Colonel Joseph Huston Found Guilty of Dereliction of Duty and Sentenced to Reprimand Court Martiai Sentences the Officer to Be Reprimanded by the Reviewing Authority LIElTENAXT COLONEL Joseph Huston has en fouiul jruilty a court martial of dereliction of duty In not attempting to juell the recent soldier riots at the Pres idio The sentence of the court is that Huston be reprimanded by the reiewnR authority Major General Hughes It fui ther states The court is thus lenient on account of the evident opinion held by the accused that he was acting within the provisions of the law There were two charges against Huston one of not taking roper or sufficient steps to quell a oldier riot which he knew was in progress outside of the Presidio the other of mnduct to the prejudice of good ordrr and military discipline Of part of this harge hn relates to the general disorder continuing without interference from Huston he is found guilty but the court did not agree with the charge that Hustons command to Lieutenant Feeter to remain within the gate limited that officers action so that he could make no attempt to assist thoe calling on him for aid in stopping the riot In reviewing the verdict of the court members Major General Hughes disagrees with them on thi point and maintains that the prosecution brought evidence to bear showing that Hus ton In his order told Feeter to not take any further action and that this ldence was not disproed bv the defene General Hughes rebuke is harp He sis The enUnce is approved and confirmed In executing the duty assigned hjm it is thought the reviewing authniitj that it is onl necessary to invite the attention of the accused to the reasons given by the court for the leniency of the sentence It seems to be almost incredible tlai an otticer of Lieutenant Colonel Hustons advantages should believe the law was such thai he mut permit a riotous assemblage uf soldieis to commit an aggravated breach of the peace and continue this criminal tourse for from one to tv hours along hut outside the fence marking the boundary of his camp in the immediate vicinity and in plain hearing of his tent where he was without the right of initiating any steps to suppress cuch ri tous assemblage But the court ha ing found that the accuse 1 eidently held that he was acting within the province of the law the reviewing authority limits himself to stating that under the conditions as are shown to have existed in this case any officer failing or ne glee ting to take all possible measures to suppress such riotous conduct and to bring the offenders to Alarm There was a narrow escape from fire in one of the coal bunkers of th battle ship Oregon edc das iron Ing the hundred or more tons in a compartment becoming healed ai ettlng off a thermostatic alarm Th th rmns tnt was set for 150 degree temperature When the bell attached to the instrument rarg a hasty examination of the bunker was made but no lire was discovered As a precautionary mearurc however the compartment was flooded and all possible danger thereby overcome The other coal bunkers were found to be normal In temperature No excitement was caused on board the Oregon the thermostat bell and no hrt alarm was sounded on the ship Some of the officers and men who were about to go ashore were in fact not aware of the occurrence until the returned to the Oregon yesterday and it did THE CITY From the South seas comes a story of the murder of a German traders lfe and Infant daughter by the cannibals of the Solomon Islands the most uncivilized portion of the South Pacific Although the crime was committed last June news jf the affair was brought to port only yesterday upon the arrival of the scrboner Neptune Captain Kessler fifty eight days from Ja luit Gilbert Islands For oer fle ears the Neptune hits been trading among the Gilbert islands and returns here to be repaired and newly outfitted The Neptune was built at Benicla by Captain Matthew Turner for Captain Kessler the sole owner and the fact that she is not only copper sneathed but copper fastened explains why she has been enabled throughout a long period of more than five jears to withstand the raages of the teredo and limnoria which are particularly destructive In tropical waters Missionaries from the Solomon islands took the story of the Solomon isl rnd murder to the Gilbert islands At New Britain in the Solomons Herman Wolff represented a German trading coirpanj and with him lived his wife and little daughter Wolff had had no trouble with the natives though aware of their treacherous inclination and frequently left his wife alone at New Britain while he visited other portions of the island on brief trading expeditions He was on one of those periodical trips last June and during his absence two or three natives took a pig to Mrs Wolff and asked her to buy it demanding tw Ice as much as it as orth She declined to take the pig and the departure of the natives with the animal from the house was the signal for an attack upon the place a large number of the bloodthirsty cannibals armed with spears and native axes Rushing in upon the defenseless Mrs Wolff the natives quickly cut her down with repeated blows upon the head cleaving her skull Her infant was asleep at the time In a cradle The murderers cut off the childs head fixing it upon a pole that was left standing beside the door and after looting the house and adjoining store