take charge ot the remains Sheriff Matthews who was on the stand at the inquest claimed that he had not hunted Sullivan but acknowledged that he had felt bitterly toward him He mid the story of the row in the hotel corridor as previously detailed Deputy Sheriff Viant who went with Sullivan to his room said that there Sullivan wanted to explain what he had said about Matthews claiming that a mistake had been made in the telegrams passing between here and Baltimore in the Concentrating Plant Entirety liMtroffd Salt Lake April 5 A special from Frisco to the Tribune says The new concentrating plant and hoisting works of the Horn Silver mine have been totally destroyed by fire The mill made its first run on April 1st but was not in operation when the fire broke cut The fire is supposed to have been of incendiary origin The timbering of the shaft is on fire and the ground is supposed to be caved in for a distance of 200 feet Men were sent through the air shaft but were unable to get near the main shaft on account of the smoke All the miners were hoisted safely excepting six who were compelled to climb the ladders through the air strait from the 700 foot level The loss is estimated at 100000 Nothing is known as to the amount of insurance carried KILLED IN A SCUFFLE A Man Thrown Heavily and Suffers Fatal InJuriS Jackson April 5 Last Monday a young man named James Quinh started a scuffle in a friendly ay with Albert Morgan who was employed at the Globe Hotei Quinh was under the influence of liquor tic was thrown Morgan falling across him Hegotupqitickly and left the room without say tog a word But It was noticed that blood was issuing from his none He was at once put to bed and a medical examination showed that he bad sustained serious jnternal Injuries from the effect of which he died this morning He exonerated Morgan from all blame The him on a cot This closed the case for the defense and argument was begun Attorney Frank Short opened for the ptosecuiion The speaker confined himself to an analysis of the testimony The keynote of his arguments were contained in the following paragraphs Richard Heath has sworn before this jury that be was a friend of McWhirter Yet he testifies that a man named Childers came up to him and said that people were accusing him of the mnrder That is a peculiar circumstance that men sbould so early accuse McWhirters dear friend of his undoing Heath talked and denied his guilt almost before the sun had risen on the morning of the murder Short claimed that Heath was convicted out of his own mouth and that to believe Heath was to disbelieve twenty reputable witnesses who had testified to the anxiety of the defendant and his denials On the day following the murder Attorney Tupper followed for the defense but the court adjourned before he had completed his argument Tupper characterised Mrs Palmrs testimony as false in every particular It is expected that tne case will go to the jury on Saturday afternoon or evening It was rumored to dav that Judge Harris would file a complaint charging Mrs Dispatch to the Choxicik Omaha April 3 Organized labor to day won its greatest victory when in the UniWd States Circuit Court Judge Henry Caldwell handed down his decision in the Cnion Pa cific wage schedule contest In the long opinion this declaration of the Court stands out most prominently A corporation is organized capitaL It is capital consisting of money and property Organized labor is organized capital its capital consisting brains and muscle What it is lawful for one to do it is lawful for the other todo It Is lawful for the stockholders and officers of a corporation to associate and confer together for the purpose of reducing the wages of its employe or of devising other means of making its investments profitable It is equally lawful for organiiied labor to associate consult and confer with a view to maintain or increase wages Both act from the promptings of enlightened selfishness and the action of both is lawful when no illegal or criminal means are used or threatened The courtroom was thronged with railroad men at the hour set for the rendering of the deciMon There were a few preliminaries before Judge Caldwell began his reading As the opinion proceeded the faces of the Cnion 1acitic officials lengthened while those of the employes grew roseate as they saw the drift of the decision and began to realize what a re markable victory was theirs At lis conclusion the silence became oppressive and until MarshRl White declared a recess not a movement was mate on the purt of the spectators to break the spell It was a dramatic ending to a most important case There was not a phrase not even a word of legal verbiage about the important document for Judge Caldwell declared I wanted it to be so plain that even the lowest man on the road could understand every word of It When Judge Caldwell left the bench the leading men of both sides shook bands with the jurist Mt Vrooman thanking the Court for its decision No thanks are necessary Mr Vrooman responded the Judge tfhen a court does its duty without fear or favor it is not deserving of thank The path was well blazed all the Court had to do was to reiterate the principles laid down from the beginning and that it sought to do in its feeble way Just beiore the court adjourned Judge Gantt of North Platte attorney for the men asked the Court to fix the expense account for the men in view of the fact that there were differences of opinion Instantly Judge Caldwell responded You ought to be ashamed of yourself to ask the Court to participate in this matter Dont come herewith the statement that you cant agree as to the expenses Then turning he said There is General Manager Dicainson you may arrange with him as to expenses which will cover the cost of aversge living in Omaha which can be easily ascertained General Manager Dickinson nodded his approval As to the far reaching characterof the opinion the utterauce of Attorney George Hodges who represented the engineers is most timely It is the greatest judgment in vindication of the rights of men pronounced by any court since the historic judgment of Lord Mansfield in the Somerset case The opinion continues in force the present rules and regulations governing the road men except that it modified the orders of Judges Dundy Riner and Hallet made in the wage eases the former ordering the receivers to put the new rules and regulations in force the latter restraining the enforcement of the new schedules pending a hesnng between the receivers and the men It lays down hew principles of arbitration between the contending forces of wages and capital being in direct opposition to the opinion of Judge Jenkins in the Northern Pacific wage matter and it lays down stringent rules as to intoxication on the part of the employes who are held to be servants of the court The opinion