Yr. Burton Smith. the attorney for the Southern Bell Telephone and Telegraph Company furnishes the company with his opinion upon the tax matter. This is an old question with the telephone- ccmpany. In 1SS9 Mr.

Smith advised the tolephono company that. under the tax art of lESS. telephone companies were not subject to taxation by counties. The attorney general agreed with the attorney of the telephone company and directed the comptroller general to direct the tax collector to collect no txs from telephone companies. Mr.

Srrlth in his recent opinion calls attention to the holding or the attorney general and points out the tact that the tax acts each rear since have been exactly the amf as the arts upon which the attorney general nade his ruling.