fled to the brush Wolff was first to discover the bodies of his wife and child when he arrHed home the following day and from two or three of the natives who had been in his employ learned some of the details of the crime He however was unable to apprehend the murderers Assisted by a fellow German who had just come to visit him from a neighboring settlement Wolff burled the bodies of his wife and child near his house Missionaries who put Into New Britain soon afterward learned of the tragedy and in the course of their cruising about the South seas carried the story to the Gilbert Islands Captain Kessler of the Neptune brought information too of the loss of the Danish bark Union on a reefat Ja lult a few months ago All hands Lawyer and Erratic Client DIVORCED MONTHS AGO BUT FORGETS IT ALL MRS ELIZABETH ALLSTEAD SAYS SHE DID NOT SIGN THE COMPLAINT Attorney In Placed In a Rldlcnlons Plight Through the Com plaint Made by a Woman THE ARBITRATION STAGE IS REACHED Notwithstanding the fact that Gus tave Allstead secured a divorce from his wife last January a second suit was filed last Saturday by the former wife asking for a legal separation from he ex husband and this suit has been quickly followed by a denial on the part of the woman that she was the complainant Allstead is the man who on the night of January 29th of this yeir shot and killed Thomas Normile whi the latter was assaulting Mrs AllsteUd on a lonely trail far up on Bernal Heights The killing occurred on the very night of the day upon which Allstead secured a divorce from his wif and he was acquitted at his preltminar examination by Judge Cabaniss upon the ground that the killing was justifiable Inasmuch as the defendant was at the time protecting the woman who a few hours before had been his wife from criminal assault Ever since that tragedy linked with its divorce decree Allstead and the oman have been living under the same roof at 51 East Park avenue It is said the divorced wife occupied apartments on the second floor with a minor son while Allstead lUed on the ground floor of the dwelling On the 14th of thi month Mrs Allstead appeared at the home of Attorney Foster with a pathetic tale of abuse and brutal treatment on the part of her husband and asked the lawyer to begin divorce proceedings in her behalf Foster says he has know the oman since boyhood she having been a nurse in his mothers family during his infancy Tne attorney claims not to have had any knowledge of the divorce proceedings instituted by Allstead nine months ago and while he felt some sympathy for the woman on account of the pitiable tale of woe she told him still he adlsed her to attempt a reconciliation Five days after this visit to his home Mrs Alt stead appeared at Foster office in the Mills building Foster was out at the time and Mrs Allstead transacted business with Grover who with Moody is associated with Foster in the law business Grover states tha the woman appeared to be much agitated and after waiting a couple of hours for Foster to return finally left requesting him Grover to instruct Foster to begin divorce proceedings against her husband at once This message was delivered to Foster by Grover and the former drew up the complaint handed It to Moody and Instructed him to take It out to Mrs Allstead and secure her affidavit and signature This Moody did and the complaint for divorce was filed in the Superior Court last Saturday Startling allegations of brutal conduct and mistreatment were alleged in this complaint Among other things Mrs All stead swore to being that her husband had beat her with a strap and had compelled her to sleep In the cellar The latter Indignity she averred took Dlace on the night of October 14th The publication of these alleged cruelties as complained of In the womans action for divorce has now aroused Allstead and also Incited his wife to deny that she had ever signed any complaint for divorce In this denial Mrs Allstead states that she had no knowledge of the complaint had never authorized the same and had not paid a cent of money counsel fees In this denial Mrs Allstead also sets forth the fact of her divorce from Allstead on January 29th last and makes the further statement that she had not since remarried him When shown this signed denial yesterday Attorneys Foster Grover and Moody were nonplused The former explained that he had drwn the complaint upon the information of Mrs Allsteads visit ss given him by his law partner and he had advancinr the filing costs of the suit out of charity for the woman who had nursed him in his childhood and whom he had been led to believe was a much abused and long suffering wife Grover was inclined to be very wroth over the matter He declared that if Mrs Allstead denied authorizing him to irstruct Foster to gin divorce proceedings that she diverges from the truth and he mentions the name of Lent a mining man who was in the office at the time and heard the conversation as a witness to the truth he tells Moody emphatically declares th it Mrs Allstead signed the complaint ard affidavit at her own house where he had taken the document as Instructed by Foster James Boyer who was attorney for Allstead In his dlorce proceedings against his wife last January makes the statement that he filed the complaint on January 9 1902 On the 29th of the same month a decree of divorce was made by Judge Kerrigan upon the grounds prayed