Kennedy mloe he received dividends so The fact that Banker Pitcher had taken his own life was first discovered about 9 oclock In the morning by pEIans depositors by their presence time be had finished a light meal and departed with papers and books after having spoken about the Yarney litigation and having remarked that he was going to Oakland In the morning to attend the trial and put everything In a satisfactory light The news of Pitchers suicide spread rapidly through the little town of Idy ermore A run on tne pans was iramei dlately instituted and was continued steadily throughout the rest of the day though without apparent excitement or assemblage of more than fifty persons at the bank at any one time The two other trustees of the estate and the lawyers for them and those for the heirs arrived In Llverraore during the after noon and reassured some 01 ine local Borensentbe man of alt wqrk who wa the only other person who slept it the house Sorensen says that he arpBe at 5 oclock and went about his outdoor duties He was aware that his em player had Intended to depart for Oakland by the early train and when he learned that Pitcher had nofbeen seen at the station he entered the house to find out what the matter was He knocked at the door There was no An earlier demand had been made on the bank because of the suspicious developments in court Friday and Pitcher had wisely anticipated a demand and Increased his cash supply by J5000 Oakland banners broueht from bis Yesterday evening It was elven out that ST WJ the books of the bans would ne reieasea nia portion bought by his daughter tragedy The latest suit known as Var ney vs Varney brought on the climax In effect It was an effort by the heirs or beneficiaries under the will of Varney to get the major portion of their Inheritance now It was costing almost 15 000 a year to maintain the whote estate intact simply for the purpose of paying out of It annuities latterly amounting to but 3500 a year The bene flciarles wanted the major part of the property valued in all at nearly 500000 to be distributed to them and simnlv enough left to produce reasonable expenses and supply the funds needed for the payment of the annuities Put their demands necessitated an Investigation of the financial status of theestate and consequently a presentation In court of the books in which the records were kept by the three trustees who were also the executors of the estate II Pitcher cashier of the Bank of Liver moret John Taylor the San Francisco mining man and Thomas HB Varney the Ban Francisco cycle dealer and president of the Bank of Llvermore i When Banker Pitcher was on the wit ness stand last JTriday the attorney for the beneficiaries were able to prove by nia own aamissions inat me trustees were practically 140000 short on funds of the estate intrusted to themi Pitcher nad also to admit that J191000 of the trusttnoney had been put Into the Bank pf Llvermore and that po Interest had ever been paid on It He was forced further to admit that as trustees they had sold for the estate more than 16000 shares of Kennedy mine stock to themselves at the minimum price of 3 a share Just before the price suddenly went up to 1S a share and dividends of 0 cents a share were declared He floundered In a pool of conflicting statements while exptalnlng this and other peculiar transactions but he left the unmistakable impression that he sold the Kennedy stock for the estate because John Taylor advised it though John Taylor who personally owned something like JKKX shares of the same stock bung on to his purlng his explanations It became apparent that Trustees Taylor and Pitcher and Var pey had sold the stock nominally to their trusted friends and then bought It back for themselves privately Taylor having that hi aggregate income was probably between 000 and 110000 per annum response He tried the knob It yield This would seem to have been ample He entered and saw Pitcher pre a nA Mii wn sumabiy asleep He called to him by the Oakland court thai they might be thoroughly Inspected by the State Bank Commissioners who are expected to arrive in Llvermore to day and take charge of the affairs of the concern pending a discovery oiine true siaiuB ti There was no answer He approached of the Institution VlVT vrL the bed and shook him gently Thecov Mrs pitcher and her two daughters left tarrying 1 twenty year old daughter Pearl Pit cher a student at the University of Call fomla and their sixteen year old daughter Hazel Pitcher a pupil of Miss Reads School But financial troubles drove him to take hfsown life Yesterday forenoon he was to have appeared on the witness stand in an Oakland court In the case of Varney JL Varney and prove he could by the books of the bank and by other documents that there was not a shortage of about UQ 000 and other Irregularities In the funds of the Varney estate of which he was practically the sole manager Just as he was the Pooh Bah of the Bankof Llvermore iii which according to his own ttamagtng admission on the witness stand last Friday be bad put something Sorensen ran to the home of DrWYS Taylor a block distant and summoned him When the family physician arrived he saw that Pitcher bad been dead for sometlme Sorensen was quite sure that the plstol must have been discharged after 5 oclock as he believed that he could not haye failed to have been aroused by the report If It1 had oc curred while he was yet in the house The position of the bedclothlng indicated however that the suicide had taken the precaution to stifle the sound as much as possible Deputy Coroner Horton was quickly notified and caused the body to be removed to local undertaking rooms A Coroners Jury was hastily Impaneled and taken to the scene of the tragedy A carefur examination of the room dis if rivTtioi nnn nt th trunt capital without closed nothing in the nature of an ante nvinrTnirt nn tt thPitati mortem statement There was not a That he originally Intended to produce the bookstand papers In court Is as apparent as that he afterward medl tated suicide In the chamber of death were found the documents that he had spent several hours collecting and preparing jit tne hank Sunday evening and there also was seen the instrument scrap of baper bearing a word purcest lng the cause for the bankers dreadful deed So far as could be learned Fred Mailey who keeps a saloon and restaurant til after the funeral which will proba bly be conducted by the Masonic order The other relatives of the deceased banker are a brother who is also called Henry Pitcher a sister who Is the wife of a Sacramento business man and another sister Mrs Amy Cecil of San Francisco Henry Pitcher was born In Sacramento forty nine years ago Inv his youth he was