Broadway near Thlrterntu street OAKLAND January 11 TVatkinson former president of the Contra Costa Water Company to day abandoned His sensational suit against Bowles president of the First National Bank and McNear the wheat magnate in which Bought to recover J34000 worth of oil stock that he claimed had been fraudulently obtained from him for JMOOO Watkinson was to have appeared today in the offices of Bowles attorneys Chlckering Gregory to make a deposition to be used at the trial of the case Watklson however did not appear Instead his attorney Garret McKnerney appeared for him and ttated that his client had decided lo abandon the action as he had concluded that it would be fruitless to carry the litigation further The case had not yet been set for trial although both Bowles and Mc NeaT had filed answers denying the accusations of fraud and mlsreprsen tation against them Watkinson began his suit on September 17th last In his complaint he outlined the history of the California Standard and Giant oil companies in which he said he had purchased stock because William Dingee with whom he was associated in business was interested in the companies In October Watkinson returned to Oakland after an absence of some weeks having gone away for the benefit of his health On his return he alleged Bowles falsely represented to him that William Dingee had sold his stock in the oil companies and was about to retire from thr directorates of those oil companies He also alleged that it was falsely represented to him that the titles to the oil companies land were involved in litigation which was causing considerable embarrassment Under these representations he said he agreed to eell his stock in the companies for 14000 while the real value of the stock was 34000 The stock was paid for by McNear the deal being brought about by his brother in law Bowles Watkinson asked for the return of his stock or its alleged value in their answers Bowles and McNear denied generally the allegations of fraud and misrepresentation it was alleged that Watkinson was fully cognizant of the condition of the oil companies and that he was anxious to dispose of his stock Bowles said he agreed to accommodate Watkinson In this respect and accordingly secured McNear as a purchaser for the stock It was further denied that the representation that William Dingee had sold his stock was false the fact being that he had sold a large part of his interests Regarding the alleged Illness of Watkinson it was denied that he had been 111 unless It had been caused by his enforced attendance as a witness in the suit of the Contra Costa Water Company against the city to establish water rates DEMANDrHiQH Interest Mrs Horton Asks Large Return for Money Lent to Mrs Baumann OAKLAND January 11 Mrs Jennie Horton who is suing Annie Baumarr ic foreclose two chattel mortgages given to secure a loan of J3S bearing internet a the rate ol lo a month and a lean of JITi tearing interest at the rate of 60 per cert a year filed an answer to day to the complaint in intervention filed by Joseph Gar ratt who claims the mortgaged property on an alleged prior lien Mrs Hoi ton al itges that Garratt has In reality no Irga lalm but thai his alleged claim was ma according to an understanding with Mm Raumann for the purpose of defraud nu the plaintiff out of her rights Mrs Baumann mortgaged a cow her piano and furniture at 3767 Piedmont av inue to secure the loans she received frorr Irs Horton and her husband A Horton The first lean was negotiated on December 19 1900 and the second en May 17th last Mrs Baumann says the ony reason he agreed to pay such a high rate of interest on the loans was on account of the promise of Mrs Horton to take music let ton from her and thus reduce the Interest ft lc alleged that Mrs Horton after the leans were negotiated refused to ae Xtuslc lessons and thus did not receive the nttrest agreed upon All that is really Sue Mrs Horton it is alleged is 1210 and airs Baumann in her answer offers to pay that sum The offer however has ceert ffused by Mrs Horton who claims the interest agreed upon besides the principal Jerome Does Not Improve OAKLAND January 11 There has been rery little change in the condition of Jerome during the last twenty four hours His physician Dr Stratton insists that the patient is no worse than he was resterday yet he has given the family no assurance that he will recover His condition is being watched very closey and cores of inquiries arc made dally as to his welfare About three months go Mr Jerome lost his wife since which time he has been faUing rapidly and he was in no condition to withstand a serious attack ot Illness such as he has undergone Though tot physically a strong mart he has up to a short time ago been an enthusiastic cyclist and for a number of years was cap tain of the Reliance Wheelmen During the time he took an active interest in Wheeling he often rode a hundred miles In a day To Approve Water Bills OAKLAND January 11 Representatives of the Contra Costa Water Company have been Interviewing officials at the City Hall with a view of having some of the corporations claims paid No water bills have been paid by the city the present fiscal year owing to the action of Auditor Breed in holding up the presented claims and the subsequent mandamus suit now On appeal to the Supreme Court Many other claims for water furnished which are not involved in the mandamus suit have been held up by the Board of Public Works It is understood now that the Board will pass the claims on to Auditor Breed who will return them without his approval as he did the other bills Then tnt Board of Works will again approve the bills the Mayor will sign them and they will be sent to the City Council for ratification Jury Could Not Agree OKLAND January 11 The jury which listened to the evidence in the cose of Kmelic Funke Wigner of Alimeda charged