Police Court for preliminary examination yesterday morning Mrs Hethenngton and her son Harry Clark sat side by side next their counsel Poote appeared as special counsel for the prosecution while Fire Marshal Towe who unraveled the curious web of circumstances in which the fire at 703 Fulton street on April 6th was enshrouded occupied a chair on his right Mrs Hethenngton was dressed in black the only xehef from the somber hue of her apparel being an old fashioned cameo brooch the white figure of which stood out in relief on a pink ground Her silver gray hair was but partially con cealed by a thin veil and from behind thisnunsy concealment her keen gray eyes seemed to never change their eager glance from the witness on the stand The son sat in a dumb stolid sort of way his thin sallow features being de void of character but full of cunning In the front row of spectators was a gray bearded man who followed every movement of the Drosecution with an eager interest which he showed by fre quently leaning forward to speat to the attorney for the prisoner He Was Clark the womans divorced husband who is now a hotel keerjer at Nevada He it is said is her only nend in her present issued a rjolicv to Mrs Clark for 2000 of which 1750 was for fur niture and szau lor wearing apparel She Said 16 premium and signed the name Clark At the tune Mrs Clark took out the policy she said she already had some property at the house 70S Fulton street and expected 4000 or 5000 worth more from Los Aneeles She inquired How do you know in case of a fire that all the furniture represented to be in a house is burned up The witness re plied We have a way of finding out After the fire Mrs Clark compromised her ciaim oy accepting tne return 01 tne 10 oremium oaid bv her Joseph Wood who lives at 70SKTul ton street over the premises where the nrr occurred said tnat on tne night ot ilia Knmini ha wo in lia drtrian Alvkn 9 oclock be heard something fall and went out on his porch to see what it was He smelt smoke and coal oil and through the window saw the light of flames Wit nessimmediatelyran around the corner to the engine houe on McAllister street and turned in a still alarm The door to the house in which the fire occurred was opened by a young man Young Clark the defendent was asked to stand up and witness said he was not the man who opened the door Charles Mayheld a clerk in the real estate office of Christiansen 303 Sixteenth street took the stand with the daybook of the firm in his hand By the aid of this he testified that young Clark was in the office on April 10th and gave the nameot Hethenngton Defendant said he wanted to rent a houe or a cottage and finally selected one at 15 Dearborn street paying 5 deposit Sam Bendit the furniture dealer explained how he had appraised the furniture at 703 Fulton street at 93 50 It was the same furniture that had been insured for 1750 James Hawkes son of the owner of the house in which the fire occurred identified the defendants as the parties who had occupied the place He testified that he was in a saloon on the corner of Buchanan and Fulton streets at the time it became known there was a fire at 70S which was only about sixty feet away About this time young Clark came in and was drinking a glass of beer There were several other persons in the saloon and as the engine passed they all rushed outexcept young Clark Witness could not open the door of the house and finally got the key from Clark On cross examination Mr Hawkes said after he failed to get into the house he ran back to the saloon to find Clark The latter was not there and he finally found him on the street near the house and got the key from him Clark did not go into the house Witness saw portions of lamt on the floor and smelt coal oil on the floor and on a lounge also saw bunches of oil soaked and cartlallv burned matches The flames were confined prin cipally to a large nox oi straw and rubbish This was carried out by the fire men ONeil who acted watchman for Fire Marshal Towe said that he took charge of the place about 9 30 oclock or a half hour after the fire A lamp and some nartlv burned matches were on the floor while the burner of the lamp was on an old bureau Witness identified the burner The next morning at about 10 SO oclock Mrs Clark came to the house and said she would go over to Oakland and get her policy of insurance In about an hour she returned and said she had given her key to some one else to go and get the policy Mr ONeil said that before he took charge of the premises the firemen were in charge The glass part of the lamp was in the center of the floor while the brass rim of the body of the lamp was over near the fireplace The burner which had been sere wed from the run was on the bureau There was coal Oil scattered About in the parlor and kitchen Foote for the prosecution sub mitted their case while counsel for the defense answered that they would introduce no testimony Judge Campbell found that the crime of arson had been committed and that there was every reason to believe thatit had been committed by the defendants although in his opinion the evidence was not as strong against the man as the woman He accordingly held them for trial before the Snpenor Court with bail fixed at 3000 in each case marriages SLOCUM HOWABD In thfs city April 89 by Slocum to Be METPCCSr KEKCHEVAIr
