Proponents of the phase-out say the tax deprives the state of retired executives whose years of business leadership could be used for civic service in their reti-ement years. Some legislators advocate replacing the inheritance, estate and gift taxes with a gap tax. It involves a formula to make the state levy equal to the maximum credit allowed on federal taxes. "Small- and medium-sized estates would receive the greatest benefit," says an analysis prepared for Sen.

MILWAUKEE (AP) Forty-nine percent of wealthy businessmen planning to retire outside Wisconsin are moving because of the state's inheritance taxes, a survey indicates. Wisconsin's inheritance tax is often blamed by tax-reformers for persuading wealthy retired persons to move to other states where the taxes aren't as burdensome on the relatives who inherit their property. The Milwaukee Sentinel said that a September telephone survey 'of about 800 persons showed about 45 percent of business executives had plans to retire out of state. Of that group, it reported, 49 percent said the inheritance tax was one of the reasons for leaving.

By comparison, about 22 percent of the 600 general-public respondents reported plans to move out of state, and fewer than a fourth of them cited the inheritance tax as a reason. The survey included 58 legislators, only three of whom said they will retire outside the state. When several members of the Legislature asked Gov. Anthony S. Earl to draw up an agenda for reviewing the state's economic climate this month, he objected to having legislators act on anything that would cut tax revenue.
