PAGE 10A NEWS, THURSDAY, AUGUST 2, 1990 Obituaries- Mims Mitchell of Magee was in charge of the arrangements. Luther Hays Sullivan Services were held for Mr. Luther Hays Sullivan, 83 years old, Sunday, July 29, 1990, 3 p.m. from Popular Springs Baptist Church, with Rev. Howard Benton officiating.

Interment in Poplar Springs Cemetery with Masonic Graveside Rites. Mr. Sullivan died Friday, July 27, 1990 at his residence. He was member of Mendenhall Masonic Lodge and Shriner. Survivors include four daughters, Wilma Kennedy of Pearl, Lucille Stewart of Escatawpa, Dorothy Nell Slay of Amarillo, Texas and Virginia Runnels of Jackson, son, Ray Layton of Mendenhall, three brothers, Robert Sullivan of Mendenhall, R.

T. Sullivan of Mendenhall and Albert Jack Sullivan of Mendenhall, sister, Eula Palmer of D'Lo, seven grandchildren and six great grandchildren. Upton Funeral Home of Mendenhall was charge of the arrangements. Claude Tebo, Jr. Services were held for Mr.

Claude Tebo, 62 years old, July 30, 1990, 2 p.m. from Mims Mitchell Funeral Home Chapel, with Rev. John Coleman and Rev. Charles Ray Burnham officiating. Interment was in Calvary Presbyterian cemetery.

Mr. Tebo died Saturday, July 28, 1990 at the A Hosptial in Jackson. Survivors include his wife, Mrs. Christine Tebo of Mendenhall, four sons, Mike Tebo of Florence, Dicky Tebo of Magee, Ricky Tebo of Jackson and Steve Tebo of Puckett, four brothers, James Tebo of Magee, Thurman Tebo of Magee, Herman Ray Tebo of Magee and Earl Tebo of Houston, Texas, three sisters, Mrs. Merle Ainsworth of Houston, Texas, Mrs.

Charlene Tanner of Pearl and Mrs. Katherine Harmon of Canton, his mother, Mrs. Lula Tebo of Mize and eight grandchildren. Mims Mitchell of Magee was in charge of the arrangements. Infant John Preston Knight, Jr.

Services were held for Infant John Preston Knight, Tuesday, July 31, 1990 from the Oak Grove Cemetery with Rev. William Wright officiating. Interment in Oak Grove Cemetery. Infant Knight was still born at Covington County Hospital in Collins. Survivors include his parents, John and Frankie Denise Knight of Mendenhall, Maternal grandparents, Mr.

Friday, July 27, 1990 Colonial Chapel Magee Interment, Stonewall Baptist Church Hudson, both of Mendenhall, paternal grandparents, Mrs. Brenda Faye Sauls of Utica and Mr. Jack Blackstock of Hawaii and a host of relatives and friends. Maternal great grandmother is Mrs. Buford Barnes of Mendenhall.

Paternal great grandparents are Mr. and Mrs. John R. Knight of Utica. Mims Mitchell of Magee was in charge of the arrangements.

Sammy Lee Tullos Services were held for Mr. Sammy Tullos, 48 years old, of Mendenhall, Wednesday, August 1, 1990, 2:00 p.m., from Athens Baptist Church, with Rev. John Coleman officiating. Interment was in Athens Cemetery, Mendenhall. Mr.

Tullos died Monday, July 30, 1990, at his residence. Survivors include his wife, Mrs. Beulah Tullos of Mendenhall, two daughters, Pamela Susanne Tullos of Magee and Penny Gail Tullos of Magee, two step-sons, Benny Davis of Suntag and Bruce Davis of Suntag, two stepdaughters, Marie McWilliams of Suntag and Patricia Ann Grimes of Silver Creek, and four stepgrandchildren. Colonial Chapel Funeral Home of Mendenhall was in charge of the arrangements. O'Dell Cole Brown Services were held for Mrs.

