Case i Special Dispatches to the Chronicle SACRAMENTO January 29 There win be a dramatic sensation In the Christ murder trial to morrow when the defense puts Its first witness on the stand This witness will tell the jury a tale of love and anguish that would drive many a man to desperation This witness will be the accused wife murderer Hiram Johnson Christs attorney believes that the etory which his client will tell will move the jury to return a Terdlct of acquittal Christ will tell on the witness stand of the love that he had lavished upon his wife for seven years He will tell of denying himself all outside social pleasure for love of the woman who was his wife how he denied himself many comforts that she might be more comfortable and how he avoided spending an unnecessary nickel that the might not be deprived of a cent Then Christ will come to the day of the killing He will say that when Mrs Hart showed him the poetry which she had taken from her husbands pocket that he immediately recognised his wifes handwriting He will further deny a statement which Mrs Hart made on the stand and will swear that when he visited her that afternoon that she showed him all of the letters which his wife had written to Mr Hart and which she had found In her husbands pockets These letters contained frequent mention of him In these his wife said that she did not love her husband any lon ger that he was distasteful to her and that the only man sv irved was Hart Slowly he read these letters which showed the perfidy of the woman that he worshiped and whom he never before suspected That night with his brain reeling he went home to his wife and they sat down to the supper table together His wifes mother was present and he tried to say something but could not bo he remained silent A little later the mother in law left and his wife looking across the table said sneeringiy Why dont you talk Whv do you sit there like a big ignoramus7 Christ did not answer and they got up and went into the sitting room where they remained a moment Then Christ found bis tongue and stepping toward bis wife said Emma I have seen those letters that you wrote to Hart In which you say you love him and do not love me any longer To this Mrs Christ replied with a heartless laugh Christ will say I seized my revolver and what happened after that I do not know This is the substance of what Christ will testify to on the stand to morrow DETAILS OF THE TRIIL The Evidence for the Proseentlon All In SACRAMENTO January 29 The defense In the Christ murder trial will commence to morrow Nearly all of the prosecutions witnesses to day testified that hen they saw Christ Immediately after the shooting he acted ery strangely He scarcely seemed to real lie what he had done and several of them under cross examination stated that they believed that he was not in hi right mind at the time they saw him He tried to kiss the dead body of his wife as it lay on the floor apparently Indifferent to the fact that she was dead Dr Halght who was called to the Christ residence immediately after the shooting said that when he arrived on the scene and found Mrs Christ lying on the floor in a pool of blood he told Christ to run back to the hou and get some ammonia but Christ said that he did not think it was necessary as his wife was dead The witness then said that he examined the body and found that life was entirely extinct He then arked Christ to give him his revoler and Christ did so The witness then told the story of the killing as related to him by the defendant Christ seemed to be perfectly cooL He stooped down over the body once and said Oh my poor wife He said this in a very peculiar tone He explained several times how the shooting was done One the witness saw Christ step across the body of bis wife instead of going arouad it On cross examination the witness said that Christ was unnaturally cool He seemed to be in a sort of dazed condition His manner was altogether out of the ordinary The witness did not believe that Christ realized what he was doing when he stepped over his wifes body At the time witness took the revolver from him he did so because he feared that Christ might take his own life Christ wa perfectly docile and gave up his pistol without a murmur Police Officer Michael Fisher who arrived on the scene In the patrol wagon testified that he thought Christ acted very queerly for a man who had Just killed his wife He seemed to be altogether indifferent When he looked at the body he looked at It the same as a man would look at a chair or stove or any other piece of furniture He seemed to be in a eort of trance Police Officer Matt Karcher stated that when Christ explained the ehoot teg to him he seemed to be going through the movements mechanically He really did cot seem to realize what he was doing After the explanation he knelt down by the aide of his wifes body aadV stopping oyer made a motion if he were going to kiss her Then he said Oh my poor wife a good deal as a little boy would says it In his first declamation There was no feeling In It The witness did not believe that he realized what he was doing Welser street law in which JC0000 is at stake was tried and submitted to day The plaintiffs in the action are James A Clayton and Flickinger capitalists and the defendant is Charles ray a contractor Santa Clara street from Third to the eastern city limits was macadamized in 1SSS and 1SS9 at a cost of about 24000 by Craen Schmidt They were backed by