Case Marie Burrc OK bi baa submitted some very rcy testimony to Judge Sanderson to iniUm her petition for divorce from ber husband Iouts Massen ben the was nera playing at the Baldwin sbe apDlied to the conrt for the anunltnent of ber marital bonds bat some question arose which required that the should fur nlsa more eTidence of the charges sne made Sbe has complied with this requirement and has presented to the court the com plete story of ber wrongs It will be re membered that it was not definitely stated whether ber hnsoand Mr Massen wag an American citizen or not Now fell light la thrown npon this point Mr Maisen was born in Paris France He never became a citizen of this country and as Miss Burroughs says he expressed a deaire never to become a citize i of the United States In fact be bad a certain feeling of hostility against America which be was not backward in expressing 1 Tbat be is an alien is now established be yond doubt This brings up a nice Question of law upon which Judge Sanderson will ponder whether a divorce can be granted when one of the parties is an alien Another matter whicn was discussed when Miss Burroughs first applied for a divorce was that there might be collusion between her and Massen to secure a de cree In her second deposition which she made in Boston and which reached the court Wednesday last sbe testines that there is no coll us on between her and her husband stall tbat sbe separated from him some three or more rears ngo whei sbe learned that he had been guilty of infi lehty and that although sne wa associated with him in thesame theatr cal companies he has never nee sustained the re ation of wife tu She then re cites how careful she has Dren in her con duct to prevent any suspicion attaching to her According to the view of Massen which Is presented he is evidently a man of very ga habit In the complaint which Miss Burroughs filed she charged him with adultery with Dolly Moore in Cin cinnati and also wub a woman in Buffalo whose name she does not know In the latest deposition wh ch she made In Boston sbe adds another gallantry to the list and attaches some of the notes which she says Massen eceived from this Boston woman Miss Burroughs accident ill found the notes a trunk some me ago She stales that the rendezvous of the two was at a place in Boston known as the Tavern The rrst letter submitted from this Boston woman to Massen read as follows Darling Leu Since writing this morning I have decided to go oat to my brother to be gone until to morrow and you know 1 have an engagement for to morrow evening and Thursday Savings Bank of Oakland bas made sn important suggestion in regard to the probable defense of his son fchelbv Mar til who is now being threatened with a suit by Valeria Hicketh er Martin The bank president bas taken a lively interest in all publications about his son and if it is necessary he proposes to furnish any financ al backing son may require in order to battle in the certs Mr iMartin does not believe that his son ever meant for the marriage contract to stand He thinks Shelby signed it when mind was not exactly clear The banl presi dent bas stud ed the case very closely and le thinks Shelby mast hsve been celebrating The father in speaking about tbe pe culiar situation of his son said 1 do not care to discuss tne mstter because 1 think enough bss been said about it There bas hesn nothing said between cbelby and myself regarding what will be done in the matter I do not thins however that there will be a contest in the courta It is my opinion tbat an amicable adjustment will be made a short time The whole matter has been a very hard one for bneluy to deal witn coming at this time It seems unfortu nate that so roue notor ety should be given him now He bas been a model young man In ererv respect for four years past He was somewhat Id at tbe time this affair happened and I am satisfied he was under tbe Influence when this contract was made He has as much as told me on my part The story has been passed around in Oakland to the effect that rcng efforts are being made to compromise the case so that will not have to betaken into the courts A young attorney who is verv much in erested tne case snd who is very close to Shelby Mart in speaking about the story of the comprom se yester dav said I do not think you will see anv comprom se in this esse now for too breaa up any amicable settlement It may seem Js sfange thing but still it Is true Shelby Martin and the lady are frends ou will observe tbat in this whole controversy neither has said an unkind word about the other The way the matter stands now it Is probabie no action will be taken for several days Mr Martin does not want to take the offensive He pro poses to be on the defensive In this ma tar While both officials regard this as unjust they decided that the intent of tbe law which was to make every one pay bis taxes was good and they would allow it to take its coarse without