Secretary Tilghman notified Hney to secure the ad ditional bondsman but the young man either paid no serous attention to the re quest or was unable to comply with it A week ago the board issued a la Accused of the Harder of Boatswain Weston The British ship Yorktown arrived yesterday from New York after a most event ful passage The report which Captain Delap renders of the voyage is an interesting one After sailing from New York on the 14th fair winds prevailed to latitude 25 deg 5 mm Thence to latitude 45 deg 5 mm a continuous gale was experienced from the southwest accompanied by a heavy head sea It became impossible to carry any sail and the ship was almost buried in water all the time On July 1st a temfic gale sprang up lasting for seven teen days and to use the captains words trying its level best to wipe us out of existence Captain Delap notes in a mere line that during the gale the boatswain James Weston was lost overboard A boat was sent to his assistance and swamped There is a story told about this incident by John Czfr a sailor on the Yorktown who was interviewed yesterday He boldly stamped the supposed accidental drowning as a deliberate murder He stated that when the vessel was well out to sea the second mate began to chase the men and vented his brutality on the carpenter and the boatswain James Weston He told the latter that he would get even on him for some fancied wrong and tookeeryoc casion to beat him When the gale commenced on July 1st the second mate or dered eston over the side of the vessel to do some work The hrst mate heard the order and objected to it but the second officer forced Weston to the task There was a high ea running at the time and a hard gale Carr states that he saw the second mate deliberately let go the rope that held Weton A moment later the cry rang out Man overboard I Cap tarn Delap and the entire crew rushed to the side of the ship and saw Weston struggling in the huge wave3 A number of the men volunteered to lower a boat to his assistance second Mate Nolan objected and lowering a boat pretended to earch for Weston He picked up the tatters hat and returned to the ship and said that eston wa3 nowhere to be seen The few sailors who witnessed Nolan leftgo the rope were afraid to tell their stoo to the captain for tear that Nolan would kill thm and Delap remained in ignorance of the nornble crime Carr came ashore late yesterday afternoon and lodged a com plaint with the Lnited States Marshal against Nolan The gale that swept over the vessel con tinued with unabatingfury for many days The counties in this State valued in all at about toOO 000 She made the following bequests To each of her unmarried nieces 1000 to each of the following named persons 1000 Her sisters Ansana Ferrari and Guadalupe Gom and her sisters in law Rafaela Araya and Matilda Simpson de Gom to her daughter Eulogia Isabel wife of Enrique Edward now in alparaiso Chile 40 000 In regard to this last bequest the testator explains that it was made to carry out so far as she can in justice to her other chil dren a promise made years ago to Mrs Fdwards that sbe should be given the Carmelo rancho in Monterey countywhich at thai time was worth 40 COO the amount of the present bequest The money equivalent is now left instead of the ranch To her daughter Florence A Atherton she bequeaths all of her lurni
