pending the trial of her suit for divorce against her husband Herman Liebes The affidavit primarily recites that several weeks ago Mrs Liebes on account of her husband cruel treatment was compelled to leave their home at 1714 Van Ness avenue and take up her residence at the Ialaca Hotel She Was accompanied by three of her children two daughters and a son Their monthly expenses at the hotel are stated to have been 1200 a month and their other expenses 300 Mrs liebes complains however that at the hotel she lacks many accustomed comforts and for that reason sb desires io return to her home pending the trial of be suit moreover she oners to ao son guaranteed that she will not be interfered wah nor molested by her husband Mrs Liebes further states that while the expenses of the household have heretofore been about 25000 per annum she will agree now If restored io possession of the home to get along on 1000 a month Comment isroade on an advertisement in the daily pipers stating that Liebes petition is that she shall be allowed 1500 a month alimony 10000 for counsel fees and 1000 for counsel lees pending the trial or the action and that the defendant shall te compelled to pay all County Attorney Durst Two Hundred and Fifty Thousand Dollars for Piftyfonr Acres Hammond Jr filed with City and County Attorney Durst yesterday a report as to the value to the city of the 5103 acres of land in the City Cemetery now sought to be condemned by the United States Government for fortification purposes After referring to the advantages to the city from a commercial point of vlew that would be gained by the maintenance of proper defenses the report continues i The actual valueof thelanb from a real estate point of view Is of course more or less problematic The blocks of land in the immediate vicinity of the City Ceme tery are 600x210 feet in size having CO building lots which may be valued at from 300 to 500 each depending upon the advantage of their situation and local The Government seeks to condemn the southwest portion of the 200 acres com prised In the cemetery tract Had It sought to condemn utilize and beantify the eastern port ion of this tracts converting the present cemetery into a Government reserve the city rgight then be benefited by the enhanced value of the remainder of the tract In brief the Government does not seek to condemn the entire tract of land thus removing the cemetery which I so detrimental to the growth and progress of the city in that district but it selects the extreme southwest 103 acres which commands a superb view has a beautiful slope and hss an unquestionable market value It may be urged that the land immediately surrounding the proposed fortifications will be greatly enhanced value by the construction of the same The fifty acres or more of the cemetery lying immediately north of the forti ficasions between it and the ocean will of course be under any projectile from the tortincattons ana wtu not De very attractive to the investor or home seeker The constrdction of the fortification i of course beneficial in itself io us but aside from this argument this case is presented The city owns a certain iract of land and the Government desires 5403 acres of it The city is compelled to dispose of it at such amount as may nxea oy me juage or larvand sliOL the eitv is not desirous of securing from the Government a single fiouarmore man in justice to its cimeus should be paid into the public funds Looking at it as a marketable tract of land its many advantages can hardly be overestimated its shape makes it ex ceedingiy available for subivision into blocks or tots The extension of California street throughthe tract to the west end Forty first Forty second Forty third Forty fourth Forty fifUv Forty sixth And Forty seventh avenues to the north would subdivide the tract into eight full blocks 240x600 feet and eight half blocks 210x300 feet except a small fraction off the northwesterly portion of the most westerly half block The property adjoining this tract is held by parties who retuse to put a price npon It and therefore I know ot no sales Of blocks contiguous to it to quote The following information is furnished however as an indication Ot what Owners of property in the near vicinity consider their blocks worth Block 213 between Point Lobos avenue and A street Forty first snd Forty second avenues is offered at 35000 The owner tells me he has refused 27600 for it The block on the north line of Lake street between Twenty fourth and Twenty fifth avenues is for sale at 30000 and I am told 28000 has been offered and refused Block 211 between Thirtieths and Thirtynrst avenues Point Lobos avenue and Clement street is for sale at 27000 I understand that the present owner paid 21000 for it in April last I do not consider this block as eligibly situated as the City Cemetery property It is on comparatively low ground and does not Command any view In conclusion I think that a very conservative estimate of the Value of this 5403 acre tract would be 250000 This would be at the rate of 15000 a block for blocks north of CaIUornia street and the block east of Forty fl rat avenue south of that street and 25000 each lor the remaining blocks or in round figures 4600 an acre for the tract as a whole The other two appraisers are Boger Magee and if A Cobb They have made no written report but it is stated that their estimates are very close to Mr Hammonds When the condemnation proceedings came up in the United States Circuit Court yesterday Judge iHawley granted Exercises The Christmas holidays sii far as the little people of the kindergartens are concerned have come in earnest and festivals all over town are the order ot the day The opening festivities of
