Struck by Duhem AS THE result of a fight In a classroom with Raymond Duhem a flfteen year old pupil Professor Adolph Herbst principal of the Adams school is nursing a big lump on his right cheek and a much perturbed spirit Young Duhem lives at 1450 Franklin avenue and had rather the best of the encounter which was witnessed by a large number of pupils Professor Herbst Is very much aggrieved and he went before the School Board with his highly decorated countenance yesterday to induce that body to expel Duhem from school He was hardly prepared for tba conservative Raymond Duhem Who Had a Fist yesterday dismissed the charges against Dr Herbert NIms and Dr Frank Thomas who were charged with causing the death Gladys Cunfilngnam of San Jose The girl died In the office of Dr Thomas at McAllister and Larkih streets on July 17th and her father who I a wealthy merchant of San Jose told the police that his daughter had be brought to San Francisco by Dr Herbert NIms of San Jose for thn Embezzlement Charge on Motion of District Attorney The charge of embezzlement on which a true bill was found by the last Grand Jury against George Ballinger was yesterday dismissed In Judge Dunnes court on the motion of the District Attorney Ballinger was accused of misappropriating the funds of his employers the California Art Glass Bending and Cutting Works and two juries haVlng disagreed as to his guilt the District Attorney and Judge Dunne agreed that it was useless to hope for a conviction Ballinger was for many years with his firm and left to take part In the Philippine campaign Upon his return from the Orient he resumed his position but was at work onlya few months when the alleged shortage was found The matter was presented to the last Grand Jury In January and a true bill was found The case was tried before a Superior Judge of Sacramento county and the Jury disagreed Another trial was held before Judge Doolihg of San Benito county and another disagreement of the Jury was the result Superior Judge Graham then reviewed the case and examined the evidence taken at the preliminary examination of Ballinger on a writ of habeas corpus He decided that the evidence was insufficient and ordered the release of Ballinger but the District Attorney desired to make one more effort in the courts to convict the alleged erfbezzler When the case was called yesterday morning the District Attorney stated that he was or tne opinion that owing to the lack of clear evidence it would be Impossible to convict Ballinger and he therefore moved for a dismissal This was granted and