exhausts the questions which have been bitterlv fought for manv years and is a complete victory for the rights of the toil ing masses Judge Kiner concurs in the opinion After stating the facts of the roads coming into the hands of the receivers Judge Caldwell says the relation of these men to the company and the rate of wages are determined mainly by certain written rules regulations and schedules which were the result of free and voluntary conferences between the managers of the raiLroud and representatives of the men In different branches of the service Among the rules was one to the effect that no change should be made in the rate of wages without firt elving the labor organizations reasonable notice Judge Caldwell then recites how the receivers were In court last January to force a reduction of wages Judge Caldwell then says that when a court of equity takes upon itself tne cosiness 01 operating tne roaa tne men become the employes of the court and are subject to its orders The Court contends that the receivers have not offered satisfactory proof showing the schedule to be unreasonable and believes the receivers made the request igrtorantlv as only one is a practical railroad man The Court desired an economical administration but to do this wages must not be below just compensation The recommendation of the receivers to adopt their schedule cannot be accepted because it was adopted without giving the men an opportunity to be heard which is a violation of the agreement The specific performance of a contract to render pergonal service cannot be enforced by injunction pain or penalties or any other means No injunction ordered can make such interference any more of contempt than the law makes it without such orders After the rendering of the opinion the formal orders were made which Included amendments to the rules governing engineers All of the representatives of the men expressed great satisfaction with the decision General Attorney Thurston for the receivers said The decision relieves the receivers and managers of the road of a great responsibility I think evervbody concerned is glad to have the Court takethe responsibility as a reduction in wages is always necessarily unpopular with the men and disagreeable to the managers Resolutions were adopted by the board ot adjustment of the Locomotive Engineers reciting the facts in tne case and stating that the board will do all in its power to carry out the decision of the Court Chicago April 5 President Carpenters ultimatum was received by the Exeter April 5 The cruel and unusual method of punishment frequently adopted by the young woman who teaches one of the grammar school in the adjoining town of North Hampton has created no little ill feeling there It has been the custom of the teacher who came highly recommended from a Massachusetts Xormal school to place cavenne pepper upon the tongues ot th offenders and upon their refusal to open their raouttis to rub it upon their faces and even into their eyes Parents and pupils protested vigorously but the school Board upheld the teacher and expelled nine pupils several of them girls just entertne upon womanhood As a result a stormy annual school election was carried by the friends of the expelled pupils and the retiring members of the School Board were defeated for re election gymnasium battle ball has proved so well adapted to the needs of a gymnasts work that it seems destined to become general even outside the confines of the school or college The game has been thus far tried only at Harvard and has me every objection Both the men in college and their fair co students of the annex find It absorbingly interesting quite replacing tennis as a competitive game It has the sports AGAINST THE TRUST A Decision Adverse to the Great Whisky Combine Chicago April 5 Judge Gibbons to day sustained the demurrers filed by Attorney General Maloney to the pleaa of the whisky trust to the quo warranto proceedings The pleas set up generally that there was no unlawful combination as charged in the information and asked that the quo warranto be dismissed In the course of his opinion Jndge Gibbons said Tt appears without contradiction that this defendant corporation has absorbed eighty one other corporations and that it controls the price and output of the product manufactured It should hardly require the aid of a precedent for a conrt to decide as a matter of law that any syndicate or combination who owns and controls eighty one distilleries and the production intervention of the United States in a suit to determine tbe rights of these settlers was referred to the Committee on Judiciary It was brought up in the committee five times and was four times defeated but was finally passed all the Republicans voting for it and some of the Democrals The report of the committee is as follows Many thousand acres of land were granted to tbe Southern Pacific Railroad Company In thC State of California and elsewhere along the line of the road Certain conditions were imposed upon the company in order to perfect its title to those lands since August 1887 the Interior Department has beld that these conditions were not complied with by the company and that the lands were forfeited to the Government Acting upon this ruling of the department hundreds of tracts have been sold by the government to actual settlers who have entered upon the lands and made valuable and lasting improvements These setter lands as well as nil vacant lands in the same category are still claimed by the railroad company and it has intituted suit against some of the settlers to oust them of their possession The Government having sold and patented the linds to the settlers and being largely interested In thertsultsoi these suits youircora mitice believes that the Government should intervene in at least one of the suits and defend its title It is therefore recommended that the accompanying resolution be passed The resolution sit slightly amended by the committee is as follows That ln prner to obtain proper construction of the actwof Congress of July 27 18S and March 3 1871 concerning grants of lands in Southern California to the Southern Pacific Railroad Company so far as said grants relate to indemnity lands and in order to determine the rights of the United States to lands within the indemnity limits of said grants the United States Attorney for the Southern District of California is authorized to intervene on behalf of the United States in one or more suits now pending or which maybe brought in said district involving the rights to any such indemnity lands as a test case and inch suitor suits may he appealed to the Circuit Court of Appeals and tbe United States Supreme Court as in other cases A minority of the committee will introduce an amendment to the resolution providing that the decision in one case shall not necessarily
