reason to reject them Fred Foss the president of the Berkeley Chamber of Commerce espoused the cause of Wharff declaring that be latter original plans were the best that the buildingbuilding could be constructed for 30000 and that the town would be getting a building worth about 7000 more than it would under the Stone and Smith plans Tuesday night when bids were submitted for the second time the representative of Stone and Smith arrived ten minutes late and could not legally then emter their plans It would seem that the Board was favoring that firm in rejecting for the second time the plans of Wharff When the bids were submitted for the first time the plans of Wharff were accepted but later rejected The bids were called for last October and the town has since been paying interest on the bonds This morning Wharff gave out the fol lowing statement I decline to enter Into any further competition for the Bancroft Way School for the reason that I have already submitted plans and specifications covering all the conditions embodied in the instructions to architects as prepared for the Board by Professor Dressier which are as fine as could be compiled for a school of that character Having done this and the former plans and specifications having been rejected I consider it useless to spend any further time or money ln preparing further plans for this school and did I think otherwise the time is entirely too limited for any architect to prepare plans worthy of the town or of the expenditure of the sum of 50000 SURRENDERS AND GIVES BAIL REDWOOD CITT February 8 report of the Grand Jury which was filed yesterday and which severely criticised the management of the poor farm and made a scathing arraignment cf its superintendent has been variously received the opening argument for the people in the case of Lester Mc Nutty charged with assault with criminal intent As soon as Brown closed a recess was taken for a few minutes and McNulty rising from his chair walked over to the side of the deputy distrlot attorney That was a good argument Everett the defendant said to the man who has been taking a substantial part ln prosecuting him Glad you think so dryly responded Brown and the Incident was closed The case of the State against Lester McNulty rests upon the evidence of three individuals porothy Olson Mlas Jeanette Forbes and the German named Wallen who was driving past the scene of the assault and heard the cries and screams of Miss Olson Every effort has been made to Impeach Dorothy Olsons testimony and It has been shown that she made many conflicting statements but ito effort has been made to Impeach Miss Jeanette Forbes or Wallen A Frick counsel for McNulty reviewed the testimony of Conductor Alves and Officers Farrar and Jamison To morrow morning he doubtless will come to the meat of his argument which he may not conclude until some time on Saturday It is probable that the Judges charge will not be heard before some time on