O'Dell Cole Brown, 53 years old, of Mendenhall, Friday, July 27, 1990, 10:00 a.m., from Stonewall Baptist Church, with Rev. Bob Jones officiating. Interment was in church cemetery, Mendenhall. Mrs. Brown died Wednesday, July 25, 1990 at Magee General Hospital.

Survivors include her husband, Charles Samuel Brown of Mendenhall, two sons, Charles Michael Brown of New Orleans, Louisiana, and Donald Leon Brown of New Orleans, Louisiana, one brother, Earl Cole of New Orleans, Louisiana, two sisters, Willie Lee Sullivan of Mt. Olive and Verna Lou Craft of Pearl, one granddaughter. Mrs. Brown was preceded in death by her son, Donald Ance Brown. She was a member of Stonewall Baptist Church.

Monday, July 30, 1990 Mims Mitchell Magee Interment, Calvary Presbyterian Cemetery Pernell Berry Services, 4:00 p.m. Saturday, July 28, 1990 Mims Mitchell Magee Interment, Mendenhall Cemetery MIMS-MITCHELL Funeral Homes, Inc. Magee, Mendenhall, Mt. Olive, Raleigh the sum of $1,180,000 from the said Farmers Home Administration for the construction and expansion of said water system. That said construction and expansion as financed by the Farmers Home Administration has now been completed, and that the City of Magee, Mississippi, under said bond and contract with the Farmers Home Administration was required to make certain monthly payments, set aside certain funds for repairs and maintenance of said system and the upkeep thereof, and other contingent funds necessary for the support and maintenance of said system.

SECTION 3. That the City of Magee, Mississippi, prior hereto, and during the year 1990, applied for and received a loan from the Farmers Home Administration for the construction and expansion of the water systern of the City of Magee, Mississippi. That the City of Magee, Mississippi, borrowed the sum of $1,022,000.00 from the said Farmers Home Administration for the construction and expansion of said water system. That said construction and expansion as financed by the Farmers Home Administration has now been substantially completed, and that the City of Magee, Mississippi, under said bond and contract with the Farmers Home Administration was required to make certain monthly payments, set aside certain funds for repairs and maintenance of said system and the upkeep thereof, and other contingent funds necessary for the support and maintenance of said system. SECTION 4.

That the Mayor and Board of Aldermen officially find and adjudicate that the rate schedule to now be adopted has been thoroughly studied and examined, and the Mayor and Board of Aldermen are convinced and hereby officially find and adjudicate that it is necessary and appropriate to adopt new water and sewerage rates, and do hereby continue the operation of the waterworks system and the sewer system as a single system which shall be known as the Waterworks and Sewer System and which is also in compliance with and in accordance with the request and requirements of the aforesaid two federal agencies. Thus, the Mayor and Board of Aldermen further officially find and adjudicate that it would be in the best interest of the City of Mages, Mississippi, and the citizens thereof, for said waterworks and sewer system to remain combined and operate as a single system to be known as Waterworks and Sewer System and for the sewer and water rates as hereinafter set forth to be adopted. The Mayor and board of Aldermen further find that the present rates being charged for water and sewerage services are inadequate to meet the cost and expenses of operating said water and sewerage system and paying the monthly payments due under said bond issues to the federal government acting through the Housing and Home Finance Agercy (HUD) and the Farmers nome Administration. That the City of Magee, Mississippi, is under a binding and contractual agreement to charge such rates as would properly finance and maintain said water and sewerage system and pay and discharge the two aforementioned bond issues. That since the present rates are not meeting these obligations, that the Mayor and Board of Aldermen have no alternative but to raise said water and sewerage rates sufficiently to maintain said system and meet the obligations of the band issucs aforementioned.

