The state parole board determines the actual length of a sentence. The new measure "lets the judge at the time of sentencing lay out exactly what the punishment is, so the people, the district attorney, the public defender and the offender all know what the cost of the crime is," Brown said. The law, which was opposed by the American Civil Liberties Union and the Prisoners Union, retains indeterminate sentences for some crimes, such as first-degree murder.

JUDGES WILL BE required to pick one of three fixed sentences for other offenses, such as two, three or four years. When indeterminate sentences were introduced in California, the system was viewed as a reform, granting more flexibility and taking into account the effects of rehabilitation. But in practice, critics argued, the uncertainty of indeterminate terms had a negative impact on prisons. "Today the whole system of criminal justice is somewhat fraudulent," Brown said. "When you give someone one-to-life, the people think he's getting a life sentence.
