Lent in the right thigh bat Inflicted only a flesh wound that will heal in a few days At the receiving hospital it was learned hat the would be murderer and suicide 521 James Fognrty and that he was already prepared for the shooting is proved ly the fact that he left a long ill spelled and rambling letter addressed to the Public Press to now this will tell why i don this In the letter he charges William Lent the father of his intended Tictirn with haying swindled him oat ol 2400 in a stock deaL Lent the elder was president of the Bodie Mining Company and Fogarty charged that Lent induced him 10 purchase and hold the stock on the assurance that it would rise Instead it fell aid Fogartv holds Lent responsible ior hs loss llis attack upon young Lent was to revenge himself for this Mr Lent afternoon Wtliism Brown Registrar of Voters and Kiy Fait Itis deputy have causa to fjeel uneasy The cases of Brown and Jfalk came up in tbe Police Court on the motion made by their attorneys to qbaah the complaints made against them by Dr jC ODonnell for having falsified election returns Their attorneys argued tnat the complaints did not state a public ofianse as tbe semi official tally shees which the culprits are charged with haying altered were in no sense public documents Judge Love denied tbe motion to dismiss and held that under section 113 of the statute the offense charged is a crime Tbis section refers to any paper that is filed or deposited in any public office or place for any purpose whatever said the Judge The language is very broad Now as I understand it these semi official returns the blanks are printed at tbe ex pense of the Government They are issued out of the office of the Registrar they go to the different precincts of the city and county with instructions to tbe election officers to mars down on them the vote as it was cast and to return them fo the Registrar Xow continued Judge Love if these papers can be altered it Is time we found it oat because it can be readily seen that if anybody 1 dont mean to insinuate that anybody hsa done sc bnt it can be readily seen that if anybody was vicious and wanted to alter the official returns the first thing would be to mutilate the semi oracisi returns in order to make the two correspond when the official count came off Now if these papers are not official snd not worth the printing on them it is about time tbe people fonnd it out because if they are not official they are instruments of evil and ought to besuppressod If the Registrar has no right to have them printed he baa no right to send them out en I it seems to me they ought to be stopped This is not a conn ol record ti the Judge in conclusion and the defendants cannot le injured if their motion to dismiss is deiieJ Tills is a matter of very grave importance and I am not going to dismiss these complaints and hold that these papers are naught They certainly serve some official purpose They sre put out in an officiil way they come back and are deposited in be Registrars office If they hare been rltered 1 think that under this section of the code here has been an offense committed If I am wrong in my conclusions however the defendants have their remedy They can jo before tbe Superior or tbe Supreme Court on writs of bslwai corpu and have this point decided within a very few hours The motion to dismiss is denied In the course of his remarks Judge Love declared that he had given the question more study and thought than any other Lmatter that has been before him as a po nce magistrate The preliminary examination of Crown and Falk wjs continued until next 5fon day afternoon It habeas corpus proceedings are not had in the meantime on the law point raised by their couneel the talcing of testimony for the defense will begin at the shooting bad been done he stated positively mat the men were engaged in a struggle when the abota were fired end by doing so placed herself iu dirct opposition to her daughter who on Friday last swore that the men were several feet apart at tliat moment Mrs Jlnnie Johnson wbo also resides near where the murder waa committed and who was a witness to it was next placed on the stand Her testimony was to tbe same effect aa Mrs Holdens and threw no new light on the matter She became a little confused however when asked by Attorney Foote if she bad at any time made a statement to a police officer At first she denied havinz done so Then later on she admitted that she had and gave as an excuse for the first denial the fact tnatabedid not know that the men to whom she had recited her version of the shooting were police officers Upon the Conclusion of Mrs Johnsorj testimony the prosecution endeavored to place witnesses Sullivan and Toomey on the acand but as neither one
