Wigwam Reg. -low Prie. 99c Friendly Broadcasting Company, an Ohio corporation, filed a complaint here yesterday in Federal Court charging that the owner of KTRG-TV has broken a contract to sell the station for $550,000. suit was against Hawaiian Paradise Park Corporation, owner of the Honolulu television station.

It also was alleged in the complaint that KTRG-TV's owner, David Watumull, is in the process or has sold the' station to someone other than Friendly Broadcasting for a greater price. Judge C. Nils Tavares has ordered Hawaiian Paradise to appear in court at 10:30 a.m. Monday to show cause why a temporary restraining order should not be jssued to stop the alleged sale and cancellation of contract. Katsuro Miho and William H.

Dodd, are Honolulu attorneys for Friendly Broadcasting. A letter written by Watu-muE on April 17 to Richard Eaton, president of Friendly Broadcasting terminating the contract was attached to the suit. Watumull wrote he was ending the agreement because the Federal Communications Commission had not approved the sale within a year after the parties had entered into the contract. This was a condition of the contract which was made January 7, 1966. Friendly Broadcasting pointed out in its complaint, however, that the a i had agreed last December to extend the contract until the F.C.C.

hearing examiner had made an initial decision on the application. No ruling has been rendered yet, although hearings to transfer KTRG-TV's license to Friendly Broadcasting were held in December, 1966, and last January. The F.C.C. has told Friendly there will be no decision until the status of the sales agreement is clarified. Friendly Broadcasting said it will suffer irreparable injury if the defendant is allowed to withdraw the transfer application or sell its property to someone else.
