to Be His Daughter and Wants His For tone The mystery surrounding the life of James Duncan who died In this city in February 1883 will it is believed be cleared away by a little woman now living on one of the most secluded streets in Oakland James Duncan was a Scotchman and at the time of his death was about 65 years old He came to California in 185 1 and for many rears drifted about with the floataam and jetsam of the mining camps Early in the sixties he came to San Francisco and opened a tannery I which he stated had becnbi business while living in New Jersey at ewarJc he said For many sister living at Ayrshire Scotland and to another a former partner named HeeUt he said that he had been married He furnished no details and the subject was never discussed He went to Scotland on a visit In 1871 and this was it is claimed the only time he left the State after bis arrival in 1831 When he died in 1888 be left a fortune of more than toOOOO which after the debts are paid will amount Minnie Doncan Jensen She says she was born at Newark 1857 and that James Duncan was her father When very young she says she was taken to Indianapolis Ind by her grandmother and upon the tatters death a few weeks later was adopted by a family named Jensen When 20 years Of age she married one of the sons and a month after the wedding her husband was killed by an explosion She then came west and being a skilled needle worker followed that occupation in several cities In November 1887 she came to San Francisco and while en route met James Duncan in the manner described After living for a year in Oakland and Santa Rosa she settled permanently at the first named place She knew nothing of James Duncans deaUfnorof his history until March 1st when she picked up the Chbokicis and read a dispatch from Newark describing the efforts to find the htlrs of James Duncan who died here Then she wrote to Lawyer Oscar Cbuck of this city and the Inquiries resulting from subsequent consultations developed a remarkable chain of circumstantial nroof in support of her aim as being the heiress of Janes xuncan Tn 1856vr thereabout the says her lather returned Newark from the West and married her mother who was a German woman Her mother died when she was very young and she was taken care of by her grandmother Before her grandmothers death she frequently beard of her fathers family of the sister in Scotland and from friends in New Jersey learned that her father visited Newark several times after her birth Duncans sister was found and the estate was about to be distributed when the new claimant appeared and gave notice of contest The matter was called to the attention of the Probate Court by Attorney Shuck and further proceedings were deferred to admit any evidence produced by the new claimant Attorney Shuck has obtained information that Duncan before his death told Mr Hecht that he had been married to ta German woman at Newark and the attorneys theory is that while floating about the gold aig pinn Duncan made a strike went hack East married and then left There Is no record of his movements during that period and this theory appears reasonable On the other hand Duncans friends at Newark say that ne was never married and no record uf such marriage can be found There is one witness supposed to be In New Orleans who it is expected will furnish the desired Information This is a man named Warren who was at one time a partner of Duncans in the tannery business Warren left here somo years ago arid went to Boston end from there to New Orleans wbere bets said to be employed in the Government service As soon Is be is iteard from Mrs Jensen who is meanwhile earning her living as an humble seamstress in Oakland will begin the contest for Duncans estate The Ex Supervisor Charged With Cruelty Mrs Kortoa Gets the Community Property The most popular theme of conver sation about the new City Hall yesterday was the divorce awarded Mrs Harriet A Morton from ex Supernsor Sargent Morton by Judge Levy of Department 10 of the Superior Court Under ordinary circumstances the case would not have attracted so much attention as it did but both Attorneys Van Shalck and A Bath who represented respectively the plaintiff and defendant wanted tne matter Kept secret and as Is customary in such instances attracted special attention to it The divorce was granted secretly and the papers sealed and put into the time lock safe in the County Clerks office he proceedings were Instituted on June 7th and in her petition Mrs Morton alleged several acts of cruelty on the part ot the defendant extending over a number of years An amended complaint alleging further causes for action was filed and AirCMorton answered both with a general denial of the allegations and the case was turned over to a referee to take testimony The testimony was handed in to Judge Levy on inursaay ana wnen the attorneys called at his chambers vesterdav the decree was slimed and the case ordered closed Bv the terms of the decree Mrs Morton gets all the community property which is valued at SbxOOO Sir Morton has a partnership interest in the Morton Warehouse Company amounting to about S50000 but it is individual property and was not claimed by Mrs Morton The decree ends a married life of nearly thirty years and while Mr Morton was charged with cruelty it is understood that the charge was not based on any overt act but resulted from incompatibility There are two children living both of whom have attained their majority Quarantine Officer Lawlor and ex Quarantine Officer McAllister had Hospital so that one end will be in one room and the other in another To better facilitate the handling of bedding and clothing a little car resting on a miniature track has been made to run into the Johnson on complaint of Charles Swift an attorney The document sets forth that at the last general election Bingham was not legally elected Supervisor of the First ward for the reason that he was no resident of that ward within three months prior to the election as re quired by law that he is not now a resident or qualified elector of the First ward ot this city that since the 7th of January 1889 he has usurped intruded and unlawfully held and exercised the said office of Supervisor The complainant prays the Court that Henry Bingham be excluded from the office that he pay costs of action that a fine of 5000 be imposed upon him and that the office be declared vacant Presiding Judge Levy has assigned the case to Judge Lawler for trial Horace Fhilbrook attorney for the relator asked that the case be assigned i to another judge dui ior reasons best known to Judge Levy the request was not complied with Papers were served upon Bingham on his arrival at the new City Hall during the day