Jacob Heft a local capitalist now deceased and the assessments against fifteen interested property owners were assigned to Haft as security for 11000 advanced by him The street was accepted and the fifteen owrers would not pay their respective assessments and suit was brought to recover the money The property ownersowners won on a demurrer and the Supreme Court affirmed the ruling The job was a bad one and the Mayor and Common Council last November Itt a new contract for the improvement of the street from Third to Eleenth Fay the successful bidder his price being 50000 The pavement Is to be of Mlumen The owners along the street ho are expected to pay for the work have objected to being made liable again for the assessment The plaintiffs are among the heaviest owners on the street Their attorneys contend that the law authorizing the repaving of a street is unconstitutional and that a stn et having been once accepted by the city must thereafter be kept in repair by the city and the city has no authority to repae it at the expense of the property owners It is claimed by the defendant that the street in 1SS8 was only temporarily improved and was therefore not an accepted street within the meaning of the law BEAT A CHILD WITH ft laden from Newcastle for Coqulm bo put into Callao dismasted On the voyage across the Pacific the ship ran Into a terrible hurricane and shipped heavy seas smashing In the rail and afterhouse and breaking the masts like reeds One man was killed For days the vessel drifted about helplessly and finally made Callao where she will be condemned and sold Ohe or two other vessels arrived In port about the same time with their topmasts gone WITH MILITARY HONORS Faneral of Captain Crocker at Grass Talley GRASS VALLET January Cap taln Crocker was buried here today with military honors The Grand a Murderers DaugMer STAMPED ON THE LITTLE ONE DEATH MAT RESULT FROM THE ATTACK Mese the Colville Slayer Her Father Details of the Horrible Prison Suicide Special Dispatch to the Chronicle COLVILLE Wash January 29 A report reached here to day that Minnie Niese the ten year old daughter Of Adolph Nlese who killed himself In Jail yesterday flew into a passion struck a six year old child wit ha stick knocking her down She then jumped upon the prostrate child beat and stamped upon her At last reports the child had not recovered consciousness It is feared she may die The following details of the suicide of Adolph Nlese in the Jail here have been obtained After Judge Arthur had sentenced Nlese and his wife for the murder of the mans little son the Sheriff marched them back to jail and was preparing to take them to Walla Walla prison to day The bailiff notified the Judge that he had heard that Nlese and his wife said last Saturday that they would never go to prison whereupon an order was made directing that the Jail be searched for any weapons or poisons that might be concealed about the premises and that a guard be posted in Jail to prevent violence At 2 oclock Deputy Underhlll took to the jail an elaborate dinner that had been prepared for the prisoners by some charitable people Just as Underhlll opened the door Jailer Dingle passed out to do an errand in the yard Underhlll placed the basket on the table and passed along In front of the cells to inspect them preparatory to inviting his unfortunate guests to the sumptuous spread when he observed an unusual commotion In the cell A glance told the story and Dr Peck who bad been a witness at the trial was immediately called Nlese was yet conscious but could not speak His wife who lay by his left side had yet some strength and said in broken EnglishEnglish Dis is de doctor dat swore lies This seemed to nerve Niese to desperation Notwithstanding the fact that every artery In the right side of his neck had been seered and his life was flowing out he put his fingers Into the ghastly wound and viciously tore them through the bloody wound His last agonizing groans were so terrible that many who stood near became heartsick and turned away He showed remarkable vitality and lived nearly an hour MrsL Niese was at once removed to the corridor of the Jail and a deep wound on the left side of the neck was soon closed Although she had lost much blood it was found that only the small arteries had been cut The Jugular vein had been touched but not penetrated by the keen blade and unless inflammation sets oclock to day at the old Garrison burial ground The woman says Niese cut his throat rs and she took a piece of the ra2or and cut hers but the other prisoners think he did all the work Nlese had broken the razor several days before an so notified1 the officer but secreted the piece with which committed suicide The suicide left a number of letters one to his little girl and others to friends confessed being the person who entered John Brownlles store and stole pistols and cutlery also Richards place He told the officers a straight story and said the reason he gave himself up was that he knew Constable Blessington had been watching him and it was only a matter of time when he would be taken He said further that he had a mania for stealing He was locked up pending action by the District Attorney Clark came to California two years ago and has spent1 most of the time In vallejo When asked what led him to enter Brownlles store he replied I was born that way I cant helpit When SACRAMENTO January 29 A remarkably bold robbery was committed Just outside the southern Hmlt3 