for habitual Intemperance and the father was given the custody of two minor boys Boyer also admit drawing up the statement of denial made by Mrs Allstead In reference to the complaint filed by Foster In her behalf last Saturday He says Mrs Allstead came to his office on Tuesday and said she was there at the Instance of her former husband and asked him to prepare the denial she wished to dictate This Boyer did and the woman signed it in his presence An unsuccessful attempt was made to interview either or both Gustave Allstead and his divorced wife Elizabeth last night at their place of abode 51 East Park avenue The house is surrounded by a stockade fence the door for there Is no gate to which was bolted on the Inside Allstead opened the door but upon being spoken to quickly slammed It shut without allowing his visitor to enter the yard He flrat said that Allstead was not at home but upon being told that he was recognized he terminated the Interview without further parley There Is a peculiar status of relationship existing in the house of Allstead up on Bernal Heights between woman and man who occupy those premises The woman first complains that she is a much abused wife and then as strenuously objects to being called a wife at all The house Is known as an abode of mystery to the people of the neighborhood and It is consequently shunned by those living in that locality Football Feeling Runs High and Games Are Endangered UNIVERSITY football has reached the arbitration stage as the only plan which will break the deadlock between Berkeley and Stanford over the eligibility of Locomotive Warren Smith and William Johnston of the Berkeley team for college sports So strong is the feellqg over the matter that Intercollegiate games are endangered The chairman of each faculty athletic committee Is decided In his views of the matter and the committees have sanctioned the submitting of the contested cases to the arbitration committee provided for In the intercollegiate athletic agreement This final court of appeal will be appointed by the president of the Tnlversity Club of San Francisco Fairfax Wheelan from among its membership which Includes representatives from all the universities in the United States Three men one of whom may Wheelan himself will have Jurisdiction in the question and special care will be taken In selecting members for the arbitration committee who have no particular feeling toward either university An unofficial communication received from Professor Angell chairman of the Stanford faculty athletic committee yesterday morning by Colonel Edwards chairman of the University of California faculty athletic committee gave him to understand that at least two of his list of fifty eight ootball candidates eligible In his opinion to play in the coming intercollegiate contest would be formally protested The letter states that both Warren Smith and William Johnston are regarded as Ineligible and ill be denied the right to play with the Berkeley team Furthermore Professor Angell announces that neither Varsity Captain Albertson nor Freshman Captain Mlddleton both of whom are registered at the College of Pharmacy In San Francisco are regarded with any fivor by the Stanford student body it being felt that their attendance at this affiliated institution is a thin subterfuge to comply with the letter of the intercollegiate agreement Now that Stanford has thrown down the gauntlet the Berkeley officials including both Colonel Edw ards and Manager Decoto make no concealment of the fact that they will fight all the protests of their rivals Before the Court of Appeal the California management feel they will get the best of the argument The chi contest will be over the eligibility of Smith the veteran half back who is accused of professionalism And he the Berkeley men consider they hav plain sailing In protesting Smith the Stanford men have impeached the action of the committee of the Pacific Coast brarch of the Amateur Athletic Association an organization which ir eludes the two rival universities in its membership and which gave Smith his rmateur standing when he applied for it earl in the season This matter having been settled once and for all by a competent board of examiners investigating the case thoroughly the Berkeley men are confident that the arbitration committee will hardly regard it it their province to review the evident 3 and decide the case for themselves This ignoring of the ruling of the Pacific Athletic Association it Is believer would be regarded as an unpleasant reflection on the integrity and worthiness of the committee that handled Smith case and ould be an act of dlscourtesv that the University Club committee would hardly care to attempt Should this be the light in hich the latter committee regard their mission there will be little left for them to do Having satisfied themselves that all the proceedings in the examination of Smith were regular they would have only to ratify the original decision and return a verdict in favor of the Berkeley halfback So bitter Is the feeling in regard the whole trouble among the Stanforl students that Professor Angell experienced great difficulty in earning his point about the University Club arbitration committee And the controversy has generated such ill feeling that Professor Angell In writing to Colonel Edwards seriously questions the advisability of continuing
