ts BmrmTmmw 1 BOOKS TO BE EXPERT ED TTTHEN tbe ces of Frederick A Conway and Eobert VV Lyons deputy slerks charged with grand larceny In connection with the theft of ball moneys were called in Judge CabanlM court yesterday afternoon Conway failed to ap ear There had been a rumor about cthe Hall of Justice all morning that he had left the city and those of his friends who were asked about him said frankly that they did not know his whereabouts He was last seen shortly after midnight tyesterday in a saloon in the heart of the tenderloin district and at thattlme he twas drinking heavily He seemed to have a large amount of money with him and was not loath to spend it His attorney Archie Campbell who ritepbslted the 500 in gold coin which secured Conways liberty after he was Arrested last week tried to convince Jthe Court that his client would surren dr himself but did not succeed Judge TCabanlss listened to an acrimonious debate between all the attorneys present Jand then ordered forfeited the 500 on deposit isatfed a bench warrant for the missing man and placed his new ball at jsooq casn or sioooo Donas ai me same time and in sDlte of the vigorous pro tests of Attorney John Barrett he continued the hearing of tbe Lyons case until 11 oclock next Saturday morning and saw to it personally that the Police Department was placed in fun possession of all the facts available in the Conway case Ten minutes later Captain of DetectlvesLMartin had four men out looking for Conway As soon as Judge CabanUs called up the bail cases as the regular order of business in his court Attorney Campbell who up to this time has represented both the defendants announced that he appeared only for Conway Lyons came into the room with Attorney Barrett and the two sat facing Clerk Fen ton just beneath the bench I would like sal4 Campbell if It please the Court to have the Conway case go over until next Thursday Judge Cabantss Jet hla eyes rove over his audience and then turned to the Miqrney VI dont see your client in court he said VHes not In court responded Campbell easily Where is he I dont know your honor 1 have notse him since yesterday The fact Tour motion for a continuance is ae nled The defendant should be present and if he is not then there are other motions which will be In order But if It please the Court I am willing to admit that the defendant through no fault of mine Is not here If you will have hs name called out in the corridors by the bailiff as the law requires and If he does not respond then I will myself ask that a bench warrant be Issued for his arrest AndI will ask for a gooddeal more than that put In Assistant District Attorney Hanley who with District Attorney Bylngton was standing to the right of the bench I will ask that the bail money to secure the presence of Conway here to day be forfeited But thats my money protested CamDbelL I DUt It up myself vjb all of it yoursr asked the Court Yes sir every cent of it Andlwant to say that this request of the assistant district attorney is without any precedent It has never been made In any siroilar case In the past The ordinary procedure at such a time as this Is to give the defendant another chance to show himself and then if he does not do it his ball money should be forfeited There has never been any case ex metis similar to this in the past said District Attorney Byington dryly Judge Cabanlfs interrupted the lawyers In a rapid exchange Of contradictory statements touching the point raised to say that the failure of a defendant to appear had frequently led to theeontmuing of a case and did not result always in the forfeiture of the flriei But Jhe Court heard the rumor this morning declare the Judge that Conway would notfappear here and his non appearance shows that the re 5 port was well founded It Is to my mind a plain case of flight and lean Jnot take into consideration who de posited the money to secure the de iifendants Presence If you did that 3 Ir Campbell you did it at your own 4V 1mr in A The Diamond Match Com pany Secnres Eiffcy Thousand Acres in Butte BIG SECTION OF CENTRAL PACIFIC GRANT INVOLVED SJHRINERSARRiyiRQ NJSW OWJfEBS Wttl ESTABLISH A FOREST done a great deal of work for the city in past years as the Investigating representative of various public boards and has served as agent of the Grand Jury on several occasions will to day begin an official inquiry into the Police Court records at the Hall of Justice It Is said that City Treasurer McDougald will detail a clerk to assist him in order that quick comparison may be made between entries In the court records and those affecting the same cases in the books of the Treasurers office In this way transactions covering the past two years may be easily checked and if a systematic search for fraud is made the worst of tbe scandal if it has not already been told will quickly be brought to the surface There is some doubt as to who the expert Is working for but as he has been employed at routine examination of the books in the various city departments for some weeks in making the annual report required by the Board of Supervisors It is likely that this special assignment comes directly from the Board Elliott was at the Hall of Justice yesterday afternoon but only glanced over the records and left word that he wouIdtbe back at 10 oclock this morning It was reported at the City Hall that Mayor Schmltz had suggested the inquiry but this the Mayor denied last night But you can say or me he added that I am very glad the Investigation has been undertaken him sharply Why dont you quit weeping he said Whats the matter with you anyway Campbell made no reply and Hanley moved that because of the absence of Conway the case of Lyons charged as co defendant go over for a few days By that time he remarked I think we will have Conway here On what demanded Lawyer Barrett now rising for the first time do you base your belief On our confidence in the Police Department said Bylngton Well my belief is as good as yours and I have no confidence that Conway will ever be caught Lyons is ready to stand his examination right now There followed another wordy mix up which Judge Cabaniss finally insisted should be conducted with decorum and then both Barrett and Bylngton made speeches The former insisted on Lypns being given his preliminary hearing right away and sajdthat all the guilt in the bail kiting easels rested on the shoulders of Conway This young man he asserted pointing at Lyons was a victim of the co defendant He was simply used by Conway as a messenger boy to take an order to the City Treasurer and to transact business for a man whom he trusted He is as innocent of crime as you are Judge He has bis character and good name at stake in this thing and tbe 1 longer the case drags the worse it will be for htm The failure of Conway to