the heirs of Earl Marshall against i Simeon Stivers of Mission San Jose would be resumed by an appesl to the ipreme Court in a few days The contest is to obtain possession of over 600 acres of land at Mission San Joe forming one of the most valuable estates In the county There a romance in the case Old Earl Marshall came to California in lo47 In the ship Brooklyn and settled at Mission San Jose He was married but no children blessed the union and he adopted and raised Simeon Stivers the defendant In the present action He prospered at the mission and acquired the property now In dispute In 1S3 he transferred one half of the estate to Stivers and in 1SS0 sold the other half to James Gillan an elder of the Mormon Church to which he had during his reeidence at the mission been con vprted Later the half was conveyed bv Gillan to Stivers and again con veyed by him to Marshall and his wife to remain in tneir possession unm tney died Marshall died in 1SS1 and his wife a few years later At the death Of the latter the heirs of Marshall among the rest Dr Marshall of Oakland sought to regain possession of the prop erty It was claimed by them that the transfer of the first half to stivers was not legal because the wife of Marshall who was at thet time Insane had hot signed the deeds It was also claimed that the sale of the other half to Gillan was cot genuine and that Marshall did not receive the 6000 which it was agreed should be paid for the land An action was commenced in the courts a couple of years ago but It was dismissed without prejudice because of the failure of the plaintiffs to press their case The delay has been occasioned largely by the tact that it has been Impossible to find Elder Gillan of the Mormon Church He believed to be alive but all efforts to find