with having practiced medicine Without a license was unable to a give and after being out for two hours was discharged It is said that the Jury stood eleven tor acquittal and cne for caiv1c jtlon The case was heard in Justice Qulnn court and will be tried again iVlthin a few weeks Wife Encomiters Difficulties in Her Action for a Divorce Oakland Branch Office of the Chronicle 1154 Broadwar near Thirteenth street OAKLAND January 11 After about six months expensive litigation the divorce action of Mrs Mary Levefra against Jose Leveira the Haywards capitalist is now in the same status it was when it was bejun This is owing to the peculiar provisions of the law which provide that a person must be a resident of a county at least six months before commencing a divorce action there and also that the defendant in an action has the right to have the case tried in the county in which he resioes As a result of these provisions the suit originally commenced by Mrs Leveira in Alameda county was dismissed be cause she was a resident of San Francisco when she filed the suit It appeared from the testimony during the hearing of Mrs Leveiras application for alimony and counsel fees that the wife had left her home at Haywards on account oi her husbands abuse and had gone to San Francisco to reside with one of her married daughters Owing to this fact Judge Greene hel that Mrs eveira had commenced her action in the wrong county she having acquired a residence in San Francisco Her suit in this county was therefore ordered dismissed Shortly afterward Mrs Leveira commenced a second action for divorce In San Francisco When the case came up before Judge Sloss in San Francisco Leveiras attorneys asked that the action be transferred to Alameda county for trial on the ground that the defendant resided in this county and had a legal right to have the case tried here Judge Sloss granted the motion and to day the case was transferred to this county and set for trial before Judge Ellsworth The Leveiras have been married nearly fifty years and have eleven grown children who are divided against one another in the divorce proceedings Mrs Leveira In her complaint alleges that she has endured cruel and abusive treatment from her husband for twenty years She tialms that he has not only beaten her with his fists but that he on one occasion used a cow whip upon her and at another time drove her from their home with a revolver in the middle of the night and later chased her with bloodhounds She also claims that he refused to call a doctor to treat her when she was seriously ill Leveira is reputed to be worth about 30000 He made most of his money on a ranch in Contra Costa county Mrs Leveira asks a division of the properly and alimony pending the trial of her suit Before the case was transferred to San Francisco Judge Greene made an order directing the husband to pay the expenses of the suit up to that date amounting to about 500 WILL PASS IT TO THE GRAND JURY Board of Health Says It Is Powerless to Deal With Faith Healers WAR ON ALAMEDA January 11 The City Trustees will all a speciaUmeeting for January 17th when arrangements will be made for the tale of the 100000 bonds recently voted for a new high school build InK and other school puriioses Arrangements are now under way for prfminv and preparing the bonda and no cnihcuiy Is nniiclpaied in quickly disposing of hem It is expected that a considerable premium will be Directors to keep the Swett Scnool closed In Kast Oakland another week owing to the continued prevalence of scar et fever among the pupils and Superintendent McClymonus to day gave notice that the school will not reopen next week Oakland Branch Oftd cf the Chronicle 1154 Broadway near Thirteenth street OAKLAND January 11 The Board of Health is in receipt of a number of letters from persons who are anxious that some steps be taken to prevent the treatment of disease by Christian Science healers but while the members of the Board who are regular practitioners of medicine do rot countenance treatment by persons other than regular graduates of recognized medical colleges thy are powerless to prosecute Christian Scientists as the law at present stands The crusade against Christian Science healers is rot a new thing in this city wh ere the Scientists are strong and where they hve Just completed the finest church building in the city The movement against them in the present instance has simply been revived owing to the death of little Mar jorie Slater who died of scarlet fever while under the treatment of Mrs Schafer fine of the readers of the Second Christian Science Church Several letters referring to the death of the girl were read at the meeting of the Board of Health last night Or of these letters was received from A Gibson who urges the Board to de vls some means whereby healers may be prevented Trom practicing their profession Frank Sharpe who claims that his home has been wrecked by the Christian Science doctrine also had a communication in which he expresses the hope that some punishment may be meted out to the healers in gen eral and Mrs Schafer in particular He insists that Marjorie Slaters death Is the third which of his knowledge is due to lack of proper medical and surgical attention where the patients were under the treatment of healers The reading of the letters brought out many caustic remarks from the members of the Board of Health who were of the opinion that the matter should be brought to the attenticn of the Grand Jury which is in session at the preeent time Inasmuch a the Board was not exactly clear as to the manner In which thy hould proceed Health Officer von Adelung was requested to confer with the District Attorney and through him bring the matter to the notice of the Grand Jury Mrs Fluno one of the leading Scientists In this city and the second reader of the First Church stated today that not