Into Collision The controversy OTer the sale of the partnership interest of the late William fuller in the well known firm of hit er Fuller Co assumed new and some wl at noTel features yesterday Two important questions that have never yet been passed upon by the courts of this State have suddenly loomed up before Judge Coffey One is as to the juns diction of the Probate Court in an action that has been enjoined by the civil court The other involves the validity of an agreement binding the heirs to sell a part nership interest without taking into ac count the value of the pood will of the buiness The partnership interest involved is valued by the executrix Mrs Fdller and bj the heirs under the will at 1 400 000 and the son of Mrs Fuller William Fuller Jr who is also a member of the firm of hittier I uller A Co has offere 1 to purchase the interest at that figure Bv the terms of the will the executrix is au thorized to sell or dispose ot the interns to the best advantage of the heirs The sale has already been made subject of course to the confirmation of the court A day or two ago this confirmation was asked for by Mrs Fulle and the heirs but owing to a minor irregu antv the heannjr of testimom in the matter was postponed until yesterdav mornins But Whittier the surviving senior paitner the fim objects the sale He makes a bid for the nterest of the late Mr Fuller offering to purchase it for 1 250 000 on unsecured note of hand He protests against the conrt confirm nz the sale to the younge Fuller for the larger sum of 1 400 000 and to support this protest and this claim during the last few vears An inspec tion of the returns previous to 1879 he said and for 19 and 1890 shows a nor mal annual increase of children between 5 and 17 years of from 500 to 1000 In 189 when the census was evidently a iraudulent one there was a sudden in crease over 188 of fi203 children For the next five years it was 924 but in 18S5 there was an abnormal ncrease ot 5971 in 1886 of 50 9 and in 18S7 of 4167 In 1886 the first returns were so glaringly fraudulent that the census was retaken and it fell from 78 246 to 59 713 a decrease of 18 53ck In 1889 tne increase was 920 and 1890 it was o0i The Superintendent with similar force discussed the census of private and parochial schools In IRSf the number reported was 92S9 and in 1890 jt was 8748 a decrease in four years of 541 pupils From statistical information which he deemed accurate the Superintendent declared that the number of pupils attending parochial schools in this city is 13 000 the number attending convent and Other church schools not less than 3000 and at least 1500 attending other pny ate schools making a grand total 01 17 50G The census returns show half that number rom the point of view of average daily attendance the decrease in the public schools in four years has been 831 The chiet cause is parochial school attendance and accurate figures are this vejr absolutely essential The following recommendations of the Superintendent were also adopted That th school medal dies be transferred from Fhiladelr hia to tne Board of Education that 50U pies of the revised rules of the Board of 1 xaminers and 1UO0 copies ot the official printed list of schools be printed and that the Committee on Classification be empowered to withdraw all feeble minded children from the schools A suggestion appropriated by the board to introduce such practice and instruction in the schools of the citv Joseph OTon nor principal of the Valencia street School gave a detailed description of the advantages of Heart Presentation Convent at Taylor and Ellis streets has filed a suit in the Superior Court against Margaret Agnes Me Dermott James Pbelan aamuel Blair and the Mutual Savings Bank The first named defendant Is the niece of the late Maria Far otherwise known as Maria McDermott who died on September 29 1839 leaving a codicil in her will as follows I give and bequeath to my niece Margaret Agnes McDrmott of the Presentation Con vent Taylor street San Francisco 2000 for the use of her community the sisters of said consent Messrs Fhelan and Blair are the executors named In the wilt On October 17 1890 the court ordered the executors to pay over the bequest to Margaret Agnes McDermott Again on January 14th last the court directed the executors to pay over the 2000 to the Mutual Savings Bank in the name of Margaret Agnes McDermott for the use of the plaintiff in this case the Presentation Convent Now it appears that after the will was ad mitted to probate and before the first order of the court directing the executors to pay over the bequest to the testator she ceased to be a member of th Presentation Convent and re moved to Madras India where she now resides Miss McDermott is therefore unable to receipt for the money now in the bank and the convent asks the court to appoint Mother Josephine of the convent or some other fit per son as uustee of the fond giving her power to receipt for the same that the convent may have the use of the money Gallic Dhodeens The customs authorities have been wrestling with pipes recently An importation of clay tobacco pipes was assessed at 70 per cent ad valorem as pipes not specially provided for The appellants in their protest to the Board of General Appraisers claimed that the pipes were dutiable as common pipes of clay at 3o per
