December last Thompson went on a debauch which left him In bad condition both physically and financially He then went to his brother Fred and asked to be sent to some asylum where he could not get drunk and where he would be taken care of It was finally agreed that he should go to the County Jail and remain there under lock and key until he had become perfectly sober and thought he could let drink alone While he was at the County Jail about December 15th Attorney Bennett visited him Attorney Sawyer was taken Into the ease Sinclair told them he was being kept at the Jail against his will and wanted to get out Tbe attor neys thought that 50 wouia or proper fee for their services so he wrote East to his sister for 1100 Attorney Bennett testified that Sinclair had said nothing at the Jail about his Inheritance until the attorney had agreed to secure his release on habeas corpus The witness said Sinclair told him that his share In the estate of his mother amounted to from 110000 to J150O0 and that his brothers were trying to have him railroaded to an asylum in order that they might be appointed guardians and have control of the property for their own Interests Witness said Sinclair offered to give him half or even more of his Inheritance In case he could get hold of It Bennett would not accept more than 23 1 2 per cent so the agreement was drawn up on that basis In expectation of an attack from the brothers Bennett then had two medical friends go to the Jail and examine Sinclair as to his sanity The doctors report was favorable so they were preparing Ho proceed when the brothers Intervened with a petition for guardianship Attorney Sawyer took the stand and testified practically aa did his colleague Both attorneys were severely cross examined by ex Mayor Chapman who appeared as counsel tor the petitioners He did not spare either ot them Bennett had no memory for dates he stated that the matter was ot such small Importance that It had made no lasting impression on his mind When Bennett referred to his colleague as Judge Sawyer Attorney Chapman insisted that he did not know any such person The question of a partnership agreement between Attorneys Bennett and Sawyer came up for it appears that by tbe agreement with Sinclair Bennett was to act as guardian and Sawyer as attorney In the matter The petitioners would like to show that there was a conspiracy between them to get hold of Sinclairs money Sawyer denied tne partnership They had discussed the matter of partnership be said for the first time about ten days ago but had not signed