infrequently do healers call in the aid of a surgeon where the need is apparent but aftto why this was not done In the case of the ing Ferry System Will Be Built Without Much Delay EDWARD LAST EXIT OF EDWIN HOLDEN Second Death Follows Failure of Maud Millers Company Oakland Branch Office of the Chronicle 1154 Broadway near Thirteenth street OAKLAND January 11 The second death within a month following the failure of Maud Millers theatrical venture occurred at 11 oclock last night when Edward Holden one of the best known native California actors died at a private sanitarium When Maud Miller died of a broken heart after her return from her unprofitable southern tour leaving a stranded company to follow her home her body was accompanied to the grave on The Heights by Holden who had given his energy to the success of her venture As he turned from the closed grave it was remarked that he had agM perceptibly in a few hours and it is said by those closest to the dead actor that his desire for fe ceased when Maud Milier died Last Saturday Holden gave up and took to his bed with what was diagnosed as rheumatic fever On Thursday his removal to a sanitarium was advised and as he made no effort to live his case was looked upon as hopeless by hi attending physicians He grew worse rapidly and last night closed his life ii delirium Holden was born in California and lacked but a few weeks of being 40 years old He leaves a wife from whom has been estranged several years a soil 11 years of age and a brother George Helden who Is master mechanic at the Orpheum in Pan Francisco Edward Holden made his professional debut as a member of the oil California Theater Stoi Company when it was under the management uf John McCuIIough When only IT years old and play ig small parts his first opportunity for advancement came through the failure of a noted star to appear at the theater one night when billed to enact the role of Hamlet The house was crowded and it seemed as though the audience must be dismissed when young Holden suggested that knew the lines of Hamlet He was triea out and phased both manager and audience by his clever acting Two years ago last June Holden was engaged by Landers Stevens of the Dewey Theater in this city to play Vheavies in melodrama After a year he attempted an opposition at the Mac donough Theater at popular prices but did not succeed He was re engaged and remained at the Dewey until four months ago when he went with Maud Miller as managtr of a read company in which she was to imprsonate seme of the heroines in plfys written by her poet lather At Santa Cruz the company struck a frost and became stranded Maud Miller returned to Oakland and soon died Holden was one of the few who followed her remains to the grave on The Heights where Joaquin Miller buried his daughter He was recently engaged as stag manager at Dietz Opra houss a position he was occupying when seized with his last illness His remains will be sent to San Francisco for interment Oakland Branch Office of the Chronicle 11M Broadway near Thirteenth lret OAKLAND January 11 Frank Smith who in addition to being the Borax King of the world enjoys the distinction of being the heaviest stockholder in the Realty Syndicate and its kindred corporations the Oakland Transit Company and the new company which promises to build and operate another ferry system between this city and San Francisco admitted to day that the purpose of Frank Havens in making his hurried trip East was to look after the bill which has since hls arrival there been introduced in Congress in the interests of the new ferry company The bill if it should be adopted would give to the ferry company terminal facilities on the northwestern shore of Goat island and allow the company to reach the island by means of a steel tube This tube Mr Smith says will be eleven feet in circumference and will permit of the passage of an ordinary electric car by which the projectors the plan propose to convey passengers from the mainland to Goat Island from which point they will be transferred by ferry to San Francisco Asked if he thought Congress would grant the sought for privilege he said he had every reason to believe that it would The project is one continued Mr Smith that can injure no one yet everyone living on this side of the bay or having occasion to cross the bay will be benefited by it When you consider this how can you expect theic would he any opposition to granting tfu sought for permission unless it emi nated from some one who would possibly be interested in some other concern whose revenues might be cut into by the new enterprise There will be another ferry running across the bay whether we are granteo or refused the privilege If we are not allowed to use Goat island for the tube terminal we shall build a mole out as far as we are allowed to do so and then operate our ferries from there as the Southern Pacific is now doing Triers is a possible chance that the terminal on Goat island may be made a union terminal for of course the Government could not well give one corporation the exclusive use of the island Of this however I know nothing and one man can see Just as far ahead on that line as another VERDICT OF ACCIDENT Coroners Jury Finds No Censure for Flanagan OAKLAND January 11 A Coroners jury to night rendered the following verdict regarding the death of Richard Gorman who was shot last Monday evening hile attempting to protect his employer Austin lirien from an attack by Edward Flanagan the jury do find that the name of the deceased was Richard Gorman a native of Ireland aged about 2ij years that came to his death at the Receiving Hospital Oakland al about 5 id oclock A on January 7 1902 and that death was caused by hemorrhage resulting from a gunshot wound In the abdomen resulting from the accidental discharge of a pistol in the hands of one Edward Flanagan The verdict was