attempting to Important opinions yet expressed by Attorney General Fltigerald was sent by him yesterday to the Board of RailroaoVCommissioners The opinion involvos fhe rights and powers of street railways as well as transportation com panies as they are construed In the laws of tbe Btate The Railroad Commissioners were in donbt upon two important points They asked first Do tl various provisions of tbe Constitution and laws of this 8tate conferring powers upon our Board author ize tne eiercise of such powers over elec trie and motor ra Iroads other than street railroads with towns and municipalities engaged In tbe transportation of freight and passengers within the State Tbe second quest on asked by tbe Board was almost as important It was aa fol lows Has our Board authority to re qu re the maintenance by railroad com panies en paired in the transportation of freight within this State of such switches on the lines as our Board may deem necessary for the proper accommodation of shippers along tbe lines of such rail roads To these questions affecting not only the Interests of ra Iroads operating in different count es bjit street ra Iroads in every large ciy of tbe State tbe Attorney Geneia has given the following opinion one of the most mporlant he has given nee assum ng the duties of his present position First I am of the opinion that street rail roads within the meaning and intendment of the exception to the definition of transportation compn found in section 14 tsubdlv ion 1 of ne set to orjn se and de fi the powtrs of the Board of Railroad Com missioned tst es of lgo passengers from one part of a th cklv popu ated strict to an other a town anu a city and is suburbs 1 a street ra way no matter whether the cart are prope ed by anima or mechani ca power Ou rode also tn the tie devoted to Street Ra lroad Corporat ons vis on 1 par 4 4 treats of them throughout wltr re at on passenger traffic on These au nor es fu ly sustain my con elusion If the franchises of tbe ectr and motor railroads in question mere authorize them to operate as street ra roads then in assuming to act as ra porta companies in the carry ng of pasngers and fre ght or freighton tne a un awfu ly exercising their Irirtch Code of Procedure sec on 803 and yourBoard wi 1 furnish me with evidence of that fact I will at once lnsti tute proceedings against them to forfeit their franchises snd at be same time to enjoin them Irom turther operating their roads as carriers of fre ght if however they are au thorlied by their Charters to carry both passengers and reight freight alone they are transportation com pan es as dehned by the act of 1880 and within the meaning of section 22 article 12 of the Constitution and are subject to he jurisd ctlon of the Board of Railroad ommlu oners Second it is also mv opinion that the pow ers of your Board are those conferred upon it by section 22 art cle 12 of the Constitution Those powers are To establish rates of charges for the transportation of passengers and freight by ra road or other transportation companies and publish tbe same from me to time th such changes as they mar make to examine the books records and papers of all railroad and other trans portation companies and for this purpose they shall have power to Issue subpoenas and all other necessary process to hear and determine compalnts against railroad and other transportat on companies to send for persons and papers to ad minister oaths take tes monv and punish for contempt Of the orcie and processes In the same manner and the same extent as courts of record and enforce the decisions and correct abuses thro lgh the med um of the courts and prescribe a uniform system of accoup be kept by all such corporat ons and eompan es It Is a so pro ided in said sect on that he Leg ature may confer such ir her powers on he Com sslone as sha be necessary to enable them to rform the du les enjoined on them in this and the forego ng section Tbe tore going sectior re a es discrimination in Charges and fac 1 es The powers thus conferred upon the Board of Rai road omm ssloners do not include the authority to requ re th ma nteoaaee by railroad com pan es engagedMn the transpor tatlon of Ire ght with th tte of such swi ches on the lues as ssld Board may deem necessary for the proper accommoda on of shippers along the line of such rail roads Therefore the Board possesses no such authority However by section 481 of the Civil Code the duty Is njolned ipon rail road companies to furnish sufficient ac commodatlons for the transportation of all such passenger and property as offer or is offered for transportation at the place of start ng at the inction of other railroads and at ding and stopping places established for recefvtng and discharging way passenrers and ueuht sho any such company neglect pe form th duly thus enjoined upon by law the Attorney General upon the ieir of any person injured by such negligence can institute proceedings to