engaged With surveying parties for the Central Pacific Railroad across the Sierra Kevada mountains Then he became a clerk In a store In Sacramento Jn18f4 he came to San Francisco and became an employe of the Bank of California remaining with that Institution nearly eleven years He quit the Bank of California to become the mahagerof Thomas Varneys banking interests in the Llvermore valley and late in 1885 was mademanager of the Bank of Llvermore which was incorporated wlth 100000 of Varneys money AsaTesident of Llvermore Pitcher was at different times Town Trustee School Director a member of the public library board and a promt in the town was the last man to seei nent factor In the League of Progress Pitcher alive That was a few minutes The litigation leading up to the sul after 10 oclock Sunday night At thai clde is an Interesting preliminary to the But these were not all the remarkable revelations Pitcher was to have appeared In court with the books yesterday He preferred to blow bis brains out Van leys will was probated March 3 1S90 Varney had established the Bank of Llvermore He put into it JlOOOOOits entire capltalstock An attempt was recently made by Pitchers attorney SOoodfellow of this city to force Bishop and Treat out of the case at the start on the ground that Earl formerly of Oakland and once attorney for the beneficiaries was now of the firm of Bishop Wheeler Bishop believed that something was the matter with the guardians of the trust funds He proceeded on that supposition as the case progressed The admissions he got out of Banker Pitcher proved that his surmises were correct The suicide apparently indicates that more revelations might have been made There are about a dozen beneficiaries or heirs to receive the bulk of the Var ney property Two of them1 Mrs Varney of San Franclscoi mother of Thomas Varney and Mrs Eliza Brownell of Llvermore reside in California The others live In the East and are either brothers and sisters of the testator or nephews and nieces Several of these beneflclarles are also annuitants so that there should have been no reasonable opposition to a speedy distribution of the estate and a saving of the bulk of the expense of fl 5000 a year Their re luctance to produce the books caused suspicion to fall upon the trustees MAY DAY FESTIVAL WILL BE A SUCCESS Teaeers Gettlnsr CordlafSapport tu TlieIr allowed either of them to enter her house The dead woman owned the property In which she died and is supposed to have left some money The fact that people living next door to her house did not take energies yesterday tft accentuating the claim made by the heirs and the executors of the estate of James Fatr that the action brought by the alleged widow was conceived In conspiracy and petered by bribery and forgery It was known to the defense that In July 1899 while Mrs Craven was occupylng4of flees with Pence Pence this firm prepared a brief to show how prlorjo 1895 1 tt State without a license The paper It supposed to be the result of a special effort by Charles Pence Yesterday Lafe Pence in his desire to show that Witness Louis Dunand was an attorney for Mrs Craven placed this docu ment or a copy of it in the bands of the Court thereby adding another strong link to the chain that being forged bythe defense Is it not a fact1 asked Pence that when Mrs Fair was at your houseln San Rafael In July and you were discussing the marriage in Sausallto she showed you a brief showing that prior to 1895 a marriage In this State without WMKV VfWQt Dunand denied that be had seen anyr such document but a copy was sub mitted by Pence for Identification It was also admitted that a similar carbon copy had been Bent to Wi Foote It Is included In the claims of the defense that this opinion wblch now forms a part of the records of the case sets forth all the forms that were re quired prior to 1895 to constitute a legal marriage without a license With this opinion which admittedly was prepared about the middle of July the Craven conspirators proceeded It is alleged to prepare their case Chinese fashion by providing testimony and evidence to meet the requirements of the law It is In testimony that Mrs Craven went to San Rafael soon after this opinion was rendered staying first at jjupana nome ana wen ai a uoiei Two weeks later she was Introduced by Dlinand to syivajin turn she met justice Of the Peace Slmpton Who was to testify that he performed the ceremony In course of time Slmpton made an affidavit as to the ceremony which be gave to Lawyer Foote Then a contract for 30000 for services was drawn by Dunand for the benefit of Sylva artO measurably of Slmpton and Dunand The i Pence opinion showing how to legalize marriage without a license was floated bet wen July 10th and 15th or before August 12th About a month later the Justice of the Peace had been found his affidavit drawn a contract of fXOOOO as compensation for services executed and Mrs Craven had revived the litigation by which she sought to recover a contract Widows allowance out of the Fair estate When the case was railed yesterday forenoon Dunand resumed the witness stand for further cross examination at the hands of Laf Pence i Can you fix the date when you first met Mrs Fair in San Rafael last July asked Pence I cannot About how many days was it prior to your trip to Sausallto to meet Sylva 4 Probably less than two weeks When did you first bear that she claimed that there was a solemnized marriage 1 As we reached the sidewalk after leaving the boat at Sausallto she said I havent told you yet that I was married to Senator Fair by Slmpton In 1892 That was the first time and I am sure of it The witness declared that at no time prior to this had Mrs Craven and be discussed the marriage ceremony He explained that be bad distinctly told the lady that he wished to hear as little as possible for there wereeo many attorneys In the case that if anything leaked out he did not wish to be held responsible The witness denied that he had read with Mrs Craven ascrapbeok of testimony In the deed case The scrap book wrapped In a newspaper had been left at his office by the lady and placed by him In an unlocked drawer T6 whom he gave it he did not recollect It might have been to Pence him self He delivered it he recalled on a written order from Mrs Craven He would try to find that paper The witness was unable to recall having had any communication with Sylva about fees after leaving the latters offlce in Sausallto He said there had been no such communication JThe following letter which establishes etlll mpre firmly the fact that Sylva was engaged byMrs Craven with a small retainer and that the 30000 contract must have been drawn as compensation was Introduced by Pence