SECTION 5. That commencing with billing of water and sewerage rates for the month of September, 1990, that said rates shall be as follows, to-wit: 1. WATER: RESIDENTIAL SIZE SERVICE First 3,000 gallons $8.00 Minimum Next 5,000 gallons $1.25 per 1,000 gallons; Next 5,000 gallons $1.00 per 1,000 gallons; All over 13,000 gallons .75 per 1,000 gallons 2. WATER: OTHER THAN RESIDENTIAL SIZE SERVICE First 3,000 gallons $15.00 Minimum Next 5,000 gallons 1.50 per 1,000 gallons; Next 5,000 gallons 1.00 per 1,000 gallons; All over 13,000 gallons .75 per 1,000 gallons 3 WASTE DISPOSAL: Sewer charges will be of water bill for both residential and commercial users. SECTION 6.

That the City of Magee, Mississippi, as to its waterworks and sewer systems shall provide no free service to anyone as to the same. Further, that the waterworks and sewer system shall be operated on a fully meter basis as to water. SECTION 7. That in order to clearly define the distinction between a residential or family unit user and a commercial user, it is hereby adjudicated that as to two more residential or family units, trailers, duplex apartments houses, or other classifications including trailer courts, which have physical separation and all of same are owned by the same person or persons, each of said users may be individually metered and pay the residential or family unit rate or all may use one meter and pay commercial or other than residential rates. That all rooming and boarding houses may have a choice of classifying themselves as either commercial or non residential or residential as to rates because the Mayor and Board of Aldermen have checked and ascertained that the usage of water by rooming or boarding houses is approximately the same as for en individual residential unit or user.

Thereby rooming or boarding houses may pay either a commercial rate or pay residential rate and they may make a choice as to which rate. That when individuals shall live in one dwelling house with no physical separation between said individuals or family, with no physical separation between said individuals or family, and no physically separated apartments, then the same shall be considered: a family unit or residential user and the residential rate shall apply as to the same. Hotels and motels shall be considered commercial users. SECTION 8. That Ordinance No.

159 in Minute Book 1 at Page 278 thereof and in Ordinance Book No. 1 at Page 278 thereof is repealed. That said ordinance is superseded by this ordinance, and therefore, said prior ordinance is hereby repealed and declared null and void. SECTION 9. That the City Clerk shall publish a copy of this ordinance for at least one time in the Magee Courier, Magee, Mississippi, a newspaper qualified under the laws of the State of Mississippi, to publish legal notices.

SECTION 10. That this ordinance shall take effect and be in force as provided by law or stated differently, this ordinance shall take effect and be in force immediately after the passage of ane manth from the date of its adoption. The above and foregoing ordinance was first reduced to writing and read, considered and approved, section by section, and approved as a whole and in its entirety at this the recessed public meeting of the Mayor and Board of Aldermen held on this the 24th day of July, 1990, at the City Hall in Magee, Mississippi, the regular meeting place of the Mayor and Board of Aldermen of said City, and the vote on its final passage was taken by and A motion to adopt the foregoing Ordinance was made by Alderman James Robert Magee and said motion was duly seconded by Alderman F. M. Grubbs.

Whereupon, the motion to adopt the foregoing ordinance was put before the Board of Aldermen by Mayor Pete Russell, and on roll call vote, Alderman E. O. Berry, Alderman James Robert Magee, Alderman F. M. Grubbs, Alderman Robert Vinson and Alderman Jack Craven voted "yea" or in favor of the motion and the adoption of the ordinance.

Those absent and not voting or voting none. The ordinance having received the affirmative vote of all members of the Board of Aldermen of the City of Magee, Mississippi, Mayor Pete Russell declared said Ordinance to have been duly adopted and to be in full force and effect according to its provisions. SO ORDAINED AND APPROVED, this the 24th day of July, 1990. That said water and sewerage systems were prior hereto constructed with said HUD loan, and that the City of Magee, Mississippi, under said bond issue and contract was required to make certain monthly payments set aside certain funds for repair and maintenance of said systems and the upkeep thereof and other contingent funds necessary for the support and maintenance of said system. SECTION 2. That the City of Magee, Mississippi, prior hereto, and during the year 1980, applied for and received a loan from the Farmers Home Administration for the construction and expansion of the water systern of the City of Magee, Mississippi.