of the city hut night at the residence of Rev Massey a retired Unitarian minister Mr and Mrs Massey had gone to the city to remain over night leaving their hired man whose name Is Leech in charge of the premises About 10 oclock Leech went over the house and saw that all the windows and doors were fastened and then went to bed About an hour later he was awakened by a peculiar noise in the room and he awoke to find the light from a lantern shining in his face and two masked men with revolvers standing at his bedside One of them spoke to him and told him to get up They then forced him at the point of their revolvers to visit every room In the house While cue of the robbers mounted guard over Leech who was compelled to hold the light the other ransacked the rooms They were fully fifteen minutes in going through the house and when they had finished they conducted him outside where the bid him a polite good night and disappeared in the direction of the city The robbers got little for their pains the only things missed being some Jewelry of little value and 120 In money Leech describes th robbers as being well dressed und gentlemanly in appearance Both wore overcoats with the collars turned up and slouch hats Their masks were formed of white material and resembled handkerchiefs As yet there Is no clew to the robbers but it is supposed that they are hiding in ths city and possibly may be part of the gang of which four were arrested by the police a few days ago Clark to day when Miss Pay Underwood the Intended bride of Hugo Klaas visited the Morgue a short time after her arrival from Kansas City on todays overland Miss Underwood started for Sacramento twenty four hours before Klaas was killed by John Hurley last Sunday morning They were to bave been married on ber arrival here Miss Underwood was accompanied to the Morgue by Dr Power and wife of this city the effect that the Howell point levee had broken The water was very high but the levee stood until the north wind began to blow More than 60000 acres of tine farming land will be inundated many thousands of acres of grain will be destroyed and the crop prospects of the whole body of land wHl be ruined for the season as the water will be slow to run off and the levee cannot be repaired This levee runs from Sycamore slough northeast to Howell point The district to which it has heretofore afforded protection comprises some of the best farming land In the State The following Is a partial Cracksmen at Los Angeles LOS ANGELES January 29 The most daring burglary reported to the police In a long while occurred about 4 orlock this morning In George Ar buckles saloon A small safe in the office of the saloon was blown open and according to the proprietors between S500 and 600 stolen The safe had been drilled the combination lock broken with a punch and the door blown off with powder The money drawers were rifled and nothing of value was I left in the safe TO IMPROVE THE SCHOOLS Code Commissioners Desire to Make Changes SACRAMENTO January 29 The Code Commissioners have arranged for a special session to be held at the Capitol some time in June next to hear suggestions looking to an economical and effective administration of the schools of the State State Superintendent Black take no further action to prevent the hanging on Friday preparations for which are nearly completed The scaffold was erected to day and an lnclosure sixteen feet high has been built around it The execution will take place in the morning but the exact hour will not be known until tomorrow night Montgomery little sister Eva and young brother Orville isited him in his cell to day His sister Joined the church last Sunday and the condemned boy exacted a promise from his brother that he would also Join the church He admonished him to profit by his ex ample and be a good man He wept bitterly at parting with them The prisoner has become much interested in the Salvation Army The members of the army have visited him several times and Montgomery sas he likes thtlr religion When seen in his cell to night he said he had made up his mind that he must die and he is ready for it No man can sav that I am a coward he said I will go to the gallows and die like a man I would as soon be hanged to credit there He was admitted to bail by Judge Beggs In 1000 and his trial as set for March 10th Held for Trial PETALUMA January 29 The preliminary examination of Harry Maynard a druggist for shooting Winnie Gossage near Fair Ranch Lake vllie on the night of December 12th was held to day Phelps themost important witness for the defense could not be found and Is supposed to be In San Francisco Maynard was held In bonds to appear for trial a i Drowned In the River SACRAMENTO January 29 A telephone message received to day from MonroevUle Glenn county announced the death of Doroto Sesenea assistant carpenter on the steamer Jacinto He had fallen into the river and was drowned He was a native of Mexico 40 years old and had lived in Sacramento A Prospectors Story HERMASILLO Mex1 January 20 A gold prospector who has arrived here reports that five of his companions who were captured by the Indians on Ti buron island were probably murdered He was also takes prisoner bat escaped Social oclock the first affair jf the day occurred between Braun editor ol the Record an afternoon journal and Phil Francis editor of a morning paper Last evening th Record contained an editorial tihich Francis deemed applied to himself although