the water front reported to the police last night that he had found a shabby sloop rigged boat bleating about helplessly He had drawn the boat up on shore and found that it had been deserted tq all sustained the decision of Judge Frlck setting aside the verdict of manslaughter against Louts Muhlner and granting him a new trial the State might have been able to present a much stronger case at the second trial for It is believed that the weapon with which the crime was committed has been found The revolver was ndt produced at the first trial and all efforts to find it failed The case was necessarily weakened to that extent but still a verdict against the accused was returned by the Jury Since the tnal and appeal of the cas to the Supreme Court by the State a revolver has come Into the possession of the officers It was found by a gardener In the rear of the house adjoining the Mooar residence where the murder was committed and near the route taken by Muhlner to escape from the spot according to the theory advanced by theState at the trial No efforfhas ever been made to trace the possession of the revolver but It ls believed that 1 could be done If necessary Tea a revolver was found near the scene of the murder said Assistant District Attorney Church when asked about the matter to day and it Is quite likely that It was the weapon with which Muhlner killed Jennie Lewis We never went to any pains to have the matter looked up but held the point tn reserve for any contingency that might arise The weapon was found back of the house adjoining the Mooar residence and at a point according to our theory passed by Muhlner as he fled from the scene after shooting the Lewis girt It was a caliber weapon and Jennie Lewis was killed with bullets of that slxe It would have been the most natural thing in the world for Muhlner to hve thrown his revolver away as he fled and that Is the way we argued at the trial The revolver was found at an unfrequented spot and the chances are against its havtng been lost by any one else We may inveslgate this matter fully and try and trace possession of the weapon to Mublner District Attorney Snook declared that he firmly believed that the
