Hamilton widow oi the late Hamilton is not satisfied with her husband 9 will She filed her papers yesterday in th Superior Court contesting a distribution in accordance with the terms of the will of the deceased Tbe contest so far as Mrs Hamilton is con cerned means that she wants 136 235 out of the estate She declares that she re nounces her richt to receive anything under tbe will of ber deceased husband and elects to inherit that portion of the estate to which she claims she is entitled under the law Mrs Hamilton has em ployed attorneys to make ber fight for the fortune Hamilton was one of the best known capitalists in Fresno county He was the owner of the San Joaquin ranch near Sanger which is valued at 92 151 Wnen Mr Hamilton died it was found that bis life was insured for 91000 aid all this money will be collected The deceased was the owner of numerous fine horses and was In the breeding business for a time When be died It was found that he left a rather peculiar will The document had been written by himself and had been stowed away so that even his relatives did not know that he had dispose of his estate Talued at 272 470 by wilL Mr Hamilton failed to remember his widow in any substamal way and did not even recoR nize her neht to inherit any of the estate except as provided in the wilL The testator provided that his widow and ch 1 dren should enjoy the profi of right to take out letters of administration Alexander Gordon who was a friend of the famil then came in aud secured letters of ad ministration with the will annexed The will is all in favor of the children and the widow feels that she has been neglected in the matter of a substantial provision bhe is not willing to accept one lifth of the prof ts for life and stand the chance of beinc turned clerk for Sanford and Belt clerk for Lay mance It was decided that the recount should commence at the tirst ward and then go right through the city After that the country precincts will be taken up It will be im possible to tell who is the victor until the very end for the reason that objections are made lo many ballots and tbey are marked and laid on one side The ballots will be taken up at the takers at any price Toward the end Daniel Meyer the capitalist came to the front with a bid of 20 000 lor tbe bonds and they were knocked down to him The sale created somewhat of a surprise be cause it was an indication as to how the bonds stood on the market These bonds were originally worth 1000 apiece or a total of 40 000 Ihev were owned by Phoebe Blair and Montgomery and earn uel Howe The trio were pressed for money some two years ago so tbey went to Daniel Meyer and borrowed 30000 on I their promissory note giving the Doncis then valued at 40 000 a security When tbe bard times struck Charles Hansen against the Southern lactic Company A jury in Judge lack court awarded Hansen as compensation for personal injuries 10 000 which the ra I road company must now pa Hansen was lnmrjd on Jane 20 lss at which time lie was but 7 years of age While walking along the railroad track at the crossing of Th rt eth sireet bis foot was cauent in a cattle gnsrd He was unable to extricate himself and a passing train of the railroad company ran over and crushed his left leg in such manner as tn require amputation borne novel points of law were raised on tbe trial of the damage suit It was urged that Hansen could not recover for the reason that he bad been a trespasser on tbe railroad con pany right of wav The evidence it was rtid failed to show that either tbe plaintiff or tbe public bad ever acquire i with the consent assent or permissioT of the railroad comjanv the right of user of the railro id as a wav for travel or as a playground or place of rendezvous for children rie compan also claimed in support of a motion for non suit that the att guar was of tlia most approved pattern and that there had been no proof of negligence on the part of the engineer in failing to stop the train The evidence disclosed the fict that the engineer used every possible efTort to stop the train after he Jiad dis covered that the boy was caught Counsel for the injured boy answered tb ese points of the railroad companv with a claim that Hansen could not have been a trespasser for the reason that the publ had been allowed to use the railroad ss a public thoroughfare for vesrs On this point Judpe Slack instructed the jurj in substance that if for more than twenty years the loens in quo had been used by tbe public as a foot path for travel with the knowledge of the railroad companv and without its protest or objection then the jury might infer that such use of tbe track and right of way was with the ac quiescence and permssion of the defend anl There was slso an instruction that if the jury found that tbe company did permit tbe piaintiti on us track then it was the dutv of the company to exer else reasonable care to see that the lad was not injutcd The Supreme Court holds that these instructions fairlv sltted the law and were in no wise objectionable For this reason the verdict of the jury is sustained A judgment for 18000 in favor of tbe heirs of William Pepper and
