Jndpe Hfbbard had appointed Mr lUey receiverand with an alarming temerity arrtereil the revenue officials to proceed and seize the tobacco cigars ana cigarettes which hud been awarded to Mrs Rosenthal as her share of the community property and which Mr Riley had been guarding The Internal revenue officers yesterday wooped down upon the place and being wholly lacking in appreciation of Mr Riley vigilance placed that officer of the court out upon the sidewalk during a heavy shower and Special Agent Gilchrist took charge in the name of the Government That this infringement upon the authority of the State arm of the Government will be resented there can te no doubt The rapidity of action on this line however was temporarily delayed by reason of the absence of Judge Hebbard from the city Swift reparation nevertheless has been demanded by Receiver Riley who appeared before Superior Judge Beawell yesterday afternoon qqd made complaint of his unceremoni 7 JUS removal He was authorized to commence forthwith an action against Revenue Collector Wei burn Deputy Collector Bert Thomas and United States Marshal Barry Baldwin to recover the sum of 20000 for alleged conversion of certain personal property alleged by said receiver to have been taken and earned way from said receiver and converted by said Welbura Thomas and Barry to their own use Mr Riley forthwith filed a complaint in an action for 20000 damages wib the County Clerk He graphically describes the pipes tobacco cigarettes tobacco cutter show cases and other fixtures contained in the plsce and all of a value of 10000 He then charges that the defendants in converting the property to their own use acted maliciously and to Mr Rileys damage in 10000 which together with the value of the goods makes up the total of 20000 which the receiver seeks to recover It is expected that Judge Hebbard will return early in the week when the clash of Federal and State authority will reverberate alone the vaulted carridors of the new City Hall In the meantime Mr Rilev is out of job and proposes to make the Federal authorities pay for it ABOUND HOLLY PARK Fire Protection Is Demanded by tbe Taxpayer The Holly Park and Mission street Improvement Club at a meeting last night appointed a conmittee of three to go before the Supervisors and ask for fire protection for the district south of Thirtieth street From that point to the county line hero is not a single piece of fire apparatus and hydrants are also few in number The nearest engine company is at Twenty sixth street and it is expected to cover over two square miles of territory Rickard Reiehenbach Thomas ONeill and Becherer were named as the committee The atention of the Street Department will be called to the impassable condition of Mission street From Thirtieth street to Silver avenue the railroad company has neglected to keep Its portion of the roadway in repair The rails are from two to four inches above the macadam roadway and are a menace to the lives and property of teamsters A resolution was adopted protesting against the order limiting the speed of cable and electric cars during certain periods to six miles an hour The club favored an increase to twelve miles and expressed the opinion that the growth of the city would be retarded if tbe speed of the trolley cars were limitedwo horse car lime Rapid transit for the suburban Supervisors It was announced that the Street Superintendent had promised to have an outlet for th Ejizabeth street sewer in twenty one days STOCK IN DISPUTE LEGAL CONTEST LASTING YEARS FOR Bank of California Stock in Litigation iu an Oakland Court Governor Budd Gives His Viewa Has a Chat With the Harbor Commissioners Tbe Executive Wants the Architects Condnct Investigated There has been a legal battle the courts for more than ten years over the ownership of 120 shares of the capital stock of the Bank of California The contest has been waxing warm with Nat Brittain tbe capitalist on one side and the Oakland Bant of Savings on tbe other Tbe contest was submitted to a jury in Oakland at 4 oclock yesterday afternoon after a trial lasting over a month Last evening the jury had Been out six hours and they had not agreed on a verdict The battle grew out of the famous failure of Arthnr Bowman who is now dad He was one of Brittainsintimate friends and they had a number of transactions together In 1881 Bowman was in his prime as a banker He borrowed money from the OasJand Bank of Savings at 5 per cent and loaned it out at 7 per cent As he was a director of the bonk he had no trouble in getting money on securities and hisoverdraftat one time went as high as 240000 Brittain wanted to get in and make tome money so he indorsed in blank 120 shares of stock of the Bank of California to Bowman who promptly put it up with the Oakland bank nnd drew down some money Brittain got his money which he now declares he paid back to Bowman Heasseris that he did not owe the latter a cent When Bowman went down with the great financial crash in 1884 his friend Brittain commenced to look around for his stock He found ttiat the Oakland Bank of Savings had the stock turned over to its credit as security for a portion of Bowmans overdraft Brittain declared that it was his stock but tbe bant would hot give it up owing to the fact that it had no notice that Brittain had anytime to do with the stock when it was pat up as security tor Bowmans overdraft During all these years the legal battle has been raging over the stock and the question is still far from being settled No matter what is done in the Superior Court an appeal is sure to be taken to the Supreme Court by tbe defeated party Arthur Bowmans dealings with the bank were fully explained during the trial of the case He had enormous resources and was a man who could command thousands of dollars in cash at a moments notice His 240OOJ overdraft on tbe hank was reduced to 43000 up to the time he failed Tbis sum was fully in tbe sum of 20000 and he is trying in some way to pull out even Architect A Page Browns alleged neglect of duty in connection with the construction of tbe new ferry depot was the subject of an informal discussion between Governor Budd tbe Harbor Commissioners and Attorney Fred Stratton yesterday afternoon Tbe Governors tone indicated from tbe start that he believed with Commissioner Colnon that Brown has deliberately violated that portion of his contract which requires that he shall at all times supervise the work at the foot of Market street and shall report progress to tbe Board The Governor said that tbis clause was indisputable but he was not altogether pleased with a succeeding clause which sets forth that the architect is subject to the orders of Chief Engineer Holmes This he intimated gave Brown an opportunity to shift tbe responsibility of watching the work on the depot upon Holmes The Governor expressed the wish that the legal aspect of tbe case be gone into thoroughly with a view ascertaining whether or not Brown can be removed from office and bis contract annulled Attorney Stratton pleaded for Brown arguing that all precedents showed that the chief eneineer and not the architect of the Board was the proper official to supervise all work being dtfne under the authority of the Harbor Commissioners Even though Browns contract required him to oversee the work it was the duty of tbe chief engineer to direct the architect the lawyer argued The chief engineer bad been directing affairs at the ferry ever since the work had been commenced and there was no necessity for Browns attendance Mr Stratton said be did not think that Browns absence amounted to a violation of his contract After some further discussion the subject was dropped and Governor Budd ex Eloded what he thought was a little ombshell He declared that since examining the plans and specifications for the new building he baa aiscovered that the 600000 voted by the people to erect the depot would not pay for the structure the Harbor Commissioners were building According to the estimates submitted to him the foundations alone would cost 250000 The building would cost 500 000 and allowing 50000 for interior fittings and incidentals the total cost would amount to 00000 He did not understand how the Commissioners could have made such a blunder knowing as they did that they were limited by law in the matter Mr Stratton came to the rescue once more He was the attorney for the Board when the depot was planned and knew all about the estimates He informed tbe Governor in a very few minutes that the Harbor Commissioners have not as yet touched a cent ol tbe 600000 The thousands which have been paid out for the foundations came from the harbor improvement fund The Commissioners had shown themselves to be clever financiers Mr Stratton intimated by saving the 600000 for an elaborate superstructure In looking over the law they had found that ferry approaches could be built with the money in the improvement fund It was decided that the foundations for the new ferry coald be called approaches to serve the purpose intended and with that understanding the improvement fund has been drawn upon ever since Governor Budd subsided after the deep and dark plot had been unfolded He did not look altogether delighted however and said something about beating the devil around the
