of Office Brigaditrs and Colonels Will Confer With Governor Budd To Day Oonrnor Budd has invited all the Gen trals and Colonels in the National Guard to meet bim at 6cramen to to day to assist him in figuring oat where they are at Considerable controversy bas arisen retarding tbe operation of be military bill passed at tbe last sesion of the Legislature and six Brigadiers are anxious to tind oat whether tbey have tbe rigb to sport tbe uniforms and insignia of tbeir offices end it they bare not who bas Then there are various Colonels Captains and Llentenants who bare been sittine up at night recently stud in the creat problem presented in tbe military fall Tliey want to know if their regiments and companies are now enjoying a legal existence and if not when and how tbe panoplv of tbe law will be thrown upon them Tbe Tarioni conundrums presented by tbe new law were called to tbe attention of the Gorernor but alter studying them for two alternoons he threw up tbe job in disf uit and he determiued to let the military gentlemen work out their own salvation It was the Governors Inten tion to Tlstt this city to day to confer with the leading officers of tbe guard upon the operation of the new law but other busi ness held li tit Sacramento Colonel Murray who is acting as Vdjutant Gen eral at the Gorernor order tbeielore notified the Generals and Colonels to meet with lbe Bosrd of Location at tbe Co itol to day The idea of the reorganization of tne National Guard had it inception in the National Guard Officers Association That bod which is composed of all the actire and retired officers of the btate forces held a meeting in this city short time before the meeting of the Legisla ture and prepared a bill providing that the guard should be organized into four brigades instead of sis as at present it was also proposed bv some or the rad cal reformers that the law should be amended to the effect that all general officers should be elected instead of being appointed by the Governor This proposition however was knocked oat for those acquainted vith the modern methods of runtime a State were aware that the Governor might oppose such an amendment as it wonld deprive him of certain pre ogatives and just so mnch patronace When the committee of the officers associat on with the bill in charge went to Sacramento they found there a number of gentlemen who had their own ideas about the manner in which the National Guard shouli be or ganized Among these was 1 rank Pow era the silent Oanged haired vouth from tbe Western Addition wbo proposed to knock oat five Brigadiers and tbe Major General and organize the Guard in one brigade There were also others The committee found it necessary to amend its bill to meet tbe approval of tbe Sacra tnento generals and several important changes were made The original bill indorsed by the association and introduced in the Assembly by tbe Committee on Military Affairs provided that it should tnke effect on July 1895 This date was fixed so that the changes provided should not take effect until tbe end of the hscal year As it was agreed on all sides that the number of brigades should be reduced the exten sion of time to July 1st would give ample opportunity to tbe Governor to make the new assignments for the new organua tion When the military bill was passed and approved by tbe Governor it was the general opinion in this city among thoe officers who had not followed the matter closely that the original time limnntion bad not been changed in the law This is a mistaken idea however for tbe bill approved by the Governor has for its last clause this sentence Thu act shall take effect Immediately Now the problems commence to arise The new law amends section 1912 of tbe Political Code to read js follows 6ecUon 1912 The organized uniformed militia of tbe Slate of California are known as tbe National Guard of the State of California This force shall not exceed 8lxU nine com fianies of which sixty companies shall be in antrv or artillery as the Board of Location may direct and fie companies of the Nmal Battalion and tbe other four companies shall be distributed to uch arms of the service is the Board of Location may direct The National Guard must be located throughout tbe State with reference to the military want thereof means of concentration and other military requirements Tbe section quoted is now tbe law In stead Of sutv companies of infantry or sr tillery there are sixty rive inth guard The questions the military men want settled are whether the sixtj fie com panies are legally in existence if they are not what positions will tbe colonels and brigadiers hold to ilay at Sacramento if they are not officers of the National Guard If only slii companies hare a legal existence what companies are tbey wbo shall determine them and what be cornea of the other five companies9 The five companies of the Naval Battalion are specified by tbe law as being a portion of the National Guard so that there is no donbt of tbeir status The Naval Battalion ia always on top It bas better uniforms better equipments and better rifles than the other organza tlous and now it is saved from confusion by the hand of the law The I Irst Troop Cavalry is also assured of existence but the condition of ail the other companies in the service is very badly mixed In fact a lawyer who had read the law said yesterday that tbe only members of the Rational Guard whose status is now as sured are the Governor and his staff the Major General and staff the Naval Bat talion and tbe cavalry Tbe others are lost in tbe meshes of the law Tbe Con troller of btate has looked into the matter and has agreed to draw warrants for the first quarter of the ear for all the companies which were in the Guard before tbe bill was passed As tbe Governor signed the bill on March 24th tne companies will get tbeir allowances for seven days more than some lawyers tbink tbev are entitled in the presentcondition of artairs The Controller is now awaiting action and advice before determining on the issu ance of warrants for tbe second qutrter of the year The other important clause in the new law reads aa follows Sec 2003 The National Guard of the Kate of California is hereby organised into three brigades each commanded by a Brigadier General lbe limits of each brigade to be fixed by the Commander in Chief Brigadier Gen erala and their staffs deprtred of their office by reason of the reorganization hereby provided for are hereby placed on tbe retired list with tbeir rank Tbe Commander in Chief bas not yet fixed the limits of tbe three new brigades and tbe alx old brigades continue in run nine order Asa matter of fact and law there are only three brigades in tbe National Uuard to day wheMYerthey may be located though there are six brigadier generals It can hardly be said that any of he fcrvadiera hare been deprived of tl fr offlews by reason of the reoreanua tio presided for in tbe new lav for that reorganization hat not yet been effected One of the chief objects of the conference which is to take place at Sacramento to aay will be the location of the three new brigade Another point raised is that the new lav will deprireall the briradiera of office for as tbey vera appointed with tbe consent of the fcenate to command certain official districts it ia held by some that a law which changes the dis rict likewise ends the appointment and the commander of tbe new district wonld baveto be an original appointment As far aa the Second Brigade is concerned it Is thought that no change in lis territory will be made with the possible addition bf Humboldt The First Br gade will take in the southern section of the State with headquarter at Los Angeles and bacra inento will be the headquarter of the Third Brigade which will include Northern and Central alifornia The suggestion which will doubtless be followed for the elimination of the superfluous com panies will be that all companies shall be subjected to a rigorous inspection 1 heir lives will depend upon the reports of these inspections and it will thns be a case of the survival of the finest The annual inspections have not vet been held tbe orders issued for them having been countermanded to await a decision by the Governor regarding tbe manner in which ne will locate tLe three brigades This de cision will probably be made to day or during tbe wees It being conceded that tbe autonomy of this bnede will not be broken the ocal guardsmen are anxiously awaiting tbe appointment of a successor to General Dickinson According to present reports the officers of the brigade think he will be reappointed Major General Pirnond now has no prominent rial for his office and is said to be also certain of reappoint ment The delay in the official announcement of the Governor choice fo Ad juiant General is accounted for to some extent by the fall from grace of benator Seymour That gentleman supported Major Driffel of romona and it was eiven out
