days by a band of peace officers cowboys and Indian trailers was landed In Jail here to day and charged with one of the most brutal acts of savagery In the criminal annals of Lander county The crime charged to the Indian is atrocious bejond belief and becomes a SRage Apathe raider more than a member of the usually peaceful bands of Piutes and Shoshones that frequent tills section of the btate The Indian is charged with a daube minder that has depihed del Giusee a section foreman in the emploj of the Keada Central Railroad of his wife and thirteen months old child and has left a two months old the following morning Del Giosse and Ganser started down the tiack to their ddly labors The Indian at the san time rode awaj on his horse in another direction Upon returning home in the ening an aw ful Bight greeted the father gaze He became alaamed upon appi caching the house at the unusual stillness his little domicile and upon entering the kitchen and finding no preparations for dinner in progress he became filled ith the fear that some terrible calamity had befallen the household Then the faint cry of an infant as heard through the door of the adjoining room Rushing Into the apaitment Del Grosse found the body of bis elder child lj ing on the bed strangled to death He searched through the house for his ife but without avail The boy Ganser gae the alarm while the frantic husband and father continued the search out of doors Finally in a little chicken hojse not more than four and a half feet high he found the object for which he was seeking The body of his wife suspended by the neck to a rafter of the ehed with the ery rope that had been glen to the Indian the night before presented a grew some sight The face had been battered beyond recognition and death must have resulted from the brutal injuries thus Indicted After beating her head and face to a pulp the murdeier had evidently dragged the bod of his lctim to the chicken house to conceal it from the gaze of passers by and thus put off the dlsco erj until the husband return at night His purpose in hanging the bodv by the neck after accomplishing the woman death can onl be surmised as a ery ci ude attempt to cause a suspiclonjhat the woman had committed suicide The appeal aice of the head and face of the Icstim eaes no doubt as to the cause and manner 0f her death The roof of the structure is so low that the womans feet boand tightly with baling wite hung loosely upon the ground All indications pointed to the Indian isltor Jf the preious evening as the perpetrator of the double murder and a posse was immediately organized to trail him across the country An Indian tratlei from Battle Mountain who is ci edited with an almost supernatural instinct in following trails led the hunt after the fugitive With him ere three cow boj and several peace officers The Indian trailer experienced little difficult in finding the trail which led through the hills in the direction of Cortez The trail of the horse was well defined and easily followed for the reason that th animal was without a shoe on one foot Tour hundred yards from Del Grosse house the pursuing party discovered a clew to the provocation of the murder A trunk belonging to the section foreman was found broken open and rifled Nothing of any value was found by the murderer It is supposed that the Indian suspected Del Grosse of having nMotln mnnpv In his DOSSCSsion The faet was that all of Del Grosses money was In bank He had two bank books in his trunk one of which was taken by the murderer together with a bottle of whisky and a suit of clothes A mile and a half further on the pursuing partv found a valise that belonged to the boy Ganser It had been cut open but the contents were without value The Indian as ov ertaken and captured without much difficulty in the Cortez mountains after a two days hunt and as brought here to day Robbery is believed to be the sole provocation of the tragedy Why the murderer destroyed the life of one inno cent Jnfant and left the other unmolested can only be conjectured The theory is adv anced that he feared the screams of the thlrteen months old child might cause an alarm before he had riddn to a place of safety The younger Infant was hidden from view in a cradle and was probably overlooked by the murderer There seems to be no doubt as to the guilt of the Indian and feeling Is intense throughout Lander county Del Grosse is an Italian Swiss has been In the employ of the Ne ada Central for many years and is hlghlv thought of by the officials of the company His wife was Swiss They State POMONA November 5 James Gar lick formerly a resident of Oakland and for twenty ears engaged in the wholesale hardware business in San Francisco and Los Angeles died at Ids home here last evening aged 69 Mr Garlick came to America In 1SS9 from Bristol England and to California in 1875 Although having proprietary interests in several hardware Arms at different times he devoted most of his energy to representing his business on the road and became well known to the retail hardware trade from Seattle to San Diego Several years ago he retired from business and purchased property here He had been in feeble health for a ear Mr Garlick was the father of Miss Annie Garlick who rendered good service as a Red Cross nurse in the Philippines and wno returned recently with the First Calf Ifornla Volunteers Mr Garlick is also survived by a widow another daughter Mrs George A Hall of Pomona and two sons Frederick an attorney or NeW York and Walter of San Francisco TACOMA GREETS THE Mne TACOMA Wash November A Spokane special sajs The Northern Pacific has brought suit against 150 leading Spokane citizens to recover land along its track granted by Congress in the act un er which the Northern Pacific was organized The railwav contends that it Is tntltled to 200 feet of land on each side of its track wherever it was laid through Uiids belonging to the Governratnt At present the railroad occupies only fifty feet on each side of its track Many business blocks warehouses and residences hav been constructed ithln the 200 foot limit and the railway seeks to clear its right of aj China request for certain other information regarding the letter and opinion of Attorney General Griggs respecting British claims In connection with the 1895 revolution here In referring the matters back to the Hawaiian Government the letter states that they are resubmitted for consideration and settlement The question is how far that goes Does it mean settlement on a basis Attorney General Griggs ruling hlch Is general In character or does it leave the matter entirely in the hands of the Government of Hawaii to do as it pleases the United States holding to Its former policy of having absolutely nothing to do with the questions President Dole thinks the matters are again entirely in the hands of the local gov ernment on practically the old basis There are those In town however who think that as the matters were taken up years ago as the subject of diplomatic correspondence between Hawaii and Great Britain they are sjni pending In much the same attitude that fol low Ing annexation they must become a matter between Washington and Lon don Marshal Browns petition for a writ of mandamus against the Collector General of Customs to compel the regis tratlon of the Falls of LOUIS Nov ember 5 George Bar thell a foreman In the wholesale house of the Simmons Hardware Companj to da fatally shot his wife beat his wife father and mother Into Insensibility and then killed himself Barthell had been separated from his wife for four ears and during that time had made repeated requests that she return to him but to no avail This afternoon Barthell walked into the home of his wife parents Mr and Mrs John Rohlhng with a revolver In each hand and without sa ing a word he fired a shot at his wife Ihe ball went wide and Mrs Barthell fled from the room Barthell then knocked Rohlting insensible with the butt of his revolver Mrs Rohlflng endeavored to protect her husband and In the struggle received a broken nose and blows from the weapon that also rendered her unconscious