no names were mentiored The editorial was based on th rpor of the Grand Jury and referred in unsparing terms presumably to Francis A few months ago the Record contained an artlcl reflecting on Francis who hired a cab and went to Brauns home He knocked at the door and when Braun opened It and saw him he closed It In his face Francis went away threatening vengeance The trouble between Francis and Braun has apparently been smoldering When last evening Record appeared with the editorial mentioned It was thought trouble wa3 coming but the evening passed quietly and this morning the Penny Press Francis paper only contained jocular reference to the Records editorial This afternoon Braun was returning to his office from lunch and Francis met him Braun says Francis struck him with a cane and the menclinched Brauns thumb was bitten by his enemy and Francis received a blow in the face before they were separated They were arrested and heid In 100 ball each A little later Duncan McPherson editor of the Sentinel theoldeetjournal in the county and Wright an expert of the Grand Jury engaged in a fight on the sidewalk They were charged In the Justice Court with disturbing the peace and each furnished UOO ball The most serious difficulty occurred at 5 oclock this evening Editor Braun was standing In front of his office when Editor Francis struck him over the ear with a cane He was stunned but not seriously hurt Francis was arrested and held in 11000 bonds DIVORCE 11 BRITISH COLUMBIA A Question Whether the Conrts Have Jurisdiction VICTORIA January 23 An important question as to the jurisdiction of British Columbia courts to deal with divorce cases has been raised here Chief Justice Davie on the ground that the jurisdiction of the courts was uncertain in this respect refused to hear an application under the divorce act to day The Legislature In 1867 declared the English oivil and criminal laws existing in November 1838 In force here unless inapplicable from local circumstances Since then the Supreme Court of the province has dealt with divorce cases under the English divorce act The late Chief Justice Begbie considered the statute not applicable and that therefore the provincial court had no Jurisdiction in divorce cases The late Judge Gray and Judge Crease differed wtth this view and the Question has never been decided Now that a draft of the Consolidated Statutes has been laid before the present session or the Legislature Chief Justice Davie suggests that the question be referred for decision to the full court of the province SAPA STTDEATS PROTEST Vlarorous Objection to the Closing of the College NAPA January 29 The students of Napa College are so much aroused over the proposed closing of the Institution that immediately after chapel exercises this morning they requested the privilege of holding a mass meeting to consider the Question It was granted and recitations for one hour were Michael Foley was coming to California from New Tork on the Santa Fe overland and on the train In Illinois he became acquainted with Johnson Bridgman an elderly man who was also coming to California The latter was in poor health and alone He needed much attention along the route but none of the passengers gave any care to the Invalid except Foley who although a stranger was moved to pity Foley brought in his meals arranged his berth at night and helped to dress him in the morning In fact he rendered the sick man every attention and ness When they reached Los Angeles Bridgman took Foleys address and in the next two years wrote him several times once sending him a valuable Christmas present For the last three years Foley has not heard anything of Bridgman He had partially forgotten hint when he received official notice several weeks ago that Bridgman had died in Lowell Mass after years of illness and had left a large amount of property there also that Foley was the heir to 3000 cash a special bequest of the deceased because of kindness and poHteness shown Bridgman on his way to California Foley thought at first It was a practical Joke that some one was playing on hits but Instructed a Pasadena lawyer to look up the matter He Is a poor laboring man a bachelor about 40 years of age and has worked for the Puente Oil Company for several months He says he never had 300 at commit tee of ten engaged in securing riif of way for the Valley Road through Fresno county to day closed a deal for a tier of twenty flve lots In Blackstons Addition Just north of the city Negotiations for this purchase have been la progress two months but not until today was a final agreement reached This deal completes the right of way through the city from north to south with one or two exceptions where tie i owners of property refuse to name any price mat can ne entertained by the committee Condemnation suits vrfU be resorted to in these places The lots which have not been obtained are small and the refusal to sell the right of way acros them cannot delay matters There is now little to delay the building of the road from Madera county to this city as nearly all the rights of way have been secured From Fresno southward not so much has been done but citizens along the proposed lines to Visalia and Hanford have busied themselves securins the consent of landowners and when the committee is ready to turn Its attention in that direction it will find everything prepared The committee feels that the work which It undertook last summer is now drawing to a close and
