CONTEST IS SUCCESSFUL Court Declares the Executors fcl Must Pay Additional Legacies OAKLAND March 28 By a decision rendered to day by Judges ElUworth and Hall sitting in banc Professor Frank Soule of the State University and Mrs Mamie Bacon former wife of Frank Page Bacon will each receive S00O more from the estate of the late Henry Bacon The money is to be paid with stock of the Bacon Land and Loan Company It was determined that the testator intended to leave each of the contestants J1CUMX instead of 00u which they were paid the executors The decision was based upon the finding that there had been constructive and actual fraud although unintentional on the part of the executors When the will of the late capitalist was read shortly after his death the bequests to Professor Soule and Mrs Bacon were read as 2000 each The word ten was mistaken for two thd writing being so unintelligible that the word might be read either way Copies of the will were made and upon these the instrument was ac mltted to probate When the estate was closed Professor Soule and Mrs Bacon received only 2000 each The error in the reading of the will was not discovered until little more than a year ago when the BERKELEY March 28 Colonel A II Pay ton representing the Santa Fe Railroad Company met with a special committee of the Town Trustees to discuss the matter of granting the franchise asked for by the railroad company The Trustees were willing to grant the franchise ad requested though they desired to obligate the railroad company to maintain a station in Berkeley and to stop all passenger trains at the station Colonel PAy son expressed a willingness to comply with the condition of the Trustees but said the company desired to have a franchise without any conditions As a com piomise he said the Stranger With a Revolver Itoams the Streets After Night SAN RAFAEL March 28 A mysterious man armed with a revolver suspected to be lhe San Rafael incendiary was the cause of some midnight shoot ing last night Frank Johneon presi dent of the Johnson Locke Mercantilt Company took two shots at the man after the latter had followed the tutot of the Johnson children for some distance and had then remained standing in the street with a drawn revolver The tutor was returning after a late visit when the actions of the strange man first attracted his attention The fellow was walking on the opposite side of the street from the tutor and when the latter quickened his pace the sit anger broke almost Into a trot to follow him The educator was unarmed nnd tritfd to avoid the man but the latter in his hurry to catch up even climbed a fence and cut across lots Just before reaching the Johnson house the two men came into the glare of an electric light and the stranger discontinued his chase and retraced his steps into the darkneb The tutor wa returning home after a late visit when the actions of the strange his son started out en a hunt for the iueerly acting stranger They had gone but a short distance when they fund the man standing in the street holding a revol er in his hand Neither Johnson nor his son were armed and they were obliged to turn back to secure weapons They again returned to the scene and locating the man fired two shots at him The shots were fired high and th stranger took to his heels and made lilt escape in the darkness It was praq tlcally impossible to