appear here to day is no ground for a continuance Lyons is no longer bound by any ties of friendship to Conway He Is prepared to go on that stand and tell the whole truth andlf the District Attorney wants to take advantage of the evidence he will give we shall hot object Byington said In response that he had charged the two men together and that he wanted to try them together if he could In the charge both were assumed to be equally guilty and he did not propose to permit the case tbdrag noitta keep Lyons very long In suspense He said he did not think Conway could possibly get away and that as long as there was a good chance of getting him he did not want to try onehalf his case Just giveus go and examine the marvels of genius atKav 221 Montgomery street A Andrews proprietor Another big sale of timber lands in California has been made The Diamond Match Company of Chicago the big trust which practically controls the match business of America and has a strong position In Europe has bought over 50000 acres of timber lands In Butte and adjoining counties While no fig ures as to the amount of money in volved In the transaction have been gven out It Is known that the company paid from 2 60 to J5 an acre for the land The total price was probably not far from 200000 The greater part of the land involved In the sale was formerly part of the Central Pacific land grant of 1864 About twenty years ago Dakln Dorland purchased a large tract in northeastern Butte county with a few sections In Plumas county This Arm was afterward merged In the Sierra Estate Company and about 10000 acres of the holdings were sold to lumber companies Last year Dakln was commissioned to find a purchaser for the rest of the holdings about 40000 acres He succeeded In Interesting the Diamond Match Company in the land and It was examined by their cruisers last summer Last January Clough manager of the companys lands and factories in Massachusetts came to California and took over the lands for the company The tract consisted of every alternate section with some outlying pieces Tne remaining sections contained much valuable timber and the companys agents set about acquiring them A tract of 4000 acres was taken over direct from the Central Pacific Company and some 2000 acres were purchased from the Farnum estate Many Intervening sections were bought from homesteaders and others were secured by means of the so called forest reserve scrip which is Issued by the Government to owners of lands in the forest re serves In lieu of their holdings The greater part of the scrip was purchased from men who had secured Southern Pacific lands in the reserves In the Bouthern part or the State About 6000 acres were acquired In that manner The acquisition of these lands by the Diamond Match Company Is In line with its policy of taking over large tracts of lands either bearing timber or suitable for its production To the average man of business or to most corporations planning for the future development of the business does not extend over more than fifteen or twenty years If that long but the big match company looks farther than that it plans for all time apparently Many years ago the company purchased a tract of about 30000 acres In Massachusetts partly timbered but for the most part cut off Pine seed was planted and to day the company has a large forest and as the price of timber Is very high In New England the company is practically independent So In buying 60000 acres of timber land In California the company Is simply making provision for raw material Few large tracts of timber are left in the United States which the company finds suitable for its purpose New England was devastated of Its pine years ago while in Michigan Wisconsin and Minnesota sawmills are being shut down every year by the score and the mlllhands are moving away to the Pacific Coast Practical methods of forestry will be used on the new purchase Caretakers and patrolmen have been sent up and the timber grabbers and shack makerswill find that particular tract of land a good place to keep away from On the cut over portions and in the meadows and old river bottoms new trees will be grown 400 pounds of pine seed having been sent out from the East to plant When the time comes for encroaching upon the virgin forest only those trees over a certain age and size will be cut down and as is practiced in Germany and Japan under the forestry laws for every tree cut down another will be planted The company will have a practical forester In charge of the tract who will use modern and common sense methods In the care of this Diamond Match Company forest MISCEXLANEOfS mm ki3m a HEIR whose duty it was to gather the evidence required In the case claims that he is blameless and that he i will report the matter to his department with anything but praise for the assistant United States attorney who had charge of the prosecution He stated yesterday that from the first he was Inclined to call on the department in Washington for legal assistance realizing that United States Attorney Woodworth was too busy to conduct the case in person I hesitated about taking such a course he said fearing that it would create ill feeling here and this is the result Assistant United States Attorney Banning was slow In preparing the Indictments and when I was asked to obtain the names of the Registers of the Marysvtlle and Susan vllle Land offices he did not tell me why he wanted them I obtained them from the blue book and nothing more was said about them after they were given by me to Clerk Sherrard I did not see the Indictments after they were prepared until the morning of the trial and did not know whether the filings were made before the Registers or the Receivers of the respective Land offices Banning on the other hand as well as Sherrard Insists that Cullom was asked whether the filings were glade before the Receiver or the Register and what the names of the officials were In response to this Sherrard claims that the special agent told him the oaths were administered by the Registers and that after a brief absence from the office he returned With tbe names of Rosenberg and Johnson that these were incorporated in the Indictments and that the documents were then read over by Cullom It Is not the business of this office said Banning to gather evidence only to present it when It is furnished by the special agents If they furnish us with unreliable data the blame cannot be placed on our shoulders The Indictments were legally perfect but for the error in the names of the officials administering the oaths I shall bring the matter before the Grand Jury again this afternoon by means of other witnesses and will procure new In dlctments with the old witnesses on charges of conspiracy and conspiracy for subornation of perjury We nave tho original